The Patriot Declaration

Across our great nation, there is a groundswell of protest against the leftist agenda of those now holding power in the Executive and Legislative branches of the central government.
The tenor of this grassroots movement is growing louder as its number swells and its purpose becomes defined. It is a protest characterized not by a roar for revolution, but by a clarion call for restoration -- repair of our Constitution's authority and return to its standard for Rule of Law.
George Washington proclaimed, "The Constitution, which at any time exists 'till changed by an explicit and authentic act of the whole People, is sacredly obligatory upon all."
Further, as Alexander Hamilton made clear in Federalist No. 81, "[T]here is not a syllable in the [Constitution] which directly empowers the national courts to construe the laws according to the spirit of the Constitution...."
Much less so is there any provision for the Executive or Legislative branches to rely upon interpretation of such language as that in the "Commerce Clause" to justify all manner of government intrusion, such as the newly implemented nationalization of health care.
James Madison, author of our Constitution, wrote, "I cannot undertake to lay my finger on that article of the Constitution which granted a right to Congress of expending, on objects of benevolence, the money of their constituents... If Congress can do whatever in their discretion can be done by money, and will promote the General Welfare, the Government is no longer a limited one, possessing enumerated powers, but an indefinite one... The powers delegated by the proposed Constitution to the federal government are few and defined. Those which are to remain in the State governments are numerous and indefinite. ... There are more instances of the abridgment of the freedom of the people by gradual and silent encroachments of those in power than by violent and sudden usurpations."
Similarly, Thomas Jefferson wrote, "[T]he States can best govern our home concerns and the general government our foreign ones. I wish, therefore ... never to see all offices transferred to Washington, where, further withdrawn from the eyes of the people, they may more secretly be bought and sold at market. ... [W]hen all government ... shall be drawn to Washington as the center of all power, it will render powerless the checks provided of one government on another. ... Were we directed from Washington when to sow, and when to reap, we should soon want bread."
Undoubtedly, the author of our Declaration of Independence would have already demanded, again, that the Tree of Liberty be refreshed with the blood of Patriots and tyrants.
Those at the helm of the federal government, by way of overreaching executive orders, legislative malfeasance and judicial diktat, have abandoned their sacred oaths to "support and defend the Constitution of the United States against all enemies, foreign and domestic," and to "bear true faith and allegiance to the same..."
Though our Constitution provides the people with an authentic means for amendment, as prescribed in Article V, liberals have altered that august founding convention well beyond any semblance of its original intent.
They have expanded its scope beyond recognition in order to win the allegiance of special interest constituencies, who then ensure perpetual re-election of their sponsors, by way of political and economic agendas structured on Marxist-Leninist-Maoist collectivism.
Short of revolution, and consistent with the restoration of Rule of Law, we declare that our government's scope must be contracted to its original constitutional intent. We understand that it will take political courage, time and deliberation to undo all the insult to our Constitution, but undo we must.
If we fail to accomplish this task, and Rule of Law is overwhelmed by the rule of men, tyranny and anarchy will prevail, and the ultimate arbiter of the law will depend not upon constitutional rule but ultimately, and crudely, upon which of the rivals possesses more firepower.
As a standard-bearer for Essential Liberty, the restoration of constitutional limits on government and the judiciary, and the promotion of free enterprise, national defense and traditional American values, The Patriot Post has received calls from grassroots leaders across the nation to put forth a conservative manifesto -- a plan of action to restore the integrity of our Constitution. After great deliberation, today we are releasing The Patriot Declaration (see PatriotDeclaration.US), in order that we might rally around a uniform proclamation to restore Constitutional Rule of Law.
(Note to Signers: This document is a "Declaration of Cause and Necessity" and as such, it is not a petition of grievances, but stands on its own as an resolution of intent for all Patriots who sign it, as due notice for those who would abandon their oath to "Support and Defend the Constitution" and abuse their office to the detriment of individual liberty and states' rights.)
As Benjamin Franklin said famously when signing the Declaration of Independence, "We must, indeed, all hang together, or most assuredly we will all hang separately."
Who are "We" in support of this Patriot Declaration?
Preamble to the Patriot Declaration
We are American Patriots, defenders of First Principles and Essential Liberty.
We are Soldiers, Sailors, Airmen, Marines, Coast Guardsmen and public servants standing in harm's way at home and around the world, who are loyal, first and foremost, to our revered oath to "support and defend" our Constitution.
We are mothers, fathers and other family members nurturing the next generation of young Patriots. We are farmers, craftsmen, tradesmen and industrial producers. We are small business owners, service providers and professionals in medicine and law. We are employees and employers. We are in ministry at home and missionaries abroad. We are students and professors at colleges and universities, often standing alone for what is good and right.
We are consumers and taxpayers. We are voters.
We are not defined by race, creed, ethnicity, religion, wealth, education or political affiliation, but by our devotion to our Creator, and the liberty He has entrusted to us, one and all.
We are Patriot sons and daughters from all walks of life, heirs to the blessings of Liberty bequeathed to us at great personal cost by our Patriot forebears, confirmed in the opinion that it is our duty to God and Country to extend that blessing to our posterity, and avowed upon our sacred honor to that end. We are vigilant, strong, prepared and faithful.
Patriot Declaration
We the People, blessed with the inheritance of Liberty paid for with the lives and fortunes of Patriots before us, hold these truths to be self-evident, that all men are created equal, that they are endowed by their Creator with certain unalienable Rights, that among these are Life, Liberty and the pursuit of Happiness, that to secure these Rights, governments are instituted among men, deriving their just powers from the consent of the governed, and that whenever any form of government becomes destructive of these ends, it is the Right of the People to alter or to abolish it.
WHEREAS, our nation is at a critical historic juncture, where we must choose between Rule of Law and rule of men; and
WHEREAS, our nation is confronting significant political threats to Liberty from within our borders and from enemies abroad; and
WHEREAS, our national Constitution is the singular guidance for Rule of Law and the defense of liberty; and
WHEREAS, our Constitution's Article VI Section 1 stipulates, "The Senators and Representatives before mentioned, and the Members of the several State Legislatures, and all executive and judicial Officers, both of the United States and of the several States, shall be bound by Oath or Affirmation, to support this Constitution…" but the majority of those aforementioned have forsaken their oath to support and defend our Constitution, placing the future of American Liberty at great peril;
THEREFORE BE IT RESOLVED, We the People of these United States, in order to restore a more perfect Union, re-establish Justice, re-insure domestic Tranquility, provide for the common defense, promote the general Welfare, and secure the Blessings of Liberty to ourselves and our Posterity, pledge to support and defend the Constitution of the United States of America, as established at great cost in lives and treasure by our Founders and defended by generations since, and we demand that those in the Executive, Legislative and Judicial branches of our national government likewise honor their oaths, and commit to undertake the following actions to restore constitutional integrity and Rule of Law:
FIRST, that constitutional authority be established for any national legislation entered before Congress, by way of an Enumerated Powers Amendment, requiring specific authority enumerated in our Constitution empowering Congress to enact such legislation, thus ensuring that such legislation does not amend the plain language of our Constitution, which prescribes its own method for amendment in Article V;
SECOND, that said Amendment require that all legislation explicitly cite its compliance with the Tenth Amendment of our Bill of Rights, "The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people," thus prohibiting the central government from usurping the powers reserved to the States or the People;
THIRD, that said Amendment require all legislation and regulation imposed upon the nation apply equally to all members of the Executive, Legislative and Judicial branches of government;
FOURTH, that fiscal responsibility be enumerated in our Constitution by way of a Balanced Budget Amendment, including zero base-line accounting principles, to be put before the states and the people;
FIFTH, that said Amendment contain a provision requiring a three-fifths majority of votes by members of Congress to raise direct or indirect taxes, and acknowledgment that the legislature has no authority to raise taxes for purposes that are not expressly authorized by the Constitution;
SIXTH, that said Amendment contain a provision that direct taxes be levied at an equal ratio to all Americans, ensuring that the cost-burden of government is shared equally by all, and consistent with Article I, Section 9, which provides "No Bill of Attainder or ex post facto Law shall be passed" which would unduly single out individuals or minority groups for undue punishment;
SEVENTH, that said Amendment contain a provision that the withholding of taxes by an employer is the option of the taxpayer;
EIGHTH, that said Amendment acknowledge the interdependence of economic freedom and political freedom by provision that any bill before Congress must enumerate its implications against the exercise of free enterprise;
NINTH, that a Legislature Accountability Amendment to establish term limits for all members of Congress, similar to that of the 22nd Amendment, Section 1, limiting terms for the Executive, be put before the states and the people; and,
TENTH, because Rule of Law, established through the Laws of Nature and of Nature's God, entitles the People to unalienable Rights including Life, Liberty and the pursuit of Happiness, and severely limits the government from any infringement upon those rights, then any member of the Executive, Legislative or Judicial branch in violation of the Rule of Law established through our Constitution is subject to impeachment and criminal prosecution.
THUS, be it known that for the support of this Declaration in defense of the Rule of Law established by our Constitution, it is, with firm reliance upon the protection of divine Providence, that we mutually pledge to each other our Lives, our Fortunes and our sacred Honor.
Fellow Patriots, throughout history the burden of ensuring that the flame of liberty burns bright has fallen upon the shoulders of a few patriotic men and women. But as Founding Patriot Samuel Adams noted, "It does not take a majority to prevail ... but rather an irate, tireless minority, keen on setting brushfires of freedom in the minds of men."
Through this Declaration, we, the tireless minority, publicly deliver hope and inspiration to our countrymen and, indeed, the world, and we send a message to those who have forsaken their oaths to support and defend our Constitution, who have abandoned Rule of Law for selfish pursuits: Don't Tread on Us, or you will surely suffer the consequences.

