Leftists have exceptional disdain for Alabama Supreme Court Chief Justice Roy Moore, who first gleaned the spotlight in 2003 by refusing to purge the Alabama judicial building of a Ten Commandments pillar. Their hostility grew even deeper earlier this year when Moore, who reclaimed the position of chief justice in 2013, ruled that an Alabama constitutional amendment defining marriage as between a man and a woman supersedes the federal government’s reinterpretation of marriage.

Constitutionally, he’s right. The Tenth Amendment states, “The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.” Nevertheless, the Rainbow Mafia took issue with Moore’s administrative order, and on Friday the Alabama Judicial Inquiry Commission formally charged him.

The last time Moore was forced from office, it was the ACLU leading the attack. This time the fight is being spearheaded by the corruptocrats at the Southern Poverty Law Center. According to SPLC President Richard Cohen, “He is such an egomaniac and such a religious zealot that he thinks he can ignore court orders with impunity. For the sake of our state, he should be kicked out of office.”

What Mark Alexander wrote in 2003 is equally applicable today: “Those content to reduce this case to a colloquy on the merits of the Ten Commandments either do not grasp the serious constitutional issue being contested, or they harbor a disingenuous motive to avoid the relevant. The latter group, well represented in the pop media, has framed this case as an insurrection led by a religious zealot and his gaggle of street preachers, thus depreciating its legal significance in order to avoid substantive and instructive discussion about our Constitution.” Alexander concluded, “[T]he issue is not the Ten Commandments but the First and, thus, Tenth Amendments, and how these are to be interpreted.”

If the rampant judicial activism in recent years is any indication, Justice Moore will probably face another eviction. But Moore isn’t just a juror, he’s a patriot. And his not going down without a fight should be an inspiration to all who revere Rule of Law. We’re seeing the same mindset with North Carolina Gov. Pat McCrory in the Bathroom Wars. And righting the ship begins with leaders who show backbone, no matter the short-term consequences.
