Thanks to a federal appeals court ruling handed down last week, Massachusetts taxpayers must cover the cost of an inmate’s sex change procedure, originally ordered and upheld by a lower court in 2012. The 2-1 decision relates to Robert J. Kosilek, a murderer serving a life sentence and who now goes by the name of Michelle Kosilek. Citing a Supreme Court ruling that courts “must not shrink from their obligation to enforce the constitutional rights of all persons, including prisoners,” the judges claim that “receiving medically necessary treatment is one of those rights, even if that treatment strikes some as odd or unorthodox.” (And what “right,” exactly, are they referring to?) What this means is that taxpayers will be doling out between $7,000-$50,000 to supplement Kosilek’s gender-disorientation pathology.
