A Legal Action Supporting Restoration of Constitutional Integrity

"I do solemnly swear that I … will to the best of my ability, preserve, protect and defend the Constitution of the United States." --Article II, Section 1, U.S. Constitution

On the eve of Constitution Day, and the 15th anniversary of The Patriot Post, we are preparing to launch a legal battle in support of our mission to reinstate Rule of Law as enshrined in our Constitution. This legal action, unlike others before it, regards Breach of Oath -- breach of the contract established by our Constitution between the elected and appointed members of the Executive, Legislative and Judicial branches of our government, and We the People. It seeks remedy for the lack of any proscription against, and penalty for such breach.

Demand Oath Accountability

To enforce our Constitution's limits on the central government, we believe a formal legal action is necessary. This action, if successful, would require that all members of the Executive, Legislative and Judicial branches, first and foremost, abide by their oaths "to support and defend" our Constitution, under penalty of law, and thus, comport with its enumerated "few and defined powers" (Madison) of the federal government. The current scope of federal activities provides abundant evidence that many members of those three co-equal branches have long since abandoned their oaths, and, at present, there is no recourse for prosecution to enforce compliance.

This civil action is predicated on three questions concerning Rule of Law as enshrined in our Constitution:

First, are elected and appointed members of the Executive, Legislative and Judicial Branches of the central government required, under penalty of law, to abide by their oaths "to support and defend" our Constitution, as specified in its original language in Article II, Section 1 and Article VI, clause 3, as ratified?

Second, in respect to their oaths, do all members comport with our Constitution's prescribed method for amendment as specified in Article V, rather than disregard that constitutional prescription in favor of legislative actions based upon judicial diktats redefining those limits in accordance with the errant so-called "living Constitution"?

And, third, if the answers to questions 1 and 2 are "no," then does breach of oath, which is not currently subject to legal redress, constitute a breach of trust with the American people -- a violation of the contract established by our Constitution between those in the Executive, Legislative and Judicial branches, and the American people? Consequently, does Breach of Oath impose harm and injustice upon citizens, who are subject to the government's laying and collecting of taxes, and accumulating of debt, for expenditures not expressly authorized by our Constitution?

The first step in seeking legal remedy to restore the integrity of our Constitution is to establish whether "We, the People," have legal standing to require all members of the three branches of our central government to abide by their oaths.

To that end, please sign on to this action, and join Patriots across the nation, particularly those in our Armed Services who have defended their oaths with blood and life, in this effort to establish legal standing as citizens. If we are unsuccessful in this bid to seek remedy for the lack of any proscription against, and penalty for breach of oath, it is because the judiciary refuses any such accountability regarding the wanton violation of our Constitution. Such rejection would, in effect, render Americans, once again, condemned to the abuse previously characterized in American history as "Taxation without Representation."

Our goal is 500,000 signatures, which is minimally necessary because if the federal judiciary refuses to hear this action, then we will take it to the national legislature for codification into federal law. A large support base will be necessary if we are forced to exercise that alternative.

Background

This civil action to restore the integrity of our Constitution and its enumerated limits upon the role and activities of the central government is funded by The Essential Liberty Project and promoted by The Patriot Post.

We are seeking to answer the question of whether "We, the People," have legal standing to require all members of the three Branches of our central government to abide by their oaths. We will determine the appropriate venue and ask the court to certify this action once we have reached a sufficient number of plaintiffs to impress upon the court, and supporting members of Congress, that The People demand recourse.

We believe that this complaint complies with Federal Rules of Civil Procedure and thus should be provided a federal hearing, an assertion that, if denied by the courts, we will seek on appeal. We may also opt to file in one or more state courts should the federal courts reject this action. And last but not least, if enough Americans sign this action, the legislative option becomes viable.

We will reject the notion that the power to vote constitutes fair "representation," where there is no assurance that representatives will abide by their oaths of office and, instead, use the treasury as an instrument to perpetuate their re-election by special interest constituencies, whose allegiance is secured with confiscated and redistributed wealth.

If American citizens are rightly found to have legal standing, then the second order of business will be to question congressional authority to lay and collect taxes, and to accumulate debt, for expenditures not expressly authorized by our Constitution, with the objective of defunding such expenditures.

We will seek to renew congressional requirements for enumeration of constitutional authority for each and every piece of legislation proposed by the Executive and Legislative branches.

