Our Constitution is on Life Support

That wise old sage, Ben Franklin, was prescient back in 1748, when he issued his simple Rx for success. Unfortunately, the wealth and wisdom of generations of Americans have been progressively supplanted by our central government's exercise of unconstitutional authority.
In regard to wealth, I refer most directly to our government's colossal spending and debt accumulation, and unlawful taxation.
As to wisdom, well, there's not much of that emerging from government-run school systems.
Having already depleted the wealth and wisdom of our great nation, the Obama juggernaut is determined to do likewise to health, that third prong of Franklin's trident. If successful, then we may rightly fear it as a deathblow to the greatest experiment in human history.
Where is Doctor Franklin when we really need him?
Simpletons across the United States and, indeed, the world, are beguiled by the Democrat health scare cacophony. While so much has been said, so too has so little. And, as we approach the seemingly inevitable passage of some such diabolical legislation, almost to a citizen everyone is screaming, "Stop the world, I want to get off!" Indeed, only elitist Democrats are charging full-steam ahead, constituents be damned.
Intentionally lost in all this noise is the Leftist tactic of drowning its opposition in waves of excessive and ever-changing health care minutia. With the devil being so well hidden in the details, this ensures that we remain distracted while Rule of Law is further usurped by the rule of man.
As Patriots, we are summoned to slice through this diversionary blather. And, to obtain proper analysis of this overarching objective, we must seek guidance from our founding documents, the Constitution of the United States of America and its superordinate document, the Declaration of Independence.
In a search of the Constitution, we find that the words "health," "medicine" or "medical" are mentioned -- drum roll please -- not even once: not within the original text, nor within 220 years of amendments. (A search of the Articles of Confederation yields similar results.)
To some, this exclusion indicates that the Founding Fathers were unconcerned about the health of their countrymen. But, supporters of this argument expose their condescension, and it is here mentioned to disabuse them of their disdain. For our Founding Fathers sacrificed so greatly for the birth of our nation -- in both blood and treasure -- that to posit such indifference does a great and grotesque disservice to their honor and their memory.
To others, this exclusion indicates that health care was mercifully omitted since medical care of the 1700s was so "primitive" that the cure often caused more harm than the ailment. They further argue that, given the foresight of modern medicine, our Founders would have surely incorporated universal health care within the Constitution. But, supporters of this argument expose their arrogance, and it is here mentioned to disabuse them of their haughtiness. For the medicine of our Founding Fathers was actually advanced in its day, just as the U.S. medicine of today is advanced, and just as tomorrow it will be thought primitive. This, of course, assumes that we successfully restore Rule of Law.
Alas, we discern seemingly little counsel from the Constitution.
And, as we turn to the Declaration, a search for the words "health," "medicine" or "medical" once more yields exactly zero results. Furthermore, the itemized grievances therein make nary a hint concerning health, even considering the "primitive" conditions discussed above.
Alack, we also discern seemingly little counsel from the Declaration.
However, neither do the Constitution nor the Declaration counsel us with direct verbiage concerning agriculture, textiles, construction and the whole raft of goods and services upon which those everyday necessities of food, clothing and shelter are stationed.
But, the Declaration does aver that all men are created equal, not of outcome but of opportunity; that they are endowed with the right to Life, not a guaranteed good life, not a guaranteed healthy life, but life with all of its miraculous potential; that they are endowed with a right to Liberty, the fusion of freedom and personal responsibility; and that they are endowed with a right to the pursuit of Happiness, the eclectic amalgamation of hopes and dreams and desires and necessities as defined by each individual -- not by faceless, nameless bureaucrats.
Furthermore, the Constitution's Preamble declares that its purpose is to establish Justice, the even-handed application of law to all citizens; to insure domestic Tranquility, the exclusion of class warfare; to promote (not provide) the general Welfare; and to secure the blessings of Liberty, there again, the fusion of freedom with personal responsibility.
So, our founding documents do guide us to proper health care legislation: for it is that which encompasses equality and liberty for consumers and providers alike; that which promotes life above death panels; that which encourages the medical hopes and dreams as defined by each individual; that which constrains, not magnifies, class warfare; and that which secures "the blessings of Liberty, to ourselves and our Posterity."
Anything more than this is an affront to constitutional order and Rule of Law. As Thomas Jefferson so keenly observed: "Were we directed from Washington when to sow, and when to reap, we should soon want bread." And, it takes little thought, or even imagination, to extend his estimation to the current health care debate.
The bottom line is that Article 1, Section 8 of our Constitution, which addresses powers of the legislature, never endowed Congress with authority to regulate or collect taxes for banking, mortgage or automaker bailouts. Neither does it present authority for them to subsidize production or service sectors such as health care. Indeed, James Madison wrote, "I cannot undertake to lay my finger on that article of the Constitution which granted a right to Congress of expending, on objects of benevolence, the money of their constituents..."
Sadly, not one Democrat bill addresses "health care" so much as it seeks omnipotent centralized government power and control, the currency of the Left. However, the proposals certainly betray the Left's condescension and contempt for Rule of Law, along with their frontal assault upon our Essential Liberty.
Patriot Readers, the U.S. Constitution is on life support. To prevent it from flat-lining, we must exude high dudgeon, we must slice through the Left's onslaught of minutia, and we must surgically endeavor with our every thought and deed to restore a healthy Rule of Law.

Not only will those things in the latest health mandates (not discussions, since it is onesided) eroding the Medicare benefits of senior citizens, it will also erode until abolished the lifetime care that was promised to American Servicemen who remained in the service for 20 or more years after they were 65 years old.It seems to me that since earlier demise for older Americans will be the result of this "health bill", at 74 years of age, I should plan to leave this planet five to ten years before I thought I would.

