Death Panels Here, Doctors Plea for Help

Doctors across America are sick. A new and desperate plight has surfaced in emergency rooms across the nation for both patients and doctors alike. The following blog by one valiant doctor speaks for thousands of doctors being forced to go against their natural instincts and abilities to allow further hospital care and re-admit patients.

Effective October 2012, doctors at hospitals across the land are being forced by the Obama administration to break their Hippocratic Oath. Obama's revamped Medicare has now begun forcing doctors at hospitals to turn their backs on patients no matter how critical their need for re-admittance. Obamacare has activated a mandate through Medicare that will cost thousands of lives and serves as the precursor to Obama's inhumane and authoritarian Death Panels.

The following excerpts are used with permission from the blog of Dr. Thomas Hamilton, an American doctor who speaks truth to power. Dr. Hamilton describes how he was torn between providing medical help to a very sick senior or turning her away to face a certain and tragic fate without treatment:

It was my plan to admit this woman to the hospital. I found out a little later that this same woman had been a patient here just slightly more than 2 weeks ago with a DIFFERENT DIAGNOSIS. I was told that if this woman was admitted, the hospital would not be paid.

The new Medicare rule now is that if the same Medicare patient is re-admitted to the hospital within 30 days, the hospital will not be paid. When they first started this nonsense they said this only applied to patients with the same diagnosis. Now they have “expanded” the rule to include re-admissions for any reason. So if you're in the hospital for pneumonia, and 3 weeks later, you break your leg…….too bad. Medicare will not pay the hospital to fix your leg.

A little later a man was brought in by ambulance, very sick, in pain, and near death. I did my usual evaluation and treatment, doing my best to ease pain and stabilize this man's illness. He needed to be admitted. To my chagrin I found out that he had been treated for the SAME problem at a DIFFERENT HOSPITAL about 10 days prior. If I admitted this man, our hospital would be paid nothing. I admitted the man.   My friends I am caught in a terrible position. I could have given treatment to both of these people and sent them out. There is no doubt that both of them would have died. Oh, I could also be sued for malpractice, but nobody cares about that.

The good doctor goes on to explain,

As more and more are added to the Obamacare rolls, there will be less and less access. People will get sicker and yes, people will die because of it. I had a sick and sinking feeling in the pit of my stomach today after both of these incidents. We have a good hospital. Our nurses, technicians, and support staff work very hard and they deserve to be paid for their efforts. I am not so worried about myself as I am near retirement, but I worry for all the younger folks in the healthcare business and I worry about our seniors who are in the long run going to be sacrificed as the government implements cost cutting shenanigans to cover up their broken promise made way back in 1964.

In my last article, Sick – No Appeal – It's ObamaCare, I wrote:

“Slashed doctors' pay, reduced services to patients of all ages and medical devices and testing equipment made by cheap overseas labor are cutting-block initiatives by the Obama government. Already targeted are our most defenseless – our mentally and physically disabled in institutionalized care who require the most medical assistance at a higher cost? Obamacare is not about care. It is not about using America's advanced medical skills and technology, the finest in the world, to save lives of Americans regardless of race, age or class. It is about control. It is a power play that takes over one eighth of the U.S. economy. If not repealed, it is the unveiling of how a once great medical system became an ugly and deadly government-run 'business' in America.”

It is incomprehensible how Barack Obama can throw billions of dollars at political cronies, irresponsible unions, failed and bankrupt “green” projects, elaborate vacations, contraceptives, sterilizations and abortions-on-demand when those critical dollars could go towards improving medical care for all Americans from newborns to seniors. Under Obamacare, average Americans and their families are targeted. Where is Obama's oft-repeated demand for “fairness” and an “equal playing field” when he cunningly exempts himself, his elitist friends and his political cronies from the perils of his signature law – Obamacare?

Unless someone has a time machine laying about, I am going to venture a guess that the current president, "ObamaCare", or whatever other Faux-rage trigger you care to lay blame on, isn't at fault here.

Now let's get to the important text:

C. Denials -- Deny readmissions under the following circumstances:
- If the readmission was medically unnecessary;
- If the readmission resulted from a premature discharge from the same hospital; or
- If the readmission was a result of circumvention of PPS by the same hospital (See

I'd summarize those three criteria as, "you screwed up", "you really screwed up", and "you intentionally screwed up in an attempt to defraud the system". Sounds like reasonable criteria for denying reimbursement.

It would be a waste of time to try and tell you that this administration, and most of it's "Czars" running such programs as Obamacare, have, and continue to disregard their own legislations and have chosen to follow their own agendas. Trying to deal with the US government departments, especially those run by appointed sleazebags, is a waste of time, money, and lawyers since they delay, delay, and delay. There will be no action taken by any of them until such time as their appointer, Obama, is gone and they, too, are replaced by competent professionals.
Not going to see ANY of this from this administration, where the head of it uses Executive Privilege as often as you change your underwear. (Wrong analogy in your case, but the point was made.) See "Fast and Furious".
I can only hope that YOU run into the system and come out the loser. And eventually, you will, and you will.

