Has Harry Reid Committed a Felony or Just a Misdemeanor?
WASHINGTON -- I have one question about the way Majority Leader Harry Reid has been conducting the Senate. Has he committed a felony or a mere misdemeanor?
The wags will say that a politician from Nevada does not commit misdemeanors, but I am in earnest. The difference between whether Dingy Harry -- as he is known by the eminent political scientist Dr. Rush Limbaugh -- shuffles off to a federal prison or merely pays a hefty fine is significant. I suppose we can leave it to the federal prosecutors to decide, but if he gets off on a misdemeanor I urge it also entail mandatory budget counseling. No one would be surprised to hear of Harry being sentenced to a stint at anger management counseling. Why not mandatory budget counseling too?
Majority Leader Harry's transgression is that for over 1300 days, he has failed to pass a budget. In fact, there is no evidence he has even tried. This is against the law. Federal law clearly requires the Congress to pass a budget every year. I presume the reasoning behind this is that the American people deserve to know where their taxes are going. Putting it another way, why are the American people being mulcted every year by the Internal Revenue Service to pay for Harry and his gang's criminal activities? What are their activities? Are they buying votes with public moneys? Are they favoring friends with subsidies and other extensions of the people's treasure? What about lucre they have extended for "renewable energy," for automobiles no one wants, for every idiot enthusiasm of the so-called welfare state.
For over 1300 days, Harry has been operating his scam without a budget. The House of Representatives has passed budgets in accordance with the law. They have been designed by the law-abiding chairman of the House Budget Committee, Paul Ryan. He has braved obloquy from Democrats and other ideologues for putting down on paper what he would spend federal money on and where the citizenry's taxes are going. Harry has not, and according to the law he ought to go to jail or be otherwise punished. Surely we do not make laws without punishments, do we?
Not all senators are complicit in Harry's intrigues. For instance, the affable Senator Jeff Sessions of Alabama is blameless and actually indignant with his colleagues, Harry in particular. Recently he told my colleague at the Washington Examiner Byron York, "I think it should be a firm principle that we should not raise the debt ceiling until we have a plan on how the new borrowed money will be spent. If the government wants to borrow money so it can spend more, then the government ought to tell the Congress and the American people how they will spend it." York concludes, "One problem, of course, is that the law already requires Congress to pass a budget, and Reid has violated that." I say prosecute him. This is malfeasance on a vast scale.
Whether Harry goes to the can or accepts a lesser sentence -- such as my suggested mandatory course in budget management -- we are going to have to face up to these trillion dollar deficits that the government has been piling up since our smug president took over, Barack Obama. He envisages them for years to come, though obviously if those trillion-dollar deficits do come, life in the great Republic will be very different from what it has been. We have already raised taxes on his hellish two percent, now Republicans have got to insist that President Obama make good on the other half of his deal and cut spending. The way to cut the trillion-dollar deficit is now through budget cuts. The federal government spends too much. It spends money it does not have. In the coming debt-ceiling fight, Republicans, and the handful of sober Democrats out there, should offer suggestions on where the cuts should be.
I have just read a study by the increasingly mainstream Heritage Foundation, outlining $150 billion dollars of cuts in the budget. Patrick Louis Knudsen, the author of the study, points out that many of the cuts are perfectly doable, for they envision the federal government's desisting from undertaking what it should never have undertaken in the first place. Other cuts involve privatization, policy consolidation, eliminating ineffective programs and ending waste, fraud and abuse. For instance, Knudsen's plan calls for cutting $13.5 billion from the Department of Agriculture, $3.5 billion from Community Development, $15.1 billion from Health Care and $15.8 billion from the Department of Transportation. So it goes through every nook and cranny of the federal government, save the Department of Defense. Knudsen does not cut from the Pentagon because he feels that the military is an essential area of government involvement. Presumably he leaves it to the generals and admirals to decide what is essential for the security of the country.
The coming battle over the debt ceiling is the right time to demand our government get its fiscal house in order. If not now, when? As for Dingy Harry, possibly under the threat of prosecution he will smarten up. No one wants to see him go off to the calaboose.

Who will prosecute and who will try him? It's not just Filthy Harry. either. There are 100 Senators. Many of them are equally culpable. IT WILL NEVER HAPPEN.

What do you mean by, "No one wants to see him go off to the calaboose."? I want to see Harry Reid go to prison and never come back! He has already had far too many years to "smarten up." He will never learn. Harry Reid is an enemy of the United States of America. He should be joined in his one-way trip to prison by almost every other democrat in government.

Harry Reid is the problem. It is criminal. Harry Reid has intentionally refused to carry House Budget bills into the process. The Senate has not produced a budget , so there can be no "budget reconciliation", or conference committee. The last time we heard about "budget reconciliation" was when they used that as scam to pass the ObamaCare Bill since they could not pass a version in the Senate.
Maybe Harry has simply forgotten how to make a bill. He seems to know how to change Senate rules, which is what Democrats do every time they win control. Change the rules to shut off debate.
Harry stops the legislative process by declaring all House bills "dead on arrival" ! Then Obama steps up and says "If Congress won't act - then I will". That works out nice for the Leftist Democrat Tyrants....doesn't it.
I wonder if the Judicial branch will ever reign in these despots, or if they too will leave it up to "the people', who do read and understand the Constitution.

Maybe we, the taxpayers, should stop sending our money to DC until Congress can pass a budget?
As long as the "revenue stream" continues and no enforcement of the budget law, what do they care about fiscal responsibility?

