It's NOT 'What the American People Want'

It's what our Constitution requires

The oft-repeated mantra of Barack Hussein Obama and his Leftist cadres is that their public service obligation is to accomplish "what the American people want." At best, this constitutes a gross misinterpretation of the constitutional role of the executive, and at worst, it wholly and maliciously discards the intent of that august Founding text.
If not for Obama's patently obvious Socialist agenda, the populist appeal of this mantra might be excused as "constituent services" run amok in response to opinion polling, but its intent is much more sinister. In reality, the words "what the people want" are just code for a political agenda that may or may not have any correlation with what "the people" actually want, and, moreover, any correlation with what our Constitution prescribes.
Worse yet is that some notable Republicans have now adopted Obama's mischaracterization of their duty, which serves only to legitimize this subterfuge.
Our editorial team undertook an extensive review of "what the people want" as integrated into rhetoric supporting political agendas, however removed such agendas might be from their constitutional authority. Here is what we found.
Barack Obama is the most frequent offender:
When he was running for president, Obama asserted: "You know I taught constitutional law for 10 years at the University of Chicago, so, um, your next president will actually believe in the Constitution." In his campaign treatise, "The Audacity of Hope," he feigns appreciation for the Constitution: "I confess that there is a fundamental humility to this reading of the Constitution and our democratic process."
In reality, however, his contempt for our Constitution is unprecedented, and framing his agenda as "what the people want" is a covert assault upon Rule of Law, consistent with his "fundamental transformation" scheme for "change."
Obama packages his assault as follows:
What the American people want more than anything... The American people want to know if it's still possible for Washington to look out for their interest, for their future. ... That's the project the American people want us to work on. ... The fact of the matter is the American people already agree with me. The American people want Washington leaders to act... I believe it's time to give the American people more control... The American people want to see Washington ... make progress on jobs. ... What the American people don't want... That's what the American people expect. ... Get the business of the American people done. ...something this important to the American people. The American people want us to reform... The American people want less... The American people want more... Everybody understands that the American people want us to focus on their jobs...
Ad Nauseam...
Typical of his unmitigated arrogance, when Obama's agenda does not progress, he suggests that the American people are just too stupid to understand it. "Making an argument that people can understand, I think that we haven't always been successful at that. Republicans were able to paint my governing philosophy as a classic, traditional, big government liberal. And that's not something that the American people want."
Obama's Senate lap dog, Majority Leader Harry Reid (D-NV), got the memo:
The American people love government but they don't like too much politics in government. ... The American people want us to work together. ... The Tea Party's unpopularity continues to grow, because the American people sees [sic] how unreasonable they are. ... It's clear that while the American people and Senate Democrats are looking ahead, Senate Republicans are looking for a way to distract the American people. ... I don't think the American people want to do that. ... What the American people wants now is certainty.
Unfortunately, Senate Minority Leader Mitch McConnell (R-KY) is reading from the same script:
Both sides are working hard to reach the kind of resolution Americans desire. ... We know what the American people want. ... Something we know the American people want. The American people want us to put aside the left-wing wish list. ... Democrat lawmakers chose to ignore the American people. ... The American people want us to focus on creating jobs. ... Republicans have a plan for following through on the wishes of the American people."
House Minority Leader Nancy Pelosi (D-CA) is, not surprisingly, singing the same tune:
Democrats now need to talk about how we have a progressive economic agenda. That's what the American people want. ... Let's just do what is right for the American people. ... Those of us who are involved in politics and government know that our responsibility is to the American people.
Regrettably, second only to Obama's invoking "what the people want" is none other than House Speaker John Boehner (R-OH):
