More Court Packing

Dec. 13, 2013

Once again, Senate Democrats took advantage of having “gone nuclear” and ending the filibuster for judicial nominees. In the dark of night Thursday, the Senate confirmed Cornelia Pillard to the DC Circuit Court of Appeals by a vote of 51-44. That makes two additional Obama nominees on the court with the lightest workload, and it gives leftists a 6-4 advantage on the court that hears most challenges to executive actions. On top of that, National Review's Patrick Brennan calls Pillard “probably the most extreme of President Obama's judicial nominees this year.” Why? Well, for example, Brennan says she opposed a church's right to be exempt from normal employment-discrimination law in order to decide on a minister. The Supreme Court disagreed with her, 9-0. Beware…

Maybe not !! IF WE elect a Republican Congress and President in 2016 we can simply have them removed and replace them with whomever we want using the same Nuclear Option that the Dems used to get them all appointed.... With these Liberals it wouldn't be too difficult to find something Unconstitutional about their actions... BELIEVE !!!! Actually most of this administration should be facing prosecution once they have left (been removed) office... However, politicians are like Dr's and lawyer's when it comes to prosecuting their own !!???

Cactus Patriot in Arizona replied:

Unfortunately it is not quite that easy. Justices and judges appointed under Article III of the Constitution (Supreme Court justices, appellate and district court judges, and Court of International Trade judges) serve "during good behavior." That means they may keep their jobs unless Congress decides to remove them through the lengthy process of impeachment and conviction. Congress has found it necessary to use this process only a few times in the history of our country. From a practical standpoint, almost all of these judges hold office for as long as they wish.

The dumocRATS should not be allowed to do things like this. They are packing the courts with people that believe in Obama's agenda which is not a good one.

Like it or not, this is exactly Constitutional. These folks shoukld get a straight up vote. However, remember what Jefferson did. All courts except the Supreme Court are established BY CONGRESS and can therefore be eliminated by Congress. Jefferson effectively disbanded a lot of courts by having them defunded. That's not to say that the spineless Congress we have today would do such a thing, but that would be the ultimate nuclear option.

Every party leader will try to pack the courts, nothin new there. When you think about it Obama is out in 2016 and 2015 will be a nothing year. A lame duck year ,you know he will hit the trail to support Clinton. 2014 is THE critical year .conservatives need to vote into office every republican candidate that is worthy, Our work is cut out for us,but I know many folks have been awakened and conservatives are at least asking questions and being more aware.I think there is light at the end of the tunnel. Socialism will never be allowed to control this great free America,
