As sad as it is, the truth remain. America is no longer the home of the free. Or the brave. She has been attacked by cowards. Her freedom stripped in the blink of an eye, with the tip of a pen. Yet she did not nor did she waver. Her constitution. her people a million strong would not allow her to be stripped of her glory or damper freedom of all she stood for. But then somehow. someway. It happened! The constitution rewritten, the words now twisted. The very Men that strove to insure freedom to all Americans, are now forgotten their intentions revised. Their effort for naught. Her peoples criesof disbelief, of refusal and of fear for freedoms lost went unheeded, Remain unheard. She had a good run though , over 200 years ! never a tear. She had no fear. She thinks of the indian gentleman. With a tear for the way man was treating the earth. And a tear drop falls.

If only we can awaken the mental cowards to realize that we MUST return to the limitations and restrictions of the Constitution in order to be able to enjoy the fruits of our labor and the freedom and liberty that the Constitution provides; if obeyed. We must remove all of the thieves and scoundrels - for want and usage of a much better word - from office and remove the concept of official and replace it with public servant!

The time when our liberties really started eroding fast was during the New Deal 1930s. That is when the Supreme Court adopted its "rational basis" test that effectively wrote liberty out of the Constitution. As a result, most American liberty is no longer protected by the Rule of Law, and government can cut down our freedom to live our lives as we choose at any time it wants and in just about any way it sees fit. We do not have liberty as a "fundamental right."Only by making basic liberty a fundamental right can Americans again be the free people envisioned by our nation's Founders. When the slave Dred Scott was denied his freedom by the Supreme Court part of the arguement against his freedom included the following.....The Court also presented a parade of horribles argument as to the feared results of granting Mr. Scott's petition:"It would give to persons of the negro race, ...the right to enter every other State whenever they pleased, ...the full liberty of speech in public and in private upon all subjects upon which its own citizens might speak; to hold public meetings upon political affairs, and to keep and carry arms wherever they went."Notice that last part,"to keep and carry arms wherever they went"It was fully understood that it was the right of all free citizens to do so, when did we get so confused as to our 2nd Amendment Rights under the Constitution?

Good stuff, but I have to take exception to the concept of "the rule of law" or that there is such a thing as "the rule of law, not of men." First of all, who makes laws? Men. Second, who interprets laws? Men. Third, who enforces laws or selectively chooses to not enforce them? Men again. It is my considered opinion that democracy is built and liberties are protected by counterwieghts, and it is dictatorships that are built with laws. We all know of the famous checks and balances built into our consitutional government, but then we go directly to the ideas of laws being the essential protector of our rights and liberties. Not so. It is the separation of powers and checks and balances that do the job. And that is where we need to focus in reinforcing that part of our system to keep our freedoms.

God is sovereign in all things. He has a plan for the nations of the world and fo each of us and He will carry it to completion. In Jeremiah 12:17 He says "If any nation does not listen, I will completely uproot and destroy it." He also tells us in other Scripture that "these things happen because you will not listen. He sent the flood in Noah's day! His patience is not endless. We took Him out of our schools, our colleges, our governments and our personal lives. What do you expect? The principals set forth in Scripture have not changed and will not. Praise God, He will carry out His plan !!

Unfortunately, the N.A. colonies started off on the wrong foot. They mistreated and cheated the red skin. Still going on. The "nigger" slave was also mistreated as dogs, some worst. I don't believe the descendants can honestly say everything is super. A faction had written and promulgated the Articles of Confederation. Another faction wished to garner power around themselves and overthrew the Articles and formed the federal Constitution, 1787. I would rather doubt Lincoln would have fomented the war between the states had he been more constrained under the Articles. The 1787 doc. gave too many open ended powers to the fed. gov't and bound to be exploited and burst the chains. Yes, the Articles put the fed. in a straight jacket and retained more power in the states where it belongs. Oh yes, eventually, the fed. under the Articles would over run it because of power corrupts and usurpation is in the hearts of power centers of those so inclined. However, usurpation would have been slowed down drastically and far better than the constraining of the late document. Don't get me wrong it would be just great to get back to the 1787 doc. and once there, constrain it further so we'd see a slower usurpation and bursting of chains. It also takes people to dog usurpers. I'd have a spcl. board of patriots to investigate high crimes and protect whistleblowers.If the author means "central" is "fed." then ok, if not, it gives one the wrong impression that instead of a confederation one thinks he is in a single nation of the whole shebang.I personally and regrettably consider the whole affair so far gone down to the foundation, it's unfixable.It is interesting on the references to the 2d Amend., no mention was made to self defense as so often mentioned elsewhere. Is it the author's contention, as is mine, the right of self defense is stuck in the 9th Amend. rather than in the 2d?God forbid, but I don't believe the Union will be restored to constitutionality peacefully. Hasn't anyone been watching the news how the protestors are treated? In case no one has been watching, it has been met by armed violence of the blue line. Anyone care to be slaughtered Syrian style and before that Libyan style? Why would the U.S. and other nations now starting to arm the rebels in Syria? Libya? As much as the "Occupy Movement" is liberal, what other chances does a patriot have. The Tea Party has been coopted long ago by corporate interest. I believe someone mentioned we educate. Good that is the beginning step, then we start uniting and organizing the forces. If we can awaken and impel 1/3 of the private arms owners, we'd have an army (insurgency) to start with. If not now, when? If not I, then who?

Nicely done essay, but I would mention that Jefferson, who did not have a hand in constructing the Constitution, wrote that the living should not be ruled by the dead hand of their ancestors. He recommended that a constitutional convention should be held every couple of generations; by his back-of-the-envelope calculations and knowledge of typical life expectancy at the time, a constitutional convention should be held every 50-75 years. This is a good compromise between the views of Justices Thomas and Marshall; the Constitution means exactly what it says while it's in force and periodic adjustments to its contents are a given.

When I joined the United States Navy I took an oath to support and defend the Constitution of the United States against all enemies, foreign and domestic. That oath was made with no expiration date.
As a member of the TEA party I am still defending that oath!