Our United States Constitution, as written and ratified, stipulates in its preface that it is "ordained and established" by the people to "secure the Blessings of Liberty to ourselves and our Posterity." To that end, it established a republic, not a popular democracy, which is to say it affirmed the primacy of Rule of Law over rule of men.

Accordingly, the first order of business for those elected to national office is that they be bound by oath to "preserve, protect and defend" the Constitution under which they were duly elected.

For those elected to the presidency, Article II, Section 1, specifies: Before he enter on the Execution of his Office, he shall take the following Oath or Affirmation: "I do solemnly swear (or affirm) that I will faithfully execute the Office of President of the United States, and will to the best of my Ability, preserve, protect and defend the Constitution of the United States."

Likewise, Article VI, Clause 3 specifies: "The Senators and Representatives before mentioned, and the Members of the several State Legislatures, and all executive and judicial Officers, both of the United States and of the several States, shall be bound by Oath or Affirmation, to support this Constitution..."

The key words here are "shall be bound by oath or affirmation." Bound how and by whom? And with what penalty for violation? Currently, we believe they are bound solely by their conscience, and there is no statutory mandate for abiding by their oaths.

Our Founders intended that elected officials and judges, by way of their oaths, would be constrained by Rule of Law. However, they also assumed that those elected and appointed would be, uniformly, men and women of sufficient character to honor their oaths.


Our Founders were clear about our Constitution's Rule of Law and its prescribed method for amendment as specified in Article V, but the enforcement of that prescription is predicated on being bound by oaths.

George Washington: "The basis of our political systems is the right of the people to make and to alter their Constitutions of Government. But the Constitution, which at any time exists, 'till changed by an explicit and authentic act of the whole People is sacredly obligatory upon all. ... Should, hereafter, those incited by the lust of power and prompted by the supineness or venality of their constituents, overleap the known barriers of this Constitution and violate the unalienable rights of humanity: it will only serve to show, that no compact among men (however provident in its construction and sacred in its ratification) can be pronounced everlasting and inviolable, and if I may so express myself, that no Wall of words, that no mound of parchment can be so formed as to stand against the sweeping torrent of boundless ambition on the side, aided by the sapping current of corrupted morals on the other."

John Adams: "Our Constitution was made only for a moral and religious people. It is wholly inadequate to the government of any other. ... The only foundation of a free Constitution is pure Virtue, and if this cannot be inspired into our People. ... [T]hey may change their Rulers, and the forms of Government, but they will not obtain a lasting Liberty. ... A Constitution of Government once changed from Freedom, can never be restored. Liberty, once lost, is lost forever."

Thomas Jefferson: "Our peculiar security is in the possession of a written Constitution. Let us not make it a blank paper by construction. ... To consider the judges as the ultimate arbiters of all Constitutional questions [is] a very dangerous doctrine indeed, and one which would place us under the despotism of an oligarchy. ... The Constitution has erected no such single tribunal, knowing that to whatever hands confided, with the corruptions of time and party, its members would become despots. ... The opinion which gives to the judges the right to decide what laws are Constitutional and what not, not only for themselves in their own sphere of action but for the Legislature and Executive also in their spheres, would make the Judiciary a despotic branch. ... On every question of construction carry ourselves back to the time when the Constitution was adopted, recollect the spirit manifested in the debates and instead of trying what meaning may be squeezed out of the text or invented against it, conform to the probable one in which it was passed. ... In questions of power, then, let no more be heard of confidence in man, but bind him down from mischief by the chains of the Constitution."

Alexander Hamilton: "[T]here is not a syllable in the [Constitution] which directly empowers the national courts to construe the laws according to the spirit of the Constitution, or which gives them any greater latitude in this respect than may be claimed by the courts of every State. ... The Judiciary ... has no influence over either the sword or the purse; no direction either of the strength or of the wealth of the society, and can take no active resolution whatever. It may truly be said to have neither force nor will. ... If it be asked, 'What is the most sacred duty and the greatest source of our security in a Republic?' The answer would be, an inviolable respect for the Constitution and Laws -- the first growing out of the last. ... A sacred respect for the Constitutional law is the vital principle, the sustaining energy of a free government. ... [T]he present Constitution is the standard to which we are to cling. Under its banners, bona fide must we combat our political foes -- rejecting all changes but through the channel itself provides for amendments."