Now that the Heath Care bill has been passed, I think it would be useful for somene to list out all the infringements on liberty that are in it. This should include items that used to be handled by state or local government and are now handled by the federal government as transfer of governing from the local to the federal level is a loss of liberty that many fail to recognize.

It is too bad the even Reagan put us on this path. When the breach of individual rights were given up in the, what seemed to be a good idea, WAR ON DRUGS the path to hell as they say has been paved with good intentions. Now instead of a war on drugs it is a war on terror and our rights for most anything are gone. The fed's have all the power and you can now see the final nail being driven into the coffin of the Constitution and the Amendments thereof. they are just peices of paper and memories as our way of life have been taught out of our children and socialism is the for the common good.

So much of what you and similiar right thinking folks put before us is like so much preaching to the choir. Word words. To recover from where we are now requires more informed and active voters. I hope you and the others can reach the uncomitted. Maybe we all need to be encouraged to spread the word. Below is my attempt. I am certain you can do better.
This is an open letter to all those who supported the tea parties and have joined their movement. By now you know elections do matter. All the rallies, emails, phone calls, faxes and whatever did not get the job done. Your passion was worthless. The Progressives have gathered more power unto themselves as they worked to transform our country, and they did it against the will of a clear majority of the people and contrary to the constraints of the US Constitution. Their process is not unlike that used by Hitler to gain control of Germany..
Did you vote in recent elections? If not you deserve what is coming. Our freedom was gained by those who walked barefoot in the snow with Washington and has been protected by all who gave sweat, blood and life since. The correct process requires you to make informed votes. If you won’t do that you can’t call yourself a patriot.
If you are one of so many who didn’t vote please don’t repeat your mistake; become informed and commit to voting in future primaries and elections and encourage others to do the same.

I would suggest inclusion of a clause regarding the sound nature of a gold-backed dollar/gold standard. Any fiat currency is ultimately prone to manipulation for the benefit of the state and tyrants. Restoring honor and integrity in our currency would do wonders to limit the ability of government to expand the welfare/warfare society. The Founders knew this, and so they declared gold and silver to be the only legal tender, and prohibited any states to use paper money. They did not imagine that we would be so foolish as to delegate the issuance of our currency to a private bank. It is time to reclaim control over our monetary system, restore its integrity, and place antural constraints on the growth of government by doing so.

The line item veto sounds good, but it really does equate to legislating which is the responsibility of Congress. The best way is for the President to give advance notice to Congress and the American people that he will veto the entire bill containing the objectionable item and give a rational explaination of why. That puts pressure on Congress to be more thoughtful of what legislation they pass.

Mr. Alexander,
Your continuing efforts are greatly appreciated. Sadly, as nice as this Declaration sounds, the reason we are in this current state is that our constitution is flawed and allows for interpretation. You have quoted many of the framers repeated warnings to their posterity regarding the dangers to our freedoms and the means to the losses thereof. Not one of their warnings have been heeded by conservatives and all have been exploited by the left for the last hundred years. Even Abe Lincoln did before that.
For your declaration to have any muscle, it must include recommendations and pledges to plug the holes as it were in our constitution. We now know definitively how the left works. Remember, half this nation's populace actually votes consistently for leftist agendii. We have finally reached a true dichotomy. There exists no middle ground. Additionally we have no convenient Mason-Dixon line to geographically delineate two opposite-minded peoples. I am certain that since both mainstream parties have imported millions of third world peoples for the last 60 years and have made no attempt to protect the descendants of our founders, we will be swept aside much as our forefathers did the Red Man. We have reached a crossroads that must certainly cause us to make a very difficult choice between 1. Pressing on with the bureaucratic and non violent actions using a system that has been corrupted against us, or 2. Accepting that there are two distinctly opposed ideologies coexisting in every neighbor hood and in many cases family in the U.S. and that at some point the same price our founders paid must be repaid. The ideologist might find some means to bring about a peaceful division of the U.S. land mass into two separate countries where each side would be free to live under the ideology they choose. Sadly again, as you are well aware, the left is financially dependent upon the ethic and productivity of the right and will not let go that teat without a fight. We conservatives can continue as we are now, enabling our own oppression through our continued allowance of horrific taxation and submission to numerous unconstitutional laws, or we can break the cycle and organize and mobilize to stop the tyranny in the manner our founders did. Time is running out. The consolidation of power is nearly complete and out economy has months to perhaps a year an half before it will collapse under the burden. At that point, you can bet a more martial means of control will be enacted. When faced with bullies, no matter how many with no avenue of escape, you know the tactic. Hit fast and as hard as possible to break out and seek more help or at least buy time to build forces and a position of greater advantage. Bullies never stop until they are disabled severely, driven out, or killed. Think again about this declaration.

I agree wholeheartedly with your declaration; but would add one item to the section on term limits. Specifically I would propose that the term of service for any Federal Judge (including those appointed to the Supreme Court) be limited to one term of 15 years.
That would put some limit on the damage an individual judge could inflict on the nation, while still giving at least the illusion of complete independence from party affiliation.

I will keep this brief. The Republican Party which is not conservative never had a chance in the debate over health care reform because they allowed the Democratic Party to frame the argument as one about humanitarian behavior. They should have refused to engage in that debate and rather argue the Constitutionality of the proposed law. It is obviously Unconstitutional on my levels when interpreted and understood in the language and events of the day in which it was written. Redistribution of wealth, forced purchase of a private product, to name only two. You quoted Madison, the author of our Constitution and rightly so. I would, if you aren't aware of it point you to a Constitutional lesson by Davy Crocket. This should be mandatory reading for all public school students and individuals seeking to be nationalized citizens.
And lastly, Americans must be made to understand that there is no such thing as corporate taxes. All taxes are passed down to the retail buyer. It's simple. A producer must earn a profit. Taxes cut into his profit. The producer passes the taxes along as a business expense in the sales price. The end user has no one to pass his cost to. The retail buyer pays all of the taxes. It all seems good. And I do support it.
A balanced budget is necessary to prevent government collapse. However, zero-based budgeting was the cornerstone of the Carter administration, who up until now was acknowleged as the worst president ever.
No flat tax measure is good unless it has a specific perecentage limit. I learned in Economics 101 my first year in college that a properly managed government requires 5% and no more to operate in a fiscally responsible manner.

Hear, hear! I heartily support the 'Patriot Declaration'! I served this great nation for 20 years in its military and would do so again. I also, currently, have three sons serving military positions to defend and uphold this nation. But, I am ashamed to say, this is no longer my country. Current political postures have relegated this nation as something closer akin to Russia, China of some other socialist government - and I want MY country back. Push on Mark, I've got your back!

However we are alaso obliged to note that some of the 'liberals and collectivism' refered to, are in the Republican party as well. They must be excised from the conservative body, just as a tumor would be !