Could this mean we are no longer 'represented'. Are we under a 'taxation without representation'? Can we do a W-4 Exempt and get a due process trial (not Tax Court) claiming we are no longer represented in Congress, therfore no taxation?

As I've said many times before, the DOD needs a haircut. There is so much waste (I see it every day) it is appalling. DOD could cut it's civilian workforce by 15% and never miss a beat. Active duty could stand some trimming also. You have too many people with "make-work" jobs and skills that no one uses anymore.

sfj, I agree with you about the DOD. Why do we have civilian guards on the gates at most posts? What happened to MPs, SP, and APs doing the job they are trained for? Why do contractors hired to do maintenace on vehicles when the military has people trained to do those very jobs However, if we are going to cut the DOD, we need also cut welfare, foreign aid, UN dues, redundant programs that do essential the same function but are run by different entities. Job training is a good example of government overkill. We are doomed if the spending cuts aren't applied across the board but I won't hold my breath that any will take place as long as Reid is the Senate leader or Odumbo is president.

Welfare, as it currently exists, should be eliminated - ALL programs. There should be a "safety net" for the aged, infirm and wounded veterans. That's it, no more welfare cheaters, scam artists and lazy losers.

If we could limit voting to those with a stake in the game, IE, no paying of taxes, no vote, we could probably correct the course of our Union, but allowing the leaches to vote, will now be insurmountable as they out number those who pay for their sloth. Only a collapse that is inevitable will correct the problem, that is why the haste to disarm.

A significant fraction of our defense spending is opposed by the services, but it is appropriated anyway as pork for politicians' constituencies.

The way I see it, virtually the entire Congress is knee deep in criminal activity. In this case, Harry Reid is a slimy crook, but he is aided and abetted by a Republican Party with it's head up it's ass. There may be, that's "may", be a handful of Congressmen who actually care about the citizenry. I'm still trying to locate them.

Mr. Tyrell, I have to disagree with a statement you made at the end of this article, “No one wants to see him go off to the calaboose.” I would be quite pleased to see Harry Reid go to jail, I am sure there are MANY of us who would like to see Harry Reid in jail! On the subject of the “blameless” and “indignant with his colleagues” Senator Sessions, I am more than a little curious as to why the Senator is NOT on the floor of the Senate on a daily basis demanding that Harry Reid be prosecuted! I suspect that like all the Republican leaders in Congress, Senator Sessions is INCOMPETENT and a COWARD! It is quite obvious to anyone that Harry Reid is a doddering fool and one of the many sycophants in Congress who are dedicated to the President’s goal of turning our country into a bankrupt Socialist dictatorship! And the current Republican leadership in Congress is going to help them do it! Boehner, Cantor, McCarthy, McMorris-Rodgers, Lankford, McConnell, Cornyn, Thune, Barrasso, and Blunt are INCOMPETENT COWARDS! The President and his liberals know that they can break the law anytime they feel like it and no one will do anything about it! What I would like to know is what ordinary American citizens can do to stop this?! We have a lawless Legislative and Executive branches of government and a Judicial branch with 2 members appointed by the head of the lawless Executive branch and confirmed by half of the lawless Legislative branch! It would seem that the checks and balances of our government are no longer functioning!

Prosecuting elected officials for malfeascance or nonfeascance of office is long over due. Perhaps Sheriff Joe has room for Harry in his prisoner tent city near Phoenix.
I haven't read the Heritage report yet, but Dept of Agricluture is a good target because it includes both the Food Stamp program and the Forest Service each of which is a poster example of waste, fraud, and abuse. I hope the list of cuts included the Dept of Interior. That Department includes the Fish and WIldlife Service which probably exceeds the EPA in destruction of private enterprise through their Endangered Species regulations. It also includes the Bureau of Land Management, Bureau of Reclamanation, and National Park Service. All of those agencies have huge budgets based on goals that they set every year and then fail to accomplish. They don't do what they are told to do and they don't do what they promise to do -- so why do they still get money?

After all the articles over the years about so and so senator being guilty of doing this, and this and that congressman being guilty of something else, why do we bother to waste our time on this? NO ONE IS GOING TO DO ANYTHING ABOUT IT! We are spinning our wheels, and my cynicism just gets more pronounced by the hour. I tell myself I won't bother to read this crap anymore, but it's like a train wreck. You just can't stop!

This is simple: "No budget, no debt increase!"
And lest they fall into the same trap into which even Ronald Regan stepped, it should not be "Come up with a schedule for when you'll have a budget" but "no budget increase until AFTER a budget is passed." Too many times we've been fooled by believing the Democrats about what they'll do "later."
The Republicans have the leverage. The only question is if they have the balls.

Iis ironic. For over four years now the propaganda media has been parroting the White House drivel that "budgets mean nothing" and te White House espouses the logic that America does not have a spending problem. What they mean is, only programs we hate are a problem, such as defense, but our treasured welfare programs & 'green energy' programs, they are worthy. Of the 33 green energy programs this White House has funded in one form or another, 21 rae bankrupt or skirting the edges of bankruptcy. One car manufacturer, took taxpayer money from the Energy Dept., and promptly moved their car making operations to Scandanavia somehwhere. Just how is that helping us? The lies, distortions, half truths & manipulations are incredible. Worse is an Attorney General who is in bed with the White House & will not look into any legal violations & in fact denies anything has been done wrong, at all! Boy are we in trouble. We will have very much to suffer through & fix once this clown is out of office.

All one hundred on the senators should be in jail......elect 100 new ones and maybe something will get done. They are all crooks and liars. Let all the ones who are millionaires go without pay for 6 months until the budget is crafted. I am sick of all of them.