James Madison: "I entirely concur in the propriety of resorting to the sense in which the Constitution was accepted and ratified by the nation. In that sense alone it is the legitimate Constitution. And if that is not the guide in expounding it, there may be no security for a consistent and stable, more than for a faithful exercise of its powers. ... If Congress can do whatever in their discretion can be done by money, and will promote the General Welfare, the Government is no longer a limited one, possessing enumerated powers, but an indefinite one, subject to particular exceptions."

Those members of the Executive, Legislative and Judicial branches, who have abandoned their oaths, believe they are above the mandates established by our Founders, and thus, above the law.

Our constitutional rights are being violated, and that violation is sustained by unjust taxation for purposes not expressly authorized by our Constitution. Consequently, our nation is on the precipice of insolvency, and the bill is coming due. It will most certainly be repaid in the currency of tyranny unless Liberty with its inherent Rule of Law prevail.

The time has come that all American Patriots must, "with a firm reliance on the protection of divine Providence, mutually pledge to each other our Lives, our Fortunes and our sacred Honor," as we endeavor to restore Rule of Law and our Constitution's limits on the central government.

As a retired US Navy veteran I have taken a very similar oath more than once. The main difference between the oath I and all members of the US military takes is the phrase "I will obey the orders of the officers and men appointed over me." Obama has clearly not defended the Constitution as he swore to do. In fact he has endeavored to undermine or outright disregard the Constitution and the Supreme Court rulings which go against the Socialist agenda his Administration is pursuing with great vigor.

When I joined the United States Air Force a long time ago I swore an oath to defend our country against enemies foreign and domestic. I have tried

to keep that oath even after being discharged. I have voted for the best canidates possible, have written articles expressing my opinions and have done what I can to support what the Constitution represents. I have joined the tea party and am a follower of the Libertarian cause and a member of the Republican Party.

If you take an oath in court and lie, and are caught, you go to jail.

Anyone who fails to honor an oath of office should at least be removed from that office and lose all accrued benefits, if not jailed for malfeasance in office.

Do we need a Constitutional amendment to spell this out clearly?

IF the people do not have "standing", then neither does the 'judge' that would deny the RIGHTS of the PEOPLE.

Under the Constitution, the PEOPLE are SOVEREIGNS which place the PEOPLE above the government, for the government is merely a tool of the PEOPLE to provide infrastructure to the PEOPLE.

The government is not an entity unto itself.

And Neither are the "SERVANTS" that are employed to SERVE THE NEEDS of the PEOPLE.

An OATH is a viable contract that can be enforced.

I am in favor of a simple, one line amendment to every State Constitution: "Neither legislated law, nor judicial fiat shall ever supersede CONSTITUTIONAL LAW".

As some have already stated, those of us that wore or are presently wearing the uniform of one of great armed services take the oath to defend and support the constitution freely and without reservation. I took that oath first in 1972 and renewed it four or five times during my career of 31 years, we have to defend those who are to weak to defend themselves, unfortunately, little did we know what a "milktoast" we would have in the white house.

I happily repeted that oath each four years, through a twenty year career. I maintain that the very same oath guides me through my daily life today.

I am appalled today that we have people in our Congress who are not abiding by the Oath! And evey one of them took it freely but today there is a tremendous lack of integrity, from the Executive Branch and throughout all government agencies!

I took an oath when I entered the U.S. Army to defend our Constitution against all enemies both foreign and domestic. I get the foreign part, but never have I seen such a bold and calculated attempt to do end runs around our Constitution by legislative means by our present congress and president.

This in my mind constitutes a breach of trust between those individuals and the American people. An abusive misuse of power that has crossed the borders of decency and finds them in contempt of this country's laws.

Regarding your question: "Have you ever taken an oath", Yes. The first time was when I pledged to marry! Other than that, in a court of law & prior to being questioned for depositions. It's a pretty sobering experience on all counts.

As an aside, some people retain oaths and some do not. It's very odious when oaths are broken!!!

In the past I have said, The Tenth Amendment may be the only way to save our nation. A group of several States should get together... Filing suit against The Federal Government of The American Empire for blatant disregard to and violation of the U S Constitution's Tenth Amendment. Obviously, a suit of this nature would end up in The Supreme Court...

It appears Mark Alexander and The Patriot Post will take on the burden of goint to bat for our Nation's Constitution which State and Federal Officials have turned their backs to!

What the BHO Regime cannot legislate they WILL Regulate or rule by Executive Decree.

