A California school can prohibit students from wearing the American flag on Cinco de Mayo if they fear the student’s speech would cause violence in the school, a federal court ruled. The ruling by the Ninth Circuit Court attacks the wrong kind of speech. In years past, other students, accusing them of racism, would confront students wearing Old Glory at Oak High School on May 5th. Ethnic tensions would escalate with threats and fights sometimes broke out. Instead of going after the students making threats, the school went after the American flag-wearing bunch. In the dissent, Judge Diarmuid O'Scannlain called the ruling “regrettable.” He said the ruling will stifle speech because, “The demands of bullies will become school policy.” More…