There is no question that physicians are being pressured to deny care, and to modify treatment practices in order to comply with Medicare restrictions. The rules are worded to suggest that the purpose is to improve "patient care", but really they only serve to create a basis for the governmnet to deny payment to the hospital. For example, if the physician leaves a urinary catheter in for more than 24 hrs after surgery, without a suitable explanation written out clearly in a special format meeting the gov requirements, then the hospital will not be paid for the admission. If a patient developes a urinary tract infection , or a bed sore, or is "re-admitted" as noted in the story, the hopital will not be paid.
The amount of regulatory paperwork and documentation to monitor and enforce these provisions is outrageous. Most hospitals now have as many people checking for regulatory documentation of the payment modifiers, as they do people taking care of patients.

Even if you are admitted to the hospital the governmnet is regulating and micromanaging your care by thretaening to with-hold payment to the hospital. You doctor is making suggestions but is being restrained and controlled by governmnet regulation aimed at reducing costs by limiting payment on the basis of some "violation" of the governmnet rule.

It is bad folks, and is getting worse. Any time physicians see Medicare folks they are taking on risks of violating some government " quality" regulation. But this is not about "quality", and that is why so many docs have had enough and are getting out.

The inevitable result of socialized medicine is the decline in the quality of doctors, they will become just another type of civil servant and will be paid a little more than a mailman but less than the postmaster of a mid-sized post office in my opinion. We are already seeing a shift to foreign doctors because the Americans are getting out or not getting in to begin with. And don’t think that you can opt out of taking Medicare or Medicaid patients if it gets too bad, those days will end soon, be ready.

If doctors and hospitals weren't so greedy and stopped discharging patients so early so they could get more money for the recently vacated beds, this law would not be needed. But since greed runs everything these days, it's a necessary safeguard.

Case in point. I had a friend whose hip dislocated. She went to emergency, hip was reset and she was discharged. She got home and three hours later her hip dislocated again. Once again, she went to emergency where they reset her hip and were set to discharge her. I raised a fuss about their "drive through medicine" and they kept her for another day which was fortunate as her hip dislocated a third time while in the hospital.

Once we stop treating medicine as if it were a fast food franchise, the better we all will be. This law is a good first step.

Ekim, the doctors are caught in a vice, (not a criminal vice a mechanical vice). Premature release which You attribute to their alleged greed., is imposed by the insurance companies who are in turn coerced by the Federal goverenment. The government by their interference in the market fixes the prices of every medical treatment, and sets its own compensation rates to insurance companies, thereby forcing the insurance companies to pressure the hospitals to release patients often before they are well enough to be released. The Insurance companies are also in the same Vice, from the government on one side and the shareholders upon the other. who are invested for profit. get a clue. Obamacare must go, except it was a mistake to derisively name it after the POTUS, now the Dems will fight to insure its survival because of this dubious honor which has been bestowed .

No, Mike "Ekim" is right. Some of the insurance companies are in full support of Obamacare because it gives them a captive market. They'll like having the excuse "the government made us do it" when they deny a claim.

This is one of the reasons the United States of America has slipped considerably in the Economic Freedom ratings since Mr. Obama''s regime took over.

Lee, Come spend a day with me at any of the four hospitals in two states that I practice at. You will see more govermnet control and threats than you will possibly believe. They set clinical criteria that I do not want applied to any of my family, much less other folks. The government is telling me what and I can do and what I must do and then refusing to pay if there is any outcome less than 100% without complication, regardless of the age or condition of the patient( ie Poor Protoplasm ) to start with.

One way or the other, ObamaCare will disappear. If re-elected, the system will collapse along with the dollar in about 19=24 months. A free market system will then develope, and insurance sellers will fill the need for a high deductible policy. Evenetually there will be tax incentives ( deductions) for HSA contributions/expenses and folks will get coverage they want.

Of course, the easier way is to elect Romney , replace Obamacare will HSA's and the Insurance reforms to protect pre-existing dz and stop abuses of the past. That is all in the Republican plan - but you will never hear the left media admit it.

Look up APACHE II scoring system ( that roman numeral 2 ) and see the metric that is used in the UK and will be used here by the Death Panel to set your hospital criteria..... Hospital Bed or Pain Pill .... do you meet the score???

I have an aunt in Florida that told me two weeks ago that she CANNOT receive a new knee replacement because she is no longer covered due to HER AGE! These kinds of anecdotes MUST be told to our elderly NOW. I have noticed so many gray-haired older women driving around with Obama bumper stickers that it makes me sick. They're scared to death of Romney, not understanding what is about to be fed to them on Obama's plate. The same thing for farmers in my state, who have huge signs standing in their fields. They understood the recall election here but are now lined up to support Obama. I can only guess the lies they have been told about both candidates-Romney's rich and greedy and Obama is their savior, working hard to protect their collective rights. Later they will all cry about the devastation 'some Republican' has caused by blocking Obama's plans for their security.
