FBI director James Comey said the “dozen or so” Americans who are fighting with ISIL can come back to the States once they are done killing in the sands of Iraq and Syria. “Ultimately an American citizen, unless their passport’s revoked, is entitled to come back,” Comey said. “So someone who has fought with ISIL with an American passport wants to come back, we will track them very carefully.” But isn’t there anything more the United States can do about such treason? This week, the FBI arrested Mohammed Hamzah Khan at Chicago O'Hare Airport because he was traveling to join ISIL. If convicted, he will face a maximum 15 years for aiding a foreign terrorist group. But the administration says it can’t revoke the passports or citizenship of the ISIL fighters, even though the 8 U.S. Code § 1481 says, “A person who is a national of the United States … shall lose his nationality by … taking an oath or making an affirmation or other formal declaration of allegiance to a foreign state or a political subdivision thereof … or … entering, or serving in, the armed forces of a foreign state if … such armed forces are engaged in hostilities against the United States.” We are not at war with ISIL because it’s not a state. We can’t revoke passports of terrorists because ISIL is not a state. Furthermore, soldiers can’t get medals because Obama says we’re not at war because – you guessed it – ISIL is not a state.
