A Nebraska judge blocked the Keystone XL pipeline route through her state Wednesday, ruling that the Nebraska law approving the route was unconstitutional. The Washington Examiner writes, “Judge Stephanie Stacy said [Republican Gov. Dave] Heineman’s move to approve the revised pipeline plan, as the law allowed, was unconstitutional because it wrested control of oil pipeline decisions from the state regulatory body, the Nebraska Public Service Commission. As such, Stacy ruled the law null and void.” In other words, she ruled the approval didn’t go through the appropriate channels. Clearly, this is another obstacle in the path of a beneficial oil pipeline that the nation needs because the Obama State Department will almost surely wait until court proceedings have run their course before making a decision on approval. As if they needed another excuse to delay it.
