The Department of Justice filed a first-of-its-kind indictment against six members of the Chinese military for allegedly cyber-spying and stealing trade secrets from six U.S. companies. “This administration will not tolerate actions by any nation that seeks to illegally sabotage American companies and undermine the integrity of fair competition in the operation of the free market,” U.S. Attorney Eric Holder said. (Only the administration can sabotage American companies.) “This case should serve as a wake-up call to the seriousness of the ongoing cyber threat.” While the chances of the six soldiers being tried are slim, with the move offending Chinese politicians, we have a Constitution that gives the government, specifically Congress, power to “To promote the Progress of Science and useful Arts” through copyright and “To define and punish Piracies and Felonies committed on the high Seas, and Offences against the Law of Nations.” The DOJ’s move is the right thing to do.