I have learned more about the intent of the Constitution from reading the Patriot post for 1 year than in 16 years of public and college education. Essentially 99% of the public education system in the US has been completly co-opted by usefull idiots of the "professional educator" class. The oath sworn by elected officials and our military,to "protect... the Constitution" finally makes sense,...it seems to late for seizing the system back. The left and the press bar the doors of widspread clear education of the truth to the masses who only seek the next entitlement. My paraplegic wife works harder in a day than most citzens with their hand out accomplish in a week.

There is one comment/suggestion and I hope you do not dismiss it as carping. I think it is quite important.
A balanced budget amendment would require that revenue equal expenditures. It does not admit of a budget surplus allowing for reduction and eventual retirement of the debt. Debt pay-off is probably our third most important problem, after the schools and the annual deficits.

The article on the witholding taxes by employers should be removed in its entirety. The system works well for most taxpayers, as it is less painful than gathering funds together once a year. Also there is less opportunity for cheating.

First, here are my bonafides: I am an honorably discharged US Navy veteran of the cold war and Vietnam. I am a life member of the American Legion. I am a former deputy sheriff & police office who still holds a current peace officer license. I retired from the federal government with 31 years of proud & faithful service in keeping the flying public safe.
I have tried to stay active in politics, and although I didn't agree with the Republican's spending spree in the Bush years, I stayed dedicated to my country. Now that the liberals are in power, and that's a key word, power, I have seen my country change for the worse. When the health care reform bill was spirited through the night and signed by Obama I felt as though someone had knocked the wind out of me and I wept for my country and its dismal socialistic future. I'm too old to have much fight left in me, but you young people, if you want to see the greatest country on earth destroyed in just a few short years, just sit on your backsides and do nothing. The country will self-destruct by itself. On the other hand, if you care anything about your future and that of your children and grandchildren you must mobilize to take back our country in 2010 and stop this government expansion and further loss of our freedoms. You left out one point in your Patriot Declaration-if a percentage of government revenue is not dedicated to national defense,when leftists are in power,they will simply balance the budget by taking money from the defense budget,thus weakening our nation under a constitutional mandate.
I am pessimistic about getting this proposal passed on to the states for ratification.Why not an alternative while trying to pass this?All Senators and Representatives who do not vote for a balanced budget recieve no salary for two years.

I think your Patriot Declaration is terrific as far as it goes.
The problem is that like our Consitution it is a "toothless tiger". No matter what is written into
it unless there are consequences to be paid by the "oath breakers" they have nothing to lose.
If you break your oath to tell the truth in a courtroom you will be charged with perjury and made to suffer the conequences.So the question is why are the "oath breakers" of our Constitution not at the very least charged with perjury. The obvious answer is of course because they are ALL
doing it. In my humble opinion there needs to be an Amendment to the Consitution that provides that any such person who does break his sacred oath shall forfiet ALL his worldly goods and sent into exile.And also any one who aids him/her in hiding their assets shall suffer the same fate.

I have just signed the Declaration. I was among the 1st 1000 to sign and I do feel proud of that.
I firmly believe that, to make this Declaration work, we cannot allow any former politicians, lobbyist, bureaucrats, etc. to get involved in any of the actual legislation. These people have failed us previously by allowing the situation to reach this current boiling point. They should not be allowed to fail us in the future.
Our Nation and our Wao of Life is much too important to be left to the professional politicians and their ilk. The only people that should be allowed (by us, not the law) to run are those that truly want to fix things and then get out of the way.
The only money that ANY lobbyist should be allowed to spend on ANY legislator ANYWHERE is $10 for a sandwich and coffee. The legislator should never be put in the position of having to decide the worth of any legislation based on the perks received or anticipated.
No candidate for office can receive more than $100 from any contributor during ANY election cycle. That means $100 for any member of the House every two years. Senators are luckier still, every six years. The limiting factor is $100 period; from individuals, families, PACs, groups, etc.
The idea of Federal matching funds is basically good and in this case would actually work as intended.
NO INCUMBENTS in 2010, 2012, 2014, etc. Each person running for office must do so with the knowledge that their time is brief and they must make the most of the opportunity (ies).
Term limits are a MUST. In fact, I believe that all terms in office should be four years in length. Staggering the inauguration dates by every two years so that 1/2 of the Congress will be new every two years is an interesting concept.

By the way, wages: $1.25 per day per person, and $2.00 per days extra, if you furnished a horse and wagon. Total: $3.25 per day. You could feed a family of 4 on $15.00 per month. Point: Every generation has its WPA or 18 billion dollars work bill and every generation has "broke the Government, with uncontrolled spending". So patriots arise, the world as we know it is ending!

Alexander's Essay of 3/25/10 not only brought me to tears at the losses we have suffered in what is currently an oppressive congress, but struck a cord of fear at the realization that if we aren't successful in defeating congressional intrusion in court/through legal routes, we may once again be forced to take up arms in defense of our constitution. Not only is this White House ignoring everything said by George Washington (that our Constitution unless changed by the Whole people are obligatory to all) they are erasing his image from our quater. We will now see historical sites on the quarter. This might seem small, but it is yet another, both sybolically and literally, a dismantling of our American history and heritage. The mantra and goal in Washington is "disrupt, dismantle and destroy" and they are doing it daily and doing it well. While I applaud the effort, I find the passing mentions of the hand of Divine Providence, the author of all of our rights to be disturbing in their paucity.
While I understand the impulse to include term limits, I must disagree. We have term limits. They're called elections. If We the People are so lazy as to ignore our responsibilities in the electoral process, or if we have become so corrupt in manners as to be unable to discern good character in the people we elect to office, then we should suffer the consequences of that lack - as we are. Such a consequence will, with the help of Divine Providence, encourage us to seek His face and his will once again, at which time He will surely grant us the necessary discernment and courage to restore ourselves, as He is doing. Removing the consequences of the choice to ignore common sense and good character in our leaders may provide an easy button for the majority of the voters(as does party politics), but easy is not the same as right and convenience os a pathway to destruction.
I applaud your efforts and offer you a sincere Thank You for your excellent publication.

I signed the petition and am in total agreement with it. Two questions:
1. What will become of it?- Who will it be presented to? The President, the Courts and most Congressmen don't care about it.
2. If there is success, how far will Constitutional integrity be restored? Will we end at aiming to repeal the unconstitutional health care? What about Medicaid? Medicare? Social Security? Farm Subsities? SCHIP?
I think the real problem is not with the wolves in Govt. but with legions of ignorant and immoral fellow citizens who vote them in.

A marvelous proclamation! It overlooked one thing that I consider vital as it is the cause of 99% of all problems in Washington. The Term limits must be so set that there is no need for re-election! One term only! That can be set at any number of years deemed productive, but no re-election. The benefits are so obvious that I will not enumerate them. How about inserting that in the paragraph about term limits?
Additionally, no cushy pensions. These are citizen representatives serving country by chcice. A payback for their blessings received. A gift of a few years, then a return to business and family. This may be elaborated in the clause on officials being bound by the laws placed upon the rest of us. If there be a Federal pension for the little people, these elite must limit themselves to the same.

The IRS's encyclopedic code and it's massive Departments need to be abolished and replaced with a new simplified code that applies to all equally on earned income. With reasonable standard deductions for common living expenses. No sweet heart deals for businesses of any kind.
The Legislative and Executive branches need to have their office staffs limited to a reasonable number of assistants. The presidents wife is not and elected official and needs nothing provided at government expense, except one social secretary.
In general, the Government has grown to large to be managed. No one even knows how many departments exist anymore and how much money is being wasted. Abolish them all and start over. Limiting the size and complexity to something the common man can see and understand.

Term limits are good because the longer someone is in DC, the more likely they are to be corrupted by it. In addition, all the while they will be building a 'special interest' network, and sustaining that network will become their chief objective in order to secure perpetual reelection. A legislator's primary interest needs to be abiding by the Constitution, regardless of whether it will get him reelected or not.
To clarify: 'special interest' refers to any person or group who's interest is other than Constitutional government.

