Though we won’t know the Justices’ decision for a few months, the Supreme Court voted on Friday whether subsidies can legally be granted through ObamaCare’s federal exchange. The ruling is so pivotal it risks completely unraveling Barack Obama’s signature achievement. Monday, HHS Secretary Sylvia Burwell touted a new estimate of 11.7 million Americans now supposedly enrolled, “pressing the Supreme Court not to gut the healthcare law,” The Hill reported. According to Burwell, “These numbers show just how important the tax credits are to millions of Americans and to the insurance markets in those states. … Those who support this lawsuit believe that the law should be dismantled or repealed and they are content to roll back the progress that we have achieved together.” She may not realize it, but SCOTUS has made its decision, so pleas are futile. Nonetheless, her remarks strike at the heart of America’s constitutional crisis. King v. Burwell has nothing to do with the number of individuals who may lose subsidies and everything to do with Rule of Law. Unfortunately, conservatives are labeled “unsympathetic” for this view, but government intervention is why we’re where we are today. Getting rid of ObamaCare is a good start, but, until conservative lawmakers come up with an articulate counter to Democrats’ emotional rhetoric, it’s only a temporary solution. More…