Under this Regime the ALL departments in the Federal Government exceeds what is authorized by our Constitution. Therefore, it IS an illegal government!

However, we have an Executive Branch, Legislative Branch, Judicial Branch, Bureaucrats and a Military who ALL take an oath to uphold our Nation's Constitution... yet NOT ONE OF THESE INDIVIDUALS WILL STAND UP TO STOP THIS ABUSE!

Our Constitution either means what it says or it does not mean anything at all!

Obviously, those in the Senate and House chose to do nothing! They have turned over their job of governing to the BHO Regime and the un-elected bureaucrats appointed by the BHO Regime and Federal Civil Service workers in the governments various departments!

Our nation was formed by individuals who put all on the line because of abuse from King George III and among other things “Taxation without Representation”. Well folks, under the BHO Regime we are experiencing “Regulation and Executive Decree without Representation”!

We have all taken the oath, through either military or police service and have renewed our oath to defend The COnstitution against ALL enemies and refuse, openly, to follow unconstitutional orders.

Our next step is to organize the Constitutional Army to ensure the Constitution is followed, through civil law means as this, to begin with.

"Bound how and by whom?" You are right, sir, that it is to us - the citizens of this country - that they are bound.

"And with what penalty for violation?" An oath taken to God ("I...do solemnly swear...So help me God") with an intent to deceive is something that will be addressed by our Maker when this life is over. But until that time comes, with an understanding of the merits of the 2nd Amendment, we citizens have the right to bear arms (given by God Himself) to ensure that we can again replace a tyrannical government if needs be using the principles so well laid out in our Declaration of Independence.

Yes, I have taken oaths in the past and do not do so lightly. As Sir Thomas Moore stated in 'A Man for All Seasons', "When a man takes an oath he is holding his own self in his hands. Like water. And if he opens his fingers then — he needn’t hope to find himself again. Some men aren’t capable of this." Well I am capable of this and I recently had the privilege to witness that I successfully passed this personal integrity on to my son as he trembled to take the same oath I had once taken years ago. He too ‘Get’s it’. Even if our Teleprompter-in-Chief and his accomplices on both sides of the aisle do not. No one forces anyone to take an oath. If one cannot live up to the oath, don’t take it and refrain from the activity that would require it. Leave positions that require integrity and honor to those that can uphold it. I dare say that if we could make that the law of the land, Washington D.C. would become a ghost town.

Either the judicial branch scorns us or it supports us based on the constitution. At least we'll know where things stand at that point.

You wouldn't think so, but the Federalists thought it unneccessary to provide a Bill of Rights since the Constitution enumerated powers to the federal government and any bill of rights was implied. Thanks to the Jeffersonians, we are at least protected in some way from those who tyrannize us on our behalf.

I took an oath when I joined the Navy on 1/2/46 and again when I was commissioned in 2/60. My oath was to defend my country against all enemies whomsoever.

I remained in the Navy for nearly 32 years and

retired on August 31st, 1977.

I took my oaths seriously and was in combat in Korea and

Viet Nam.

I agree with and support your action to see that all elected federal officials are required, under substantial penalty of law, to abide by their oath of office. I have said from day one and numerous times since then tha Obama has betrayed his oath of office egregiously and should be impeached, convicted and then jailed or executed for treason.

I took the same Oath as the Military when I bacame a deputy sheriff many years ago. I took the same oath when later I became a correctional officer also in North Carolina. It was a very serious and humbling experience both times. My ever gratitude is the people that administered "The Oath" for me.

History has shown that using the federal government's courts for a redress of grievances by said government doesn't work. Therefore, we shouldn't waste our time with federal OR state courts and go directly to our state legislatures and do something that Madison and Jefferson referred to as Nullification. I have seen elected politicions over the last 20 years not abide by their pledged oaths to defend the Constitution but rather to change, manipulate and revise based on their own poltical idealogy.

This is true for those that will not pass laws to defend our Country from illegal invaders, try to write new laws from the Executive office in violation of our Congressional Representives elected by the people and not represent the total population of Americans but favor their own selected groups. This even happens in our Judical Branch were the rule of Law is based on Personal poltical views instead of our actual Constitutional rights as Citizens. We are being driven by poltical dictate in current times with this ERA of Big Government writing numerous rules, regulations and huge efforts to tax successful citizens and redistribute their wealth to favored segments of the population. This has killed jobs, smothered our creativity and stopped us from using our own God Given natural resources in our Country to stimulate the economy. This coupled with outrageous spending by the Preident and his Party has crippled our people , stolen their abilty to earn money in the free market and preserve our very way of life. We are becoming weaker and more dependent on other countries to even produce our own goods. This has got to stop or America will no longer be the Country that truly defends freedom around the world and is a generator of Capital and Creativity once more. We are being driven to a Solialistic Society with this current Adminstrations goverance.