There should be a federal law that any person elected to Congress, and to the Presidency will - before they can take their oath of office - sign a notarized statement that they have read and understand the Patriot Declaration and that they will abide by its precepts or face immediate dismissal from office. This parchment we are signing hopefully SOMEONE in Washington DC will take notice and recount their ways. I remember in this book i once read about a bunch of farm animals that got tired of being abused by Farmer Brown overthrowing him and taking care of themselves. We MUST continue the fight for our Liberty as my 5th great grandfather, John Gillon, did. Though he was not a signer of either the Declaration of Independece or the Constitution, he was a Patriot soldier. I do not want him nor our Founders nor any of those who came after them to have fought in vain. Please let me know what we can do next. I have written, called and e-mailed my senators and representative until I am blue in the face but to no avail. The other day I had displayed before my eyes a true example of a Liberal...aka Progressive.
A young man was begging for $2 to ride the bus. A professor walked by, and then went over to an acquaintance of his. He asked if had $2. He did. The professor then walked back to the young man and gave him the $2. The professor turned back with a huge smile on his face for having helped this young man.
So what's a liberal? A person who uses someone else's money to help another and then feel good about it.
By the way...the young man never got on any bus and the acquaintance never got his $2 back.

It is the duty and responsibility of the People to determine whether or not their elected legislators have become corrupt during their tenure in Washington and to vote accordingly during the next election cycle. The tendency for power to corrupt is not an excuse for a free people to adopt the "easy button" of term limits.
If We the People would have the truly authoritative place in our nation's government - that of the supreme authority(although not exceeding the authority of our Creator)- that our founders envisioned, we would also recognize our responsibility to prevent the men/women of good character whom we have elected from becoming men/women of poor character by voting them out at the first indication that their character is becoming degraded by their work in the nation's capital.
Term limits are not a proper tool for a free and responsible citizenry. Discernment of good character, on the other hand is an essential tool for such a people. We have lost or puposely discarded the ability to discern good character, trading discerment for moral relativity even towards those to whom we grant the priveledge of legislating for our own and our children's futures. Unless we regain such discerment, and the will to act in consideration of it, not all the declarations in the world will help us.

Much of the mischief being done is accomplished by the courts, especially the Supreme Court which has gone far beyond the powers granted it by the Constitution. Supreme Court Justices were to serve for the term of their "good behavior." Since it's doubtful that we can all agree on what constitutes good behavior, I submit that we must put a limit on how long they can serve so as to limit the damage they can do. I suggest one term not to exceed 15 years with no possibility of reappointment.

Nice start, but term limits result in an increase in power of the professional staff who are unelected. In Ohio we had this for the house and senate, and there was only a weak elected group of officials and powerful bureaucrats who ran everything.
Instead of term limits, go with no campaign spending limits and full and immediate disclosure of donors.

Mark: These are all admirable qualities and ideals to be emulated, carried forth, and legislated. Our challenge in the country is that our public schools in general teach our constitution as a historic rather than living and relevant document. Dallas had a congressman in the middle of the 1900s named Bruce Alger, a WWII fighter pilot and devout Christian gentleman who was a friend of mine. His yardstick for national legislation was simple. Two questions. Is it constitutional and can we afford it? How far have we left ever even asking those two questions?

Thank you for "The Patriot Declaration". Great work, especially the third action mandating that all legislation apply equally to all citizens. But I think you don’t go far enough in the sixth and seventh actions regarding the levying of taxes. Most of the problems we face today took root or were enabled with the passage of the 16th amendment. Why not return to the original intent of Article 1, Section 9 of the United States Constitution? Break the money connection between the central government and individual citizens and most of the checks and balances between governments will be restored.

Unfortunately when you argue the constitutionality, or lack thereof, of the actions of our current government, specifically the executive and legislative branches, you ignore the judicial branch and its effect. For at least 150 years or more, the federal courts have been unwilling to interfere in any way with the congress unless an act wherefrom be an egregious affront to the constitution. More importantly, they are loath to reverse any precedent set by an earlier court. Given the unlimited powers interpretation of the constitution over the past 150 years by the Supreme Court, I am totally unconvinced they will now correctly construe the constitution and strike down Obamacare or any portion thereof.
Regarding the constitution, the 10th Amendment, to which everyone seems to want to cling, has been rendered impotent by the courts and seems destined never to be resuscitated. The “regulate Commerce… among the several States” clause of section 8 does not say “who” the congress is to regulate, only the “what.” In its simplest essence commerce entails a buyer (citizen) and a seller (government/insurance) to conclude a transaction. If the government can control the process (commerce), it can control both of the parts that make up that process. Though I pray otherwise, I do not foresee the Supreme Court overturning 200 years of its own precedence.

Though I agree with the ideas presented; and a patchwork coat looks great if that is the way it was designed.
But, when referring to a legal document, that I only hope is meant to be easily understood, the final document should have very few Amendments before it is completely rewritten.
Our present Constitution, with is 20+ amendments tends to force the reader to flip pages and try to figure out what was removed and what was replacing it.
If we are talking altering or abolishing the present Constitution and replacing it with what I might hope to be an improvement and not merely a "change", I am all for this since WE... the People of these united States ALREADY have all the LEGAL authority we need to rewrite our Constitution and redefine the powers and authority of our politicians.
That LEGAL instrument is most commonly referred to as the Declaration of Independence, July 4, 1776.
Unfortunately almost nobody recognizes the lasting legal importance of the Declaration, which is (in my opinion) the primary cause for which we find ourselves in our present political predicament.

I agree with all the principles of the Patriot Declaration but have strong reservations about one: Congressional term limits. I remain concerned that it would have the opposite effect - it would disproportionately empower unelected Congressional aides (as they would remain the constant) and keep the representative, those designed to be closest to the people, from being elected by those people at their discretion. Parliamentary systems, for example, with weak individual members of parliament tend to create extremely powerful bureaucracies - even more powerful that what we already have.

I suggest a provision to insist that all legislation be passed by a positive vote, no more of the parliamentary shenanigans we have just witnessed and no more legislation passed if there is no objection (i.e. Congressional pay raises). All federal government employees, including our President, Members of Congress and our Judges must be responsible and held accountable for their actions. If they willfully violate our Constitution they should be impeached forthwith.

What a fine piece today's Patriot Declaration is. I wish there was a place where we could all sign it, and it could be published nationally.
The only disagreement, if it can even be called such, that I have is with the final paragraph: your warning for those who have trampled the Constitution not to trample us Patriots, or suffer the political consequences. Much has been said and written since the Obamacare vote about retribution in November, and that is my dearest hope, but it is wedded to my greatest fear. The very next piece of legislation which is probably ready to go as I write will grant amnesty and citizenship to the 20-30 million illegal aliens in this country. I am so afraid that this legislation will be railroaded through just like the healthcare fiasco, and with the decks then stacked with millions of new Democrat voters all hope of conservative retribution at the polls in November will be gone. I pray I am wrong about this, but so afraid that I'm not. If this happens I fail to see how conservatism can win back our country. May God still have some mercy left for America!

For a Justice to be appointed, by the President, to a life-time position doesn't make sense to me. Otherwise, how do you get rid of a bad Justice or one who has become mentally incompentent or infirmed by age while on the bench?

I love this motion to take our country back. I fell there should be some things added to this.
1. That Congress does NOT have to power to make laws governing themselves, such as terms in office, pay rasises without the consent of the people. Orginialy in the Constutiton they only had 2 terms and changed the law to suite themselves.
2. There is already an amendment that says congress is subject to the same legislation as the people but it is ignored and they have their own health care, do not pu in social security and yet they have full pensions paid to them.
There neede to be more control over what congress can do and I feel the states should have a big say in it.

This is a very curious document.
It would be much more powerful if the authors were courageous enough to identify all of the enemies of the people.
This would necessarily include both political parties (don't forget how quickly the Patriot Act was first passed by the previous administration).
To simply blame the left is the same nonsense that goes back and forth between the two parties every election.
We get tired of or disillussioned by one group and then elect the other, repeat every 4 or 8 years.
It's time for a true "housecleaning" and strict limits placed on the Federal government as provided for in our Constitution.
If one opens their eyes and ears it becomes apparent that there is a class of citizens within this country who seem bent on consolidating all power within the Executive Branch.
Sounds like the beginning of a dictatorship to me...

But--that is not important at the moment. What is important in my view is organizing to see that every Primary election we can influence is won by a candidate swearing to uphold the Constitution as defined by its original intent. Said candidate must give a plan of how she/he intends to act on that oath and begin the process of moving the Federal Government rapidly back to the bounds of the Constitution.
We must find those candidates--support them in the Primary and the general election.
There are several groups at work on this that the Patriot might consider linking up with. Please consider.

