“Where-ever law ends, tyranny begins.”
So said Enlightenment philosopher John Locke back in 1689 in Book II of his classic Two Treatises of Government. His words, it seems to us, have held up pretty well over the past 334 years.
We’re not sure House Speaker Kevin McCarthy has studied Locke, but he clearly recognizes the harm that a corrupt attorney general can cause to a republic, especially when he’s protecting a corrupt president and enforcing a two-tiered system of justice against his political enemies.
“We need to get to the facts,” McCarthy said on Sunday, “and that includes reconciling these clear disparities. U.S. Attorney David Weiss must provide answers to the House Judiciary Committee. If the whistleblowers’ allegations are true, this will be a significant part of a larger impeachment inquiry into Merrick Garland’s weaponization of DOJ.”
McCarthy reiterated his intent Monday on Fox News, noting that what Garland is saying and what federal prosecutor David Weiss is saying “are two different things,” and setting next Thursday, July 6, as the date for the beginning of an impeachment inquiry.

At issue is whether Weiss, the Delaware-based federal prosecutor who oversaw the sham prosecution and sweetheart deal of Hunter Biden, had full authority to carry out the prosecution of Biden or whether he was hamstrung by Merrick Garland and his Department of Justice.
As the New York Post reported Monday, “The attorney general said Friday that Weiss was allowed ‘to continue his investigation and to make a decision to prosecute any way in which he wanted to and in any district in which he wanted to.’”
And yet, as the Post went on to report, Weiss “told at least six witnesses last year that he lacked authority to charge the first son outside Delaware and was denied special counsel status.” That’s according to IRS supervisory special agent Gary Shapley, the whistleblower who’s done more to expose the corruption of Joe Biden’s Department of “Justice” than anyone else.
In a statement from his legal team, Shapley named names — six of them, in fact, who were witnesses to Weiss’s claim that he couldn’t press charges against Hunter Biden in Washington, DC, without the approval of the U.S. attorney in that jurisdiction.
As Shapley’s attorneys pointed out: “In an October 7, 2022, meeting at the Delaware U.S. Attorney’s Office, U.S. Attorney David Weiss told six witnesses he did not have authority to charge in other districts and had thus requested special counsel status. Those six witnesses include Baltimore FBI Special Agent in Charge Tom Sobocinski and Assistant Special Agent in Charge Ryeshia Holley, IRS Assistant Special Agent in Charge Gary Shapley and Special Agent in Charge Darrell Waldon, who also independently and contemporaneously corroborated Mr. Shapley’s account in an email.”
“Somebody is lying,” said Fox News legal analyst Sol Wisenberg, himself a former deputy independent counsel. “Either Merrick Garland has lied under oath to the Congress, or David Weiss lied to the IRS agents.”
Somebody is lying, and we know who that somebody is.
To be clear, when we say Merrick Garland is lying, we’re not saying he simply misspoke. As the New York Post reported back on April 20, “Garland has repeatedly claimed under oath that Delaware US Attorney David Weiss, a Trump administration holdover recommended in 2017 by the state’s Democratic senators, is able to criminally charge Hunter Biden without the permission of other Justice Department leaders.”
Who are we to believe, then — Shapley, Weiss, and his room full of witnesses, or Merrick Garland?
It’s high time for Republicans to stop pussy-footing around and drop the gloves. Back in February, when they were mulling the impeachment of Homeland Security Secretary Alejandro Mayorkas and Joe Biden for their abject border malfeasance, National Review’s Andrew McCarthy said this: “Either Republicans use the best tool they have to force Biden’s hand, or they are aiders and abettors.”
That tool, the best tool they have as a party that controls one-half of one-third of the federal government, is impeachment. And our nation’s corrupt attorney general, Merrick Garland, should be its target.