The solution to our governmental problems are simple but not easy to fix. Throw all of the current Representatives and Senators out of office and elect all new. At the same time do away with their obscene retirement and medical plans. Put them all under social security and the same health care the rest of us have. We must take back our government or it will be lost to us forever and we will soon have a dictator as "the one" wants to be.

I have heard the words "this is unconstitutional" so many times with reference to what Washington isdoing as far as dismantling our economy and threatening our liberty.So what is the point of having a Constitution if ithas no teeth.....authority? Where do we go forenforcement of our important founding document?What is the process put in place for times like these? Do we demand that our legislators appeal tothe Supreme Court? Do we just ignore the unconstitutional laws.....what is the procedure?I never hear what we are supposed to do to protectand preserve our nation when our very existence isthreatened by our own government. I need a "to do"list.

I am a voluntary uninsured 64 year American who believes I have the right to chose how to provide for my health care. But it is not a matter of me or my desires, it is not a matter of Medicare or medicaid cuts. It is a clear matter of the Constitution being violated. I have asked in emails to my two senators Baucus and Tester where the get the Constitutional authority for Health Insurance Legislation. I have had no reply. Any person voting for the any Health Care Bill should be voted out of office for a clear violaiton of there oath of office to uphold and defend the Constitution. Government is not the solution it is the problem.

Mark,Very well written. I am reminded of a case, I forget the details now but it was a case that would have required bakers, I believe, to only work a set number of hours in a day. It had been discovered that there was some health issue if they worked more than - 8 or 10 hours a day. As mentioned I forget the specifics. Anyway a number of the bakers, in spite of this health risk were working extra hours for extra money. One of the States stepped in to stop this in the health interests of the bakers. The Supreme Court (in a time when they actually followed the Constitution) ruled that the Bakers were not wards of the state and could choose to accept the health risk. They had the liberty to make a bad decision. Just so people are opting, to save money, not to buy insurance. I know some can't afford it but there would be better ways of dealing with that percentage. It seems to me that the ultimate intention of the Democratic party is to make everyone a ward of the state. Hopefully they will not succeed.

We do NOT have the Rule of Law. We have the rule of selective enforcement of The Law. By passing more laws than can be enforced we make everyone a criminal and then enforce, only, the laws that promote our agenda and collect fees or taxes. If we pass enough laws we can exert total control over all citizens. We need a new law; that when we pass a law we must repeal two that are already codified. Since we can't conform to the 10 original laws we have passed 1000s of exceprions to those original 10.

It is worthwhile to go back and read the history of the Fabian Socialist infection which overtook Great Britain 100 years ago. Government takover of the British health care industry after WWII was the death blow to the once-most powerful nation on Earth. After healthcare, we must realize the socialist sights are set on our bountiful commodities - water rights are under attack right now - and the Socialists will not rest until they control the life blood of industry.

We have the best roads, highways and freeways in the world. We would not think of turning all of our grand highway system into tow roads just because we need some pot holes repaired.That is about to happen to the best health care system in the world.Would someone please get this message to all member of our government and Obama to fix the potholes that needs repair in our health care system. I am copying this essay and distributing it to all of my neighbors. I intend to do this with this publication and others that I think people need to see....to wake them up! Our great Country is being systimatically dismanteled....right before our eyes!!I am "mad as hell, and I'm not going to take it any more".........I MUST act, now! If not me, WHO...if not now, WHEN. More than once, I have seen proponents of government-run health care express anger and dismay at the "fear-mongering" of opponents. For all of their scornful rebuttals to opponents' statements about "death panels" and "overall diminished quality of care", I must ask:Can they guarantee that future administrations shall never allow these abominable offshoots to occur? I, for one, lay claim to no prescient ability - but I have observed historical evidence that, given the opportunity, those with power and authority abuse them. That example - repeated throughout recorded history - constitutes scientific proof, according to the definition of scientific proof.If the proponents of ObamaCare can provide clear and substantial proof that our scientifically-proven misgivings are unfounded, then we must - as rational and intelligent people - accept that evidence.If, however, they cannot provide such evidence, then they must understand and accept our position as valid, and they must not pursue their agenda without assuaging our fears first. To proceed without consideration for one's neighbor is uncivilized and un-American.

Why has not anyone questioned Obama and Congress about eliminating all wage increases for the elderly on Social Security?...Yet congress all voted for huge pay increases for themselves thereafter and support taxpayers paying for huge bonus for all the CEO's, executives and wage increases for banks and others that received bail-out funds of billions of dollars? They cut all Social Security increases for 3 years which all combined would not be as much as their pay increases. And they even plan to take money from seniors health care plan and limit their coverage? And nobody protests? This is absurd and reprehensible behavior! Somebody needs/Must follow up on this total disregard for our seniors and any others it would considered Discrimination!...where is the no more taxes for low income that is always proclaimed by this administration? We are witness to the fact that the democrats are supporting the rich, big corporation executives at the expense of our elderly...all the things they claim the republicans did.... These people have to go!....there is no place for such grave injustice in our govern body. I believe the Democrats have under estimated our seniors and those to be seniors in the very near future...cutting all benefits from Social Security to health care benefits will cost them in future elections for years to come...Everyone is going to be a senior citizen at some point and these concerns will be felt by all soon...Seniors vote and are not going to sit back while this administration and the liberal democrats in Washington walk all over them and force them into the poverty level of existence. The Republicans have a great opportunity right now to push for support of our Seniors and gain their trust to support them in the years ahead and thereby win back the Whitehouse and both houses of Congress in light of what has been taking place with this irresponsible leadership we current see.