Direct taxation of the citizen by the Federal Government must be stopped. Federal taxation must be made through the states to insure the dominant role of the states and the citizens.

Article V of the Constitution is mentioned in good cause, though, I must mention Article VI with regards to Clause I and Clause II.
"This Constitution, and the Laws of the United States which shall be made in Pursuance thereof; and all Treaties made, or which shall be made, under the Authority of the United States, shall be the supreme Law of the Land; and the Judges in every State shall be bound thereby, any Thing in the Constitution or Laws of any State to the Contrary notwithstanding." --Article VI, Clause II, US Constitution
Further, the findings by John Marshall with regards to McCulloch vs. Maryland found that Federal law is Supreme over state law. Arguing the Necessary and Proper Clause, and Supremacy Clause both located within the Constitution.
Alexander Hamilton maintained a similar argument years earlier. The quote as follows below:
"[A] criterion of what is constitutional, and of what is not so.... is the end, to which the measure relates as a mean. If the end be clearly comprehended within any of the specified powers, and if the measure have an obvious relation to that end, and is not forbidden by any particular provision of the Constitution, it may safely be deemed to come within the compass of the national authority. There is also this further criterion which may materially assist the decision: Does the proposed measure abridge a pre-existing right of any State, or of any individual? If it does not, there is a strong presumption in favour of its constitutionality...." --Alexander Hamilton, Article 1, Section 8, Clause 18; Alexander Hamilton, Opinion on the Constitutionality of the Bank; Document 11.
Finally, the nationalization of Health Care already seems to have occurred, what with the advent of Medicare - a government controlled national insurance agency for the elderly - and Medicaid - a government controlled national insurance agency for the poor. The recent passing of the Health Care Reform Bill, does not establish an additional health care system. Rather, seeks to regulate insurers and mandate citizens into a health insurance program and that insurers must accept citizens regardless of their condition. Along with budgetary and supplementary cost-reduction measures.
According to the Congressional Budget Office, the Bill will recoup a surplus of 650 billion by 2019. In twenty years, the deficit will be reduced by 1.2 trillion dollars.

I agree with your statement, but what is "zero base-line accounting"? Sounds like it ought to be a good thing, but what does it mean?
I am uncomfortable with one aspect of this: the propagation of the semi-religious language found in our original documents. You say this isn't about religion, but your language *will* be co-opted and misused by those who will happily make it so. Then we'll have *another* monstrosity to defeat: the one that Jefferson most feared.
Yes, I have a religion, and it's at least as important to me as yours is to you. Let's make room a little more room for each other, and we'll have an easier time defending the freedom that is ours together.

The health care bill takes away my right to refuse over-priced, over-specified or otherwise unacceptable health insurance. It takes away the rights of states to regulate health care and insurance providers. It takes away my right to manage the health care portion of my finances as I see fit, and it takes away my right not to disclose such matters to others. There are literally hundreds of other violations of the 4th, 5th, 9th, 10th, 13th and 14th Amendments in this bill, plus numerous violations of other rights specifically described in the original Constitution and never repealed by amendment. How can you possibly argue that it is acceptable?

We definitely should consider repealing the 16th Amendment. The income tax has become a snake-filled morass of all manner of abuse. The requirement that the citizen must from time to time report the fruits of his labor to Washington should in itself be odious to any freedom-loving citizen.
The attempt by the House to disguise an illegal direct tax on those not having health insurance as an "income tax" is an extension of previous abuses (wage taxes, etc.). Even more egregious is the extension of questionable income tax collection means to confiscate without due process the property of those who would resist the health insurance tyranny. If children misuse a toy in a potentially harmful manner, good parents take it away. It's time to take the income tax away from Congress.

Before we amend the Federal Constitution which governments at every level ignore anyway, we must stop the destruction of our money by the Federal Reserve. This not only can be done, but must be done under State Authority. One of the limits placed upon the State governments by Article 1 section 10 of the United States Constitution states "No State Shall...make any Thing but gold and silver Coin a Tender in Payment of Debts..."
No effort to restore the Republic will succeed without first restoring hard money denominated by a standard weight of silver and its equivalent in weight in gold.
All other efforts will only, at best, delay our plunge into tyranny until the value of our labor and our intellectual property is restored to our hands.

Included with this message, and at this time, it is important that we have a plan in place to carry out this proclamation.
There are many of us who are becoming or have become educated and are now searching for the next steps.
Several plans that may be considered are:
Steps by which Unconstitutional bills that have been passed will become null and void or amended until they meet the Constitutional "smell test."
Legislators be required to attend a certain number of hours of Certified Training on the "Real" peoples Constitution. They then must pass a test on the study information with a pre-arranged passing grade.
Lawyers who become Legislators must pass a test of the words in the Constitution that may be contradictory to the Lawyer Legalize they are taught in Law School.
Those Legislators, Judges, and Candidates who do not have an understanding of this document and our Constitution should be required to have a stiff penalty assigned to them and recalled from office, and those in office who do not comply with the Citizen's request to assist with this effort , also be asked to resign.

In this, the Patriot Declaration, Mark Alexander and the Patriot Post have offered disaffected American patriots a superb, rational and inspiring core of philosophical and political grievances around which to gather our rising storm. I have not seen such a well-put enumeration of principles, goals and objections to political abuse since 1776, and I am proud to have found such an educated and informed - and passionate - collection of like-minded individuals in the cause of our national heritage. Many thanks, Mark, for your contributions and inspiration. I have but one objection to your financial proposals: Within the declaration, mention should be made of the need to repeal the 16th Amendment, abolish the Federal Reserve Bank & and the IRS, and scratch the Income Tax. These interrelated issues are all aberrations of our Constitutional Republic and they are all contrary to the original intent of the founders. Nevertheless, Bravo! Thanks again for all that you do; if only we would all do as much as yourself, the cause of American Patriots would be unstoppable.

When you remove the fear of punishment, the sting of correction is little more than an exercise in idle brow beating. What will enforce this Declaration? Certainly, only having to serve a more limited time to enjoy a lifetime "retirement" is no incentive to change.
The concepts are noble, but will Statesmen step forward to serve the law, or will politicians continue on with business as usual? Will the Tree of Liberty truly ever be refreshed?

You mean something already illegal will be MORE illegal? Anyone who is willing to ignore the original constitutional limitations will be willing to ignore this one... and what are you going to do about it? That's right -- exactly the same thing you could do about them violating the original language today. So executing a "this time we really mean it" amendment is nothing but a waste of valuable time and effort. Either move directly to some action that will have an actual EFFECT, or give up.