It's encouraging to see President Obama acknowledge that the American people want us to focus on creating jobs and cutting spending. ... Our job now is to listen to the people and follow the will of the American people. ... The American people want us to do something. ... The American people want us to scrap this bill. ... When are we going to begin to listen once again to the American people? ... Beginning in January, the House is going to become the outpost in Washington for the American people. ... I hope President Obama will listen to the American people. ... If we don't deliver what the American people are demanding... Instead of living up to the mandate set by the American people, congressional Democrats have defied the will of the American people. ... What we need to do is to listen to the American people. ... If we're listening to the American people, I don't see any problems incorporating members of the Tea Party along with our party in a quest that's really the same. ... The American people want us to focus on their message.
On the eve of his ascension to the Speaker's chair, Boehner, who has had some difficulty citing the Constitution, proclaimed, "The American people want a smaller, more accountable government -- and that starts with respecting the Constitution. That's why we will read it on the floor next week. It sends the clear message that starting on January 5th, the House of Representatives will be the American people's outpost in Washington, DC."
"Respecting the Constitution" because that is "what the people want"? Wrong, start with the Constitution because that is your sacred obligation, if you in fact honor your oath to support Rule of Law, not flippant populism.
Our United States Constitution, as written and ratified, stipulates in its preface that it is "ordained and established" by the people to "secure the Blessings of Liberty to ourselves and our Posterity." To that end, it established a Republic, not a popular democracy, which is to say it affirmed the primacy of Rule of Law over rule of men.
Accordingly, the first order of business for those elected to national office is that they be bound by oath to "preserve, protect and defend" the Constitution under which they were duly elected.
For those elected to the presidency, Article II, Section 1 is clear: "Before he enter on the Execution of his Office, he shall take the following Oath or Affirmation: 'I do solemnly swear (or affirm) that I will faithfully execute the Office of President of the United States, and will to the best of my Ability, preserve, protect and defend the Constitution of the United States.'"
Likewise Article VI, Clause 3 specifies, "The Senators and Representatives before mentioned, and the Members of the several State Legislatures, and all executive and judicial Officers, both of the United States and of the several States, shall be bound by Oath or Affirmation, to support this Constitution..."
Our Founders intended that elected officials, by way of their oaths, would be constrained by Rule of Law. However, there was an errant assumption that those elected would be men and women of honor who would abide by their oaths.
Democrats and Republicans alike, who justify the violation of the explicitly enumerated powers authorized by our Constitution, ostensibly because they are doing "what the people want," are in abject violation of their oaths, and they are not being held accountable for that fundamental breach of trust.
For the record, our editorial staff also reviewed national leadership references to our Constitution, and found few.
Boehner did open the 112th Congress with a bipartisan reading of an "abridged" politically correct version of our Constitution.
Also, in his brief opening remarks to the 112th Congress, Boehner did say, "Let's start with the rules package the House will consider today. If passed, it will change how this institution operates, with an emphasis on real transparency, greater accountability, and a renewed focus on the Constitution."
However, as for his much-heralded revision of clause 7 of House rule XII to specify, "A bill or joint resolution may not be introduced unless the sponsor submits for printing in the Congressional Record a statement citing as specifically as practicable the power or powers granted to Congress in the Constitution to enact the bill or joint resolution," the qualifier "specifically as practicable" undermines any substance this proposal might have had and should be stricken post haste.
This House Rule alteration falls well short of what we really need, The Enumerated Powers Amendment as proposed by The Patriot Post years ago.
Despite the fact that Republican leaders are flip-flopping on what this "Constitution thing" is about, the good news is that most of the freshman class in the 112th Congress are a new breed of representative singularly devoted to our Constitution and Rule of Law.
Perhaps congressional leaders should start with "civics 101," and a thorough reading of our Essential Liberty pocket guide, and this word of advice from George Washington's farewell address: "The basis of our political systems is the right of the people to make and to alter their constitutions of Government. But the Constitution, which at any time exists, 'till changed by an explicit and authentic act of the whole People, is sacredly obligatory upon all. ... If in the opinion of the people the distribution or modification of the constitutional powers be in any particular wrong, let it be corrected by an amendment in the way which the constitution designates. But let there be no change by usurpation; for though this in one instance may be the instrument of good, it is the customary weapon by which free governments are destroyed. The precedent must always greatly overbalance in permanent evil any partial or transient benefit, which the use can at any time yield."

