No Jail Time for Woman Who Accidentally Broke NJ’s Draconian Gun Laws
New Jersey’s Attorney General stepped in to defend the cause of the woman who faced jail time for bringing her handgun into New Jersey after erroneously thinking her Pennsylvania permit would be honored in New Jersey. Reason’s Hit & Run blog reports, “[Atlantic County Prosecutor Jim] McClain cited a memo issued today by acting Attorney General John Hoffman, who told local prosecutors that ‘imprisonment is neither necessary nor appropriate to serve the interests of justice and protect public safety’ in cases like Allen’s. ‘In applying the factors set out in the clarification,’ McClain said, ‘I determined that the defendant in this case should be offered the opportunity to be admitted into the Atlantic County PTI [Pretrial Intervention] Program.’” This is probably the same county that is so anti-gun it banned toy guns from its streets.