Since posting my first comment, I have read all of the comments of others that have been posted and I would like to take a moment to (briefly) reply to some of them that I feel have practical implications for the future of this document and this movement.
(I will take them generally in the order of their posts, but for brevity, I will lump subjects together as much as possible.)
First: Michael Gardener offers the suggestion of requiring Congress to limit each piece of legislation to a single subject matter. In my view, this is an excellent suggestion. It may slow the pace of parliamentary business, but it would prevent the passage of hidden/unnoticed provisions piggy-backed within bills. Besides, in light of the break-neck pace of recent Congressional business, it might not be a bad thing to retard the pace of Congressional activity. I might also add that we might require that every bill before Congress be posted in full prior to a vote with one week for every 500 pages, and that any member of Congress who has not read the bill in question would not be allowed to vote on it.
Second: Many have mentioned (and debated) the line-item veto. I think Curtis summed it up when he voiced his disapproval of this option by pointing out that this Executive privilege amounts to the authority to legislate, which was never intended for the Executive branch. This is a bad idea, and we would be foolish to allow it.
Third: Term limits - I just have one thing to say on this: Vote. Know your candidates and vote accordingly. To impose term limits on members of Congress would have the effect of expelling the good with the bad regardless of their service to the public. If you don't like what a politician's doing, vote for someone else in the next election; if what they're doing is illegal/unconstitutional, we have impeachment - we should use it liberally.
Third, part Two: Judicial Term limits. I have mixed feelings about this one, but I will say that I am not wholly opposed to it. Still, It seems like stricter, more well-defined standards of "good behavior" would suffice to keep these judges in line with their Constitutional mandates. Again, we don't want to expel the good with the bad.
Fourth: Bob Shearer's comment about allowing for budget surpluses and pay-off of the national debt is right on topic. We must ensure that our plan can allow for this, and though I'm no economist, if the provisions of this Declaration don't make a way for that to happen, then that would be a serious shortcoming.
Fifth: Larry notes that this document, like the Constitution before it, would be a "toothless tiger" without tangible ramifications for those in power if they defy their Constitutional oaths. I agree; what kind of legal/professional consequences might be imposed upon politicians who step out of line is something that would have to be determined, but I agree that some kind of penalties, besides just losing in the next election, are badly needed.
Sixth: The Duke of Earl's suggestions about Lobbyists' contributions (being limited to $10 for a sandwich and coffee), and political campaign donations (limited to $100/person/election cycle) are superb ideas. I wold add to this, regarding elections, that the PUBLIC airwaves, offer free and equal air time for every political candidate that makes it onto the primary election ballot, and that the purchase of additional air time by any candidate, especially for commercials, be completely illegal. We need honest, rational debate, not soundbites, attack ads and sensational imagery to sway voters. Some customized arrangements would have to be made for cable/satellite TV, as these are not technically public airwaves, but we should definitely outlaw those damn commercials.
Seventh: Justin's point about rephrasing the tax language in No. 6 of the Declaration is very astute. I would hate to imply that a direct tax should be levied; in fact, as my previous comment notes, I believe that direct, unapportioned taxes (i.e. the income tax) should simply be repealed, along with the Fed and the 16th Amendment. For a plethora of info on this subject, research Rep. Ron Paul's (Libertarian, TX) long history of fighting for this in Congress.
And lastly, Eighth: Mr. McNulty, I must say that you, sir, are as blind as an ostrich with his head buried up to his wings if you really believe that our life, despite all that is taking place around us, is "going on as usual." Wake up and take a look around you; study your history, from the 17th Century to the present, and get a clue about how much the world and our nation has changed - primarily for the worse. I will not even bore these other readers with an enumeration of the many freedoms we have lost, the many abuses of power and usurpations of authority that we currently suffer, etc. etc., but I will say this to your specific point about socialism: Socialism is not "government ownership of all businesses and property;" it is simply the unjust redistribution of wealth between two parties, often carried out by a third party - in this case, the government. And we are not "a long way from that," but rather, we have already waded into that putrid cesspool up to our eyeballs (viz. Medicare, Medicaid, Welfare, government housing and numerous other entitlement programs, and now, Health care). We are well on our way to the Socialist/Statist dystopia, and if you can't see that, then God help you, because you are indeed a blind man.
Thanks to Mark Alexander and his staff at the Patriot Post, You guys are truly doing this nation a service. And this forum, if these many comments from your readers are taken into consideration in a final draft of this declaration, is truly a profound turning point. It is, in many respects, an awesome testament to the power of the internet, and I am overwhelmed by its likeness to the Constitutional Conventions of our founding era. Keep it up, and let's not let this die. Our nations needs this more than anything right now.

This time our Nation is lost! Print it out. Have colleagues, neighbors and friends sign the thing. Send the signed forms to Patriot Post.
Flood that den of crooks in Washington DC with letters, e mails and signature lists.
We got to stand up, get out that door and do whatever it takes. I will take out ad space in News papers for this. I will walk from door to door with this.

In my life time I have never seen such a blatant disregard for the Constitution and the desire of the people as I have this week regarding Obamacare. If this is allowed to stand, we as a nation will be subject to further violations of our freedoms and Liberty. What is next? The second amendment? Most likely.
I am afraid the time is now for those who truely love our country and our Constitution to remove those criminals of the Constitution from office. I sincerely hope that will start with the mid term elections but I do not have a lot of hope since the apathetic, indifferent portion of the voters will forget about this day by then. The portion of the voters that helped to make this mess are still blind to harm they have done, at least by my observation. Thus my skeptisim about the elections.
In addition, who do we have that we could trust? The most qualified people are busy trying to feed their familys.
I am afraid the few real Patriots will bear the brunt of change...and change it must. The Tree of Liberty being refreshed with the blood of Patriots and tyrants is looming.
Pray for our Nation as we are on the brink of losing it. Pray for devine guidence on how best to rescue it from the attack on Freedom and Liberty.
I think we know the answer.

I'm only the second genaration on my mothers side in America. My grandparents came from the Ukraine when they were small children. They did not have school taught in Polish, street signs were not changed for them, they were not on welfare.... they became Americans. They learned english, paid taxes went to church ,voted, had a family stayed together until thier passing. People wonder what made that genaration of people the greatest, I say it was the reward of God for his people trying to live by his commandments. Everyone lived within thier means and worked long and hard for what they had. They didn't look for hand outs or expect any. They helped thier nieghbors when needed but most importantly the gave thanks for what they had recieved.
Everyone is not perfect,I mess up all the time!!! but as long as you try to follow God you will be blessed in some way.

I would not wish that the Tree of Liberty be freshened by any person's blood. However, I no longer see this result as completely out of the question. The constitution envisioned a very limited government indeed, which was appropriate for an 18th century society. At that time, the dominant forces in the world were still governments, oftentimes governments ruled by one man, or by a small group of rich men. Therefore, the founding fathers were right to be progressive, even revolutionary, by instituting a limited government for a democratic republic. I'm not one to jump on the bandwagon of those hagiographers and hero-worshipers who consider the founding fathers to have been demigods, but they did demonstrate sound foresight by including the General Welfare clause to ensure that the government would not be hamstrung and unable to respond to new, unforeseeable developments in society. For instance: the rise to dominance of corporations, business forms which barely existed (only a few hundred) at the time of the constitution's signing, and which the founding fathers (along with Adam Smith) feared, disliked and distrusted.
Sadly, this is part of a narrative of which you have likely never heard, as most "conservative" and "libertarian" news sources weave a fantasy narrative of history which would have made most of the founding fathers vomit. Certainly, Thomas Jefferson for one is rolling over in his grave at how the tea bagger movement is worshiping the constitution as if it were holy writ, completely ignoring his advice that it should be re-written by each new generation.
Supporters of this manifesto are either fools or rogues. Their blindness to the true source of power in this society makes the rest of their intellectual content void. They bring to mind Sinclair Lewis' prophesy that when fascism comes to the United States, it will be draped in the flag and carrying a cross.

Fellow patriots,
I commend the effort as set forth in this declaration but cannot sign it as it stands. I am concerned, in fact, that in a group of people so commited to the Constitution and it's Framers that so many seem so willing to add and amend items specifically considered and rejected by those same men. The term limits and line item veto elements are dangerous things that were purposefully left out of the Constitution. The balanced budget ideals were likewise considered and thought unnecessary. So much of what you have to say is right on target, but we must be cautious not to upset the delicate balance so intentionally laid out by the Founders. The complaints we have regarding the current power players in government will be ours to share should we seek to usurp the Constitution in the other direction from those we revile.
The burden falls to us as Americans and patriots to jealously guard our liberties, and to inform our fellow citizens of the dangers facing their own liberties. Jefferson said that a nation that expects to be ignorant and free expects what never was and never will be. We need to get people informed and let the Constitution do the rest. Adams also stated that the Constitution was made for a moral and religious people and is wholly inadequate otherwise. Therefore, we likewise need to be men and women of unexceptionable character that our fellow citizens can look up to and admire by virtue of our very actions. How can we expect people to honor and revere our Constitution if we are calling out its weak points and seeking to change them? Your amendments put no faith in the people to excercise their checks against government.
This, I thought, was the aim of the Patriot Post: to educate and inform its readers tt protect and preserve the principles contained in the Constitution. This Declaration leaves me wondering if, in fact, it is ideology, not principles, that guides the Patriot Post and the previous commentators in this thread - that conservatism is more important than constitutionalism. I hope I am wrong; the Patriot Post has long been my source of reason and defense for Constitutional matters. I would hate to learn that it had become susceptible to exception.

How can we include limitations on salary and benefits for all three branches? When you can become extremely wealthy by going into public service why work in the private sector? Raises also need to be addressed and limited to inflation. A public servant's raise in any job is not worth more than inflation to the People. Only through merit should promotion be warranted with the corresponding salary.
What about eliminating entitlements for public servants after leaving office? I think this needs to be addressed in the patriot declaration.
True statesmen serve the public then return to civilian life without additional recoupment for service in the form of continued salaries or health benefits not pertaining to service connected disabilities such as those incurred by our armed forces.