I was screaming inside my head this morning when I saw Obama on the news talking about how Paul Ryan's plan would "violate the social compact with Americans" during his Facebook appearance. What social compact? It is completely ludicrous that this guy ever taught constitutional law.

Why is it that there is not a single voice calling for the president's impeachment: telling the DOJ not to defend DOMA in courts is a clear and in your face usurpation of power of all three branches of government? He is not in Congress anymore, and he is not in the Supremes yet..:) He only has a mandate to implement what the Congress tells him and the SC does not object to, thus he must defend DOMA by default.

On a Fox interview, some scripted dem talking head was pontificating on the self-same subject, and summed it up with all the enlightened brilliance he could muster, that the US is a "Democracy,"
Bull! Athens was a democracy, the US is a Constitutional Republic; and in the end the populous fell under the sway, promises and bribes of charlatans.
All because of what "Greeks wanted" rather than what their city-state "needed."

The U. S. Constitution is the contract between the people, who live in the several States, and a federalist government they created. The contract clearly states what that government can and cannot do. IF THE PEOPLE WANT A NEW DEAL [as Barry seems to think], THEN AMEND OR REPLACE THE CONSTITUTION! Until then the contract holds and if Barry's bunch don't want to abide by it, I'll remind them that it is the SOLE source of their authority over me.

The real question is why isn't some in the Senate and the House going after this guy for violating our Constitution. It is clear he has only one objective and that is to turn America into another third world country. I served 20 years in the military defending America, and I resent this guy apologizing to anyone for anything I or my brothers in arms have ever done. We all agrees to pay with our lives if necessary. Many made the supreme sacrafice just so this bozo could run around apologizing for them. Maybe Obama should tell the prisoners at Auswitch that we were bad people. I think any survivors would disagree.

It is very evident that as America fast goes down the drain like all previous Empires, the more good articles are written by few well meaning Americans! And yes, read by very few Americans. Sort of like shooting in the air? What is so laughable is when writers always say: The American people! Every single politician also uses that, while when they open their mouth, whether Republican or Democrat they basically insult the Founding Fathers! America will continue on the road of self-destruction as long as it fully disobeys the Founding Fathers, as is the case ever more so!

Mark - I understand the point being conveyed, but think you should get rid of the graphic showing a copy of the Constitution going through a shredder. If it were a cartoon, maybe I wouldn't feel the same way, but the realistic photo-like portrayal is akin to those disgusting photos of religious symbols in or covered with effluents. The photo sickens me. Can't we leave that to folks who do not love the Constitution?

American voters should have questioned Mr. Obama's bona fides to lead this country before November 2008. Many, obviously too many, did not. Now we are faced with the consequences of their decision. I suspect many of those now voicing opposition to Mr. Obama may have voted for his pretention. Well so be it. To cry now about that election is pointless uhnless it be as a warning to future electorates. We have got to look to 2012 and decide, here and now, to examine each candidate on his merits and not on what some MSM media hack says about him, or her.
I support John Bolton and ask each patriot to review his record and decide for themselves whether Mr. Bolton is a candidate they could vote for president. A good starting point for your review can be found on Wikipedia. Though it leans left, Wikipedia seems to present Mr. Bolton's record fairly.

This "errant assumption" is undoubtedly one of the "causes" referred to by Rousseau when he wrote, "The body politic, as well as the human body, begins to die as soon as it is born, and carries in itself the causes of its destruction."

I believe Obama taught the Constitution for 10 years - I'll even concede it was the Constitution if the United States. I question WHAT he taught about the Constitution.
The Constitution does not begin with "What the American people want", it begins with "We, the people..."
I swore an oath many years ago when I was inducted into the US Army to uphold, protect and defend the Constitution against all enemies, both foreign and domestic --- I fullfilled my contract about the foreign enemies (and I'm prepared to do it again, if necessary but the time is upon us to defend against the domestic enemies. And, in their infinite wisdom, the framers of the Constitution provided a means to defend against domestic enemies...I'll see you at the ballot box, Mr. Obama.

The problem is indeed that some of The so called American people want abortion, pornography and big government... these people are a risk to national security. They are the enemy within and if they succeed , our Christian based society will be destroyed soon. Unfortunately members of both parties seem to drink from the same spiked punch bowl. Sen McConnel and the President both argue wrongly from the same logical fallacy (Ad Populum), appealing to popularity instead of the facts, ironically found in the US Constitution they swore to support and defend. I think another reading is in order in both houses with a mandatory exam at the end.

The smart half of the country agrees that the constitution is brilliant and would ensure prosperity and freedom to us and the rest of the world if only it were followed. But what is to stop the neo-Bolsheviks from replacing the Constitution with a leftist dictatorship? Is civics education enough to sway public opinion? I don't have that much faith in the masses. Simply arguing that this or that idea is not constitutional is certainly not going to make a single leftist curb his lust for power. Perhaps we need to appeal to an indwelling Morality rather than the constitution?

Exactly, some of the readers have hit the nail on the head. And one more for The Man, Thomas Jefferson. Apparently our little self proclaimed King or whatever he think he is, he isn't. He has trampled all over the Constitution. Apparently he never takes off his golf spikes because he is leaving holes in our Constitution and as far as the Oath of Office, it was much like anything else the automatic mouth says, don't mind what I say, just watch what I do. I have called my Congressman and Senator so many times, I am practically on a first name basis asking the same things as some of our readers, force Obama to open his records and everything else will fall in place and we won't be talking about the same issues everyday. I do not see the intestinal fortitude of Congress to open the books of this President.

