While the Department of Justice declined to prosecute ex-IRS official Lois Lerner, the Obama administration protecting one of its own should not distract from the real issue: the wider culture of corruption at the IRS. This week, U.S. District Judge Susan Dlott ordered the IRS to make public the list of hundreds of conservative political groups that were stymied by the Obama administration. This will help crystalize a potential class-action lawsuit against the IRS. David Martosko of the Daily Mail reported, “Dlott agreed this week that the tea party groups suing the government can pursue their claims that the IRS violated their First and Fifth Amendment rights, along with a section of federal law – Section 6103 of Title 26 – that prohibits the government from releasing private information contained in tax returns.” And such a lawsuit will do more than simply punishing one IRS official.