I do not like "term limits".
As I have stated before, when all the perks, pensions, and benefits are REMOVED, a large part of the "birds that nest in Washington will fly away". Furthermore, a "cancellation of all benefits to previous Legislators needs to be accomplished" If they didn't "save" for retirement from the "good salaries" that they were paid, I am sorry. We, the people, are responsible for our "retirements" and legislators are "responsible for their retirements". End of Subject.

What about:

The Constitution of The United States is a document that was written a long time ago. It is a framework for government and is not carved in stone. The English Constitution is in the hearts and minds of the English people and is interpreted as the people choose to interpret it.
In America, there are people using the literal reading of the Constitution as "gospel." I suspect they are the same people who take a literal translation of the Bible. I also do not trust anyone who has not been in the military and faced combat. I want those who want me to fight to be the ones who have experienced combat.

A well written declaration. In addition, the Federal Reserve Act of 1913 should be abolished and the Gold Standard brought back into being. One of the key reasons the original 13 colonies declared their independance from England was to be rid of the Central
Bank of Englands system of fiat currency and to establish a Gold Standard currency of their own and be in total control of it. In the constitution, congress has the power to "coin money and regulate the value thereof".

I believe we have just had a Constitutional Convention. It was a blessing to me to read the comments.
Now, when all the ideas were in at the Original Constitutional Convention, an aged man stood and said, "In the beginning of the contest with Britain, when we were sensible of danger, we had daily prayers in this room for Divine protection. Our prayers, Sir, were heard and they were graciously answered. All of us who were engaged in the struggle must have observed frequent instances of a superintending Providence IN OUR FAVOR. Have we now forgotten this powerful Friend? or do we imagine we no longer need His assistance?
I have lived, Sir, a long time, and the longer I live, the more convincing proof I see of this TRUTH : That God governs in the affairs of man. This speech marked the turning point of the Convention. Breakthroughs followed shortly and within a year the Constitution was ratified by eleven States to establish the first Christian form of government in history. Our Beloved America.
I am very grateful that people so loved this Beloved Country that they took their time to say what they had to say.
The Patriot Post is to be commended for establishing this Free exchange of ideas and for putting together the draft that stimulated the discussion, for we all agree, something must be done.

For once the enemies of freedom and free people everywhere discover that the masses will tolerate their overstepping their bounds, the endless processes of chipping away at the whole begins. So it has been for our Bill of Rights here in the United States, first they started misusing and abusing our protections against unjust taxation, then they decided to take away the right to vote from anyone that had a conviction, but they never took away their obligation to pay taxes, I believe someone among our founding fathers had a problem with that and called it “taxation without representation.” Then there is that little 2nd Amendment right of the people to bare arms, now the last I heard X- Cons are people to, and once they have paid their debt to society their citizenship is supposed to be restored. O bit we don’t like the idea of rights like that, so we willingly give them up for others. Now we have laws that constitute double jeopardy, and are even applied retroactive or ex-post facto, but that’s OK because these are called sex offender laws. And nobody has a problem with it, until the chipping gets around to them, but alas it is to late because now it is considered settled law under Case precedence.

Yet, I have seen, in my lifetime, so many "movements" and political restoration groups that I can no longer count them. Each has expressed a need to restore the republic - and each has failed. 60 years of social engineering and leftist media has taken this country to its inevitable conclusion. The NEA has produced school curriculum that has produced a voting populace that no longer appreciates the freedoms so many have died for. Immigration, illegal and legal, has brought in people that do not value the freedoms this country was founded on. The moral compass has been taken away. May I suggest two more proposals? Most of these ideas aren't exclusively mine but outlined on DownsizeDC.org. Although they propose them as bills, I would prefer them as Constitutional Amendments so as to prevent Congress or the administrative branch playing fast and loose with them.
And although they wouldn't eliminate skullduggery, Congress and the President manage to do quite well in ignoring the Constitution, they might slow corruption down so that Patriots can work towards restoring this once great nation to a democratic Republic (small d and capital R) under the rule of Constitutional Law with limited government, fiscal sanity, and restraint from international adventurism among other traditional First Principles that Mr. Alexander write eloquently about.
So here goes:
ELEVEN, that the people or their representatives not be deceived; all legislation in addition to requiring proof of enumerated authority must be written by the people's representatives and/or their staffs with annotation as to authorship, not corporation or foundation lawyers; that all legislation only cover one subject at a time and that any amendments pertain directly to the matter at hand; that the federal government and its employees including all elected office holders be subjected to the same requirements imposed upon the states or the people; be that any earmarks be identified as to who proposed and who benefits from said earmarks along with their economic impact; that all legislation be read before a quorum at standard reading speed and that any legislator voting on such legislation notarize under penalty of perjury that he or she has read the entire bill; that all references to previous legislation or portion thereof be included in the legislation in full; that all legislation be posted on the internet allowing for a reading rate period of no less than twenty-five pages per day including referenced previous legislation; that any modifications, additions, amendments or earmarks shall subject said bill to undergo the entire process again; and that any additions not revealed, whether by error or intentionally, shall subject the entire bill to be considered null and void.
TWELVE, that any violations of ELEVEN shall be grounds for impeachment, removal from office, and appropriate punishment up to one million dollars, adjusted for inflation, and ten years in prison.

The government will provide 24/7/365 television/internet access and rotating blocks of 5 minutes apiece to each candidate at the county, state, and national level so that they can give their campaign spiels. They must all use the same podium, have the same backdrop, etc. -in other words, no fancy marketing ploys-oh, and wear the same government-issue overalls while speaking. This will be paid for with tax dollars which will eliminate the need for fund-raising and the concomitant corruption. It will also eliminate foreign influence i the form of invisible donations. EVERY candidate gets the same amount of time so no one can reasonable complain.
And while I'm at it, congress can stay in military barracks while in session and wear government -issue overalls, too. Let's concentrate on the messages, not the messengers!

This is a good start to a needed discussion; with a few changes, I could sign the Declaration.
The SIXTH Article suggests a non-progressive tax. I support a progressive tax with lower tax rates. The poor are not equally capable of paying the same rate.
The SEVENTH Article will likely result in large numbers of individuals not saving money for their tax bill. It also greatly and negatively affects the nation's cash flow. A better idea would be to base requiring withholding on a person's credit rating and to continue requiring quarterly payments.
The NINTH Article will have the nation run by permanent staff members who are not elected by anyone and loyal only to themselves. I don't believe this would be any better than long term Congressmen.

I like the balanced budget and term limit amendments but the only alteration to taxation I would support is the abolition of the sixteenth amendment. I do not agree with any notion of a "fair"tax, "flat"tax or "VAT" tax until such time as 16a is repealed. Ideally we should go back to apportionment as the founders established. And while we're at it the 17th needs to go as well. That way the states get back their representation with taxation. Let's see the kind of reckless spending of today pass when the senate represents the states that'll have to pay for it. You want balnced budgets? Just repeal 16a & 17a. I'd love to see a detailed study on the effects of the repeal of the 16th and 17th amendments. I've already thought out my own but would welcome Mr. Alexander's or anyone elses thoughts on the subject other than the arguement "It'll never happen." There's allot going on today that people thought would "never happen."

Might I suggested a different method for computing contribution limits? How about "individual limits are based on 0.5% of the MEDIAN income of U.S. voting citizens" (about $140). This will serve as an encouragement to officials who want more contributions to encourage economic growth through less regulation and government involvement.
Candidates should also be restricted from using their personal wealth. This prevents the "wealthy class" from barring higher principled, hard workers from entering the election battle.

We need to eliminate congressional perks as well. Tie their pay to the median income of the people they serve. Provide no pensions or insurance. Make no allowance for family housing. Provide only military styled BOQ quarters as residences. Make serving in congress a financial burden so they have no incentive to make a career out of it. Institute a two term limit. That's four years in the house, twelve in the senate.
And again, the 16th and 17th amendments need to be repealed together. Not one now and the other some other time. That is the only way to return to the balance of powers instituted by our founders. Only when the states foot the bill and the senate represents the states will all of this foolish spending be stopped. This is the path back to states rights and fiscal reponsibility.