Sir, the Constitution allows for Amendment should the majority of the people agree that change is necessary. Destruction of the Constitution, and our country with it, can only be accomplished when an agent for anarchy deliberately abandons the Constitution, or destroys it.

If Barack H.Obama's (that's HO-bama) administrations public service obligation is to accomplish "what the American people want", then when are they going to start doing what the people want? 1. Create jobs other than McDonald type jobs. 2. Energy crisis- DRILL for oil off shore, in Alaska and any other states where it is. 3. Illegal aliens- seal the borders and get rid of those that are here. 4. Health care- get rid of that piece of crap you crammed down our throats. it's worthless, just like you. That list is just a start, there are many more items.
If someone had investigated Obama further, before he was elected, then he should not have been allowed to run. I spent 20 years in the Navy, and if I would have associated with people such as the ones he did, I would probably not have got in. I had to sign papers stating that I never associated with a long list of things. Later on in my career I had a back ground investigation for a clearance to be around nuclear weapons, had I had any association with his associates, I would not have gotten the clearance, and he's the president.
To this day, I still can't fathom the fact that their are enough dumb people in this country to put him in office, but then I sometimes watch Jay Leno, and his Jaywalking sure comes up with a lot of them.
I went to school when your first year was grade 1 and my first six years were in a one room school house. I also went to vacation bible school every summer and some years a couple of times. One of them was Menonite. I graduated from HS on Jun 2nd and Jun 9th left for boot camp. Not much for an education, but I have read all my life, because life is not one big party. I don't know what they teach the kids today, but it sure isn't working.

Lack of knowledge (on the people's part) of what the Constitution is all about has lead us to elect officials in Washington who are also ignorant of it's content. Now I have something to study and learn.

The "People" have always tended to want a king. Freedom is a gift from God, but it requires effort - a king gives you much less, but you don't have to work as hard. Our Founders knew the difference, and gave us freedom; now that freedom is squandered because "the people" are not worthy of it anymore, nor do they desire it. "Freedom of choice is what you've got. Mark, you are so right; Obama says things that sound like a populist, but we have seen the full truth that he is a socialist. What the vast majority of the people want, I believe, is for the President and his comrades to reverse course, before it is too late. But, I agree also that the worst thing is their utter disregard for the Constitution.
Always the optimist, I must say that if we can just hang on until 2012, he will go down hard. By election time there will not be anyone to vote for him except a small number who are as lunatic-left as Nancy Pelosi.

Well, I submit that there are products of public education English teachers and professors (unionized) that profess to have taught the English language as well. Just look at the test scores. Or read some of your local blogs or other written disgraces. Groan here.
Just because he got hired to "teach" that subject or any subject for that matter, doesn't mean the sorry sack was qualified to do that any more than he is to be the president of the United States.

I have many friends who read this blog but refuses to sign up for it, many that do. Half breed comment is raciest. I said I'm educated, I was told, why flaunt it in our face? to them this shows undereducated raciest.

Buzzkill, my grandfather is naturalized. He came over after WW1. My grandmother, they are the original Americans. I am a 3rd generation American, if that means anything these days. When Bachmann got caught on GMA being shown a birth certificate, well my ethnicity is called into question. Perception. When I say 2 governors swear he was born in the state, hey I'm playing some race card. Perception. When I point out the serious candidates believe in the documentation, the focus on if I can run. Again perception.
Quit focusing on race and get on with the major issues and think it through.
As for name calling, I rad, "The anointed one." So someone likes Hannity on FOX. It's his catch phrase. Hey Hannity looks Irish. I know for I was stationed in Europe. Maybe we should question him about his race? Perception.

I love this blog, I subscribe to it. I read the federalist papers once a year. I read the Anti Nicene fathers Once a year. I love seeing where I missed the mark but trust me when I say, the other sides thinks you are the above. Why? Again it's the perception you give.

Unfortunately, the inside the Beltway crowd, Dems and Republicans alike, have no idea what the American People want, because they have never bothered to ask us directly. And further, if they have, they haven't been paying attention to what we are saying. We live in the communication age in which these so-called Representatives and Senators can easily access our email addresses or snail mail addresses and ask us. Oh, yes, from time to time they do send out surveys that ask us how we feel about this or that, but most missives are always accompanied by requests for money to fund the program. I don't want to fund a program, I want them to ask me WHAT I THINK and then act on it.

