In 200 years, historians may draw connections between Barack Obama’s phone ‘n’ pen presidency and the rule of James I of England. Columbia Law School professor Philip Hamburger says Obama’s administration, with its web of regulations resembles James’ secretive courts with which the English king set against his political enemies. According to Forbes, Hamburger’s main point is, “Federal agencies, which are under the control of the executive branch of government (no matter how cleverly Congress and the president try to disguise the fact), should have no power to pass regulations that bind ordinary citizens unless elected legislators also codify them into law. Otherwise, Hamburger told me, it ‘creates an incentive for Congress to pass laws without thinking it through.’” More…