This was originally written and posted on my blog in October of 2009.
I believe it is time to start treating our representatives much the same way we and/or our military are treated. We need to start a grassroots movement to take back control of our representatives. I propose:
Starting in year 2012, all members of the House and Senate, no matter seniority, will get a starting salary of $104,000 ($2000 per week) with all applicable taxes taken out. Currently (2009) the rank-and-file members get $174,000 per year with the “leaders” getting $193,400. We will see an immediate savings of over 40 million dollars. They will not need as much money if the other parts of my proposal are implemented. Starting salaries are capped at $104,000 per year for the next 8 years and re-evaluated each census year.
All representatives will live in publicly provided housing. By that I mean that the state, via the Governor’s office, will purchase or rent the housing for the Senators and each district will purchase or rent housing for their representative and pay for utilities and upkeep. This is done through taking a percentage of money from each county/city in the district proportionate to the number of people in the county/city. The mayor of the county/city with the largest population works with the congress person to find the initial housing. After that, it is re-used by each successive representative. If members don’t want to take advantage of the free housing, they are free to pay for housing out of their own pocket. There is no housing allowance. When voted out of office, they leave the public housing provided to them much the same as the President and Vice President do.
I am sure the capital building has a cafeteria. Members of Congress who eat in the cafeteria eat for free; paid for by our tax dollars. It would be run similar to any military cafeteria. They get a choice of a couple of entrees, salad, soup, etc. If they decide to eat someplace else, they pay for it out of pocket. Any reimbursements for “business” meals require the representative to fill out a form for reimbursement to include date, time, reason, who attended (by name and company) along with a copy of the itemized receipt. All requests are posted online for a period of 30 days for constituent review. As long as it is valid, as determined by IRS regulations, it is paid. Questionable receipts are held until Election Day and the sum total is put on the ballot with places to vote 100%, 50%, 25% or 0% and that is what they receive. All unused food from the cafeteria is donated to homeless shelters.
Each year the representative is not up for election, at 60 days prior to Election Day, the representatives submit, online and in the newspaper, a listing of what they did as well as their request for any pay increase they think they deserve with justification. Much like everyone else has to do during an annual review. If the people feel the representative is doing a good job, they are voted a raise. If not, they don’t. No longer should they automatically receive a pay raise just because they don’t vote against it. How many of us have that option? This is just a rough draft, but the point is that our representatives have ceased to represent us as the framers of the constitution wanted and we need to take control back. The founding fathers didn’t want the representatives to be paid at all. Now the hard part is finding an honorable representative who would champion these ideas. When you have the control to vote your own pay and benefits, why would you take anything less than the best?

How about you run housing like the military does. Let the fed provide a single apartment complex of 535 one bedroom, one bathroom efficiency apartments. A congressman or senator can choose to live their at no cost except utilities or he can spend his own money on something better. No security detail or secret service protection outside the congressional complex.
No taxpayer funded expense account, no pension but social security, no insurance but medicare/medicaid.
Each congressman makes $75,000 a year, period. Each senator makes $100,000 a year, period. Any raises to be approved through a national referendum every ten years with passage by no less than 3/4 of the states. Raises to be within 2% of the rate of inflation for that ten year period.

I agree with several comments about the fragile treatment of taxation in this Declaration, which I have gladly signed. I propose repeal of the 16th Amendment, i.e. "The Law That Never Was", then use the "Fair Tax" AT LEAST as a model for debate until a workable system is formulated. I notice mention of repeal of the 17th - an intriguing idea, indeed.
I propose clarification of the 3rd item that any laws made about members of government shall apply equally to citizens.
When GOOOH.com surprises everyone and GETS RESULTS with a new crop of elected officials, that on November 3, 2010 they shall pass a resolution to form a tribunal to address well-publicized commited crimes (AS SEEN ON TV!!)PLUS all deeds regarding bailouts and healthcare "reform", and try those criminals, using the Rule of Law upon which this Nation was founded, and let the cow-chips fall where they may, adn let the punishment fit the crime. Such proceedings would necessarily include those who actively supported such crimes, such as legislative staffers and lobbyists.
I would like to offer this - In a venue totally removed from this type of consideration, it was pointed out that our Nation is the ONLY civilization in the entire history of man that was founded on principles. All others came into being either through conquest, or inheritance of an oppressed citizenry.

A Congress of career politicians will NEVER allow us to constitutionally term limit them by an amendment. But... WE CAN IMPOSE term limits on them in Congressional elections (‘2010, 2012, 2014......):

2. Always vote, but only for the strongest challenger , regardless of party .
If Congress has not passed a term limits bill by 2014, repeat this in 2016, 2018....

This is good, real good, the only thing I'd add is some mention of the pay politicians receive. I'd like to see any pension from public service comlpletely removed...and base their pay on an average pay of their constituents, only while their actually working, it should not be a get rich deal,just a little something for helping. this is and should always be service...

After reading your Patriot Declaration, I was impressed. But what are you going to do now that you've signed the Declaration and probably sent a check in the mail. I've written to this organization, the Heritage Foundation, the NRA, 2nd Amendment Foundation, et al. I've requested information on how we, citizens, go about placing our Senators under Citizen's Arrest for "not honoring their oath of office. No, this is not a "huge" charge, but it will make the point that we are not going to take this anymore. I intend to follow thru with this. With or without your help. Are there any others out there who have the "guts" and love of their country to do the same in their state? You may display me email.....I hope to hear from others who have some common sense and are ready to pull the carpet out from under our NON-president Obummer. I will keep this brief. The Republican Party which is not conservative never had a chance in the debate over health care reform because they allowed the Democratic Party to frame the argument as one about humanitarian behavior. They should have refused to engage in that debate and rather argue the Constitutionality of the proposed law. It is obviously Unconstitutional on my levels when interpreted and understood in the language and events of the day in which it was written. Redistribution of wealth, forced purchase of a private product, to name only two. You quoted Madison, the author of our Constitution and rightly so. I would, if you aren't aware of it point you to a Constitutional lesson by Davy Crocket. This should be mandatory reading for all public school students and individuals seeking to be nationalized citizens.
And lastly, Americans must be made to understand that there is no such thing as corporate taxes. All taxes are passed down to the retail buyer. It's simple. A producer must earn a profit. Taxes cut into his profit. The producer passes the taxes along as a business expense in the sales price. The end user has no one to pass his cost to. The retail buyer pays all of the taxes. How can you say what the original intent of the founders was? Jefferson was one of the first presidents to greatly expand the powers of the presidency. If they truly wanted to national government to have only the powers listed then they wouldn't have included the Necessary and Proper clause as well. Our founding fathers knew that they needed safeguards put in to account for things that they couldn't imagine at their time. That's why they left the flexibility in it and that's why the American Constitution is the oldest right now. This health care bill surely isn't perfect, but it was needed. Clearly the states, who have done little in this area (minus Romney whose reform is much like the bill that was passed) aren't doing a good enough job, and if Republicans wanted to help with it then they should have ANY effort to cooperate rather than simply say No to everything.
If you really wanna change what's going on it begins with campaign finance reform. When Republicans are getting money from foreign companies you should be scared. You should also be scared that corporations can spend as much as they want on campaigns. If you really want things to change then you need to prevent big corporations from being able to buy politicians on both sides of the aisle

Raising taxes is the lifeblood of the government, and it is accomplished by the use of force. I would much prefer requiring AT LEAST an eight-tenths majority.

We also need a Constitutional Amendment that more clearly defines the autority granted to the Federal government when it comes to interstate commerce and providing for the general welfare. The interstate commerce clause needs to be limited to ONLY maintaining an environment that allows for the free trade of goods or services between the states. It DOES NOT give the government the authority to limit or regulate that trade in any other manner (goodby department of energy along with several other departments). In providing for the general welfare needs to be limited to the government taking only those actions that maintain an environment that does not place hurdles that would hamper the people's pursuit of happiness. (or words to this effect). Repeal of all legislation that has been passed that streches and twists the meaning of those two clauses must also be a priority.

I'm in agreement with the comment that there should be a provision that each bill should have only ONE subject matter. No more earmarks. I wouldn't mind a limit on the page size of bills either. These 2000-3000 page monstrosities are good for nothing except disguising abuses.