I am ever amazed at your ability to clearly and succinctly pinpoint the issue. I'm at a loss to understand why no one else seems to to get it. If we'd stuck to the rule of law we wouldn't have the economic mess we have at present. We've got a pretty good crisis on our hands economically, but a better one constitutionally. Understanding and rightly dealing with the rule of law is paramount for the voters and our elected officials if we expect the Republic to survive.

Mark, I am a considerable admirer of the Patriot Post, which sees the world in much the same historical context as do I and which features graceful, historically well informed commentaries on the state of the nation.
As I know that you see things in the context of the Constitution, let me suggest to you that it is the Constitution at the root of all our troubles.
No, not the document as crafted by the Founding Fathers, which is the best prescription for a free society ever devised. I mean the Constitution as Amended on February 5th, 1913.
Whether by design or happy accident, in leaving nearly all taxing powers save customs duties and excise taxes at the level of state and local government, the Founders created a market place in governance: any jurisdiction that got out of line started bleeding business and citizens to better run places. In effect, the Constitution not only gave us a vote every few years at the ballot box, it gave us the far more potent ability to vote with our feet every day.
When discussing this observation with liberals, I always preface my remarks by asking them "if you want to buy a car, insurance policy, a cell phone or anything else, would you prefer to have 10, 20 or 50 potential suppliers vying for your order, or a monopoly or duopoly offering you "take it or leave it"? No one has ever chosen the monopoly.
Why then did we ever think that we could reduce the marketplace in governance without dire consequence? It is the 16th amendment that has incrementally destroyed the Constitution as an economic instrument.
There is, however, a way to escape those chains and restore the central benefit of the Founding plan, which I would be happy to share if asked.

I predict the Constitution will become a museum document, un-read, not followed, and not taught to students in any public school at any level. I predict that because the Congress and the Supreme Court and the Office of the President already do not strictly adhere to the Constitution if they choose not to abide by it. So, as the country devolves into a failing democracy run strictly on the majority rule system, our system of laws, and of course the Constitution will be locked away under glass somewhere. Kinda like Indiana Jones' box that in the movie held the Ark of the Covenant--and maybe in the box next to it in some dusty warehouse.

Perhaps you forget what the "Founding Fathers" said:

The States will continue to exist and govern WITHOUT a “federal” government. I will disagree with the Editor here in that the problem IS the present Constitution. There is no danger or insecurity in the abolition of a Constitution that professes the wrong authority for the institution of governments among men.

The missing factor in the Obama equation is, of course, the assertion that "The American People" reject and dismiss the Constitution. There may be some truth to that, of course: "The American People" is a profoundly spoiled and illiterate bunch. But the way Obama puts it reminds me of
Mark Twain's observation on seeing his obituary:
"somewhat exaggerated".

This should be your poster-article. It sums everything up in a nice, tidy package - it's the Constitution, stupid. The people who put it together weren't saints, as some would like us to think; nor were they evil Masons intent on ruling the world. They were just men, attempting to avoid the obvious and telltale signs of tyranny. And they gave all for the chance for tyranny to rest six feet deep. If people would read a little history, they'd realize that things weren't all that different in the 17th and 18th centuries. All the same ingredients exist today for another Tea Party.

Politicians............just follow our Constitution; verify WHERE (in the Constitution)you have the right to even consider the bills brought before you, WHERE (in the Constitution) it spells out that you have the right to pass such bills, and WHERE (in the Constitution) it (the bill) aligns. We have too much garbage (in the form of BILLS) proposed, voted on, and passed that liberally interpret what the founding fathers "thought". Don't go on what they "thought". Go on what they WROTE! These men were intelligent enough to pen exactly what they THOUGHT!!!!!!!

I believe all incoming Presidents, congressmen and woman should attend classes on the US Constitution before being sworn in and learn what the document is all about. Don't get elected before reading and learning what the document means for this country. You do not need to be elected before learning what is in the US Constitution. How can you abide by the US Constitution if you are ignorant about the document. To Nancy Pelosi, you do not need to be elected to find out what is in the US Constitution.

Excellent article, yes ,if only the corrupt officials from the district of criminals would indeed offer more than mere lip service to the "law of our land". I can think of two things that would greatly put them in remembrance of "the constitution". one being, a new pair of orange coveralls and change of address to the one caught violating it, instead of a high five, and also "term limits". It was never intended for a politician to live in such a corrosive atmosphere as washington d.c. for more than a few years, but for them to do their duty then return to the farm and get their fingers dirty and hobknob with ordinary folk and get their heads screwed on right again. Instead, they hang around d.c. for 50 years, getting rich, bought off, and lose all sense of sanity.