More than a few have been executed for Treason; acting against the interests of the citizens of the Republic, is my understanding. That is to say, "violation of the Oath of Office." It is so in the military, and it should be so for other federal employees, including the three branches and such members. The halls of government are to be occupied by citizens, not monarchs. Subject to, and conforming to, all he duties, and rights, of all the citizens. So why is our Congress not on the same programs as the populace? Such as Social Security. Where do I sign?

I have long believed that ANY elected official who writes, enacts, votes for, or is party to, ANY legislation that that runs counter to, is in oppostion to our Constitution or proves to be Unconstitutional is automativcally guilty of breach of contract and should be removed from office immediately. I've taken several oaths. As a police Officer, as a veteran, and every time I was called upon to speak the truth in a court of law. Oaths are meaningful, leagal and binding upon the actions of a U S Citizen. Actions one may take that are contrary to the oath they take are punishable by law. Elected officials especially should be held accountable to their oaths and should be made to vacate their positions if found negligent in their duty.

I took an oath when I enlisted in the Air Force, every time I re-enlisted and when I was commissioned.

It was made clear to me and, I am confident, to every other American who served in our Armed Forces that I was obligated to honor this sworn oath. It also was made clear to me that the Uniform Code of Military Justice included provisions for adjudicating failures to comply with this oath.

For more than 23 years I served under that oath and was proud to do so. It grieves me deeply to see that our elected government officials, who swear the same oath, may blatantly violate that oath with near-absolute impunity.

And a great many of our government officials continue to violate their oaths, yet enjoy lifetime pensions, tax breaks, and free medical care for life. And the only hostile force they confront is the conservative news media.

You ask if I have taken an oat, yes I have taken several. I have been a Boy Scout and as such taken an oath. I am a member of the Order of the Arrow and have taken another oath. I have taken an oath of enlistment several times. I have taken an oath upon acceptance of my appointment as a Warrant Officer, and I have taken several oaths, one each time I was commissioned as a Chief Warrant Officer. At least in the United States Marine Corps, the oath we take is taken very seriously. Each and every Marine is fully questioned beforehand to ensure they understand what the oath means, and how it applies to them. Then they willingly and without reservation or purpose of evasion, take the oath. No contract is signed or commission accepted until the oath is stated clearly with at least one witness besides the administering official.

I am a retired sergeant major of Marines, so, yes, I took the oath to "support and defend" many times. I believe it is treason if you break that oath. From our chief executive on down they have broken their oaths of office and should be tried for treason and punished accordingly. That is what would have happened to me. Are so-called "public servants" above the law of the land? They think they are, but they are not. Sadly, they continue to break their oaths on a daily basis and nothing happens. It has been very troubling to discover just how difficult fulfilling it has been--not because of my own personal disregard, but because of the demands of the infinite Federal programs, grants, regulations, and requirements. I have seen just how far we have drifted from the restraints of the enumerated powers placed on the Federal Government, and how our failure to follow the wisdom of our Constitution's structure has inflicted immense damage on our communities, our schools, our businesses, and our personal liberties.

The penalty for the violation of an oath of office should be IMMEDIATE removal and suspension of any future pay, benefits, or entitlements that may have accrued during a term of service.

Elected officials found guilty of serious crimes against the U.S. should face the death penalty as the only level of justice that is recognized as suitable for deterring the corruption of our political system.

On their first day of office, each of our elected leaders and representatives swears allegiance to the Constitution, but for too long many have freely ignored that oath and instead worked to subvert the Constitutional limits on their actions.

While the policies of Obama and his willing minions have thrown our nation into economic chaos, they have at least hastened the day when it will no longer be possible for liberal politicians to pretend even to pay lip service to the Constitution, but will be forced to declare openly their derision for the principles that made America great.

When I served as an officer in the Navy, I too took an oath, but unlike many currently serving in government, I meant it when I swore to support and defend the Constitution. Although I am no longer in uniform, I feel that sacred charge even more keenly today.

The time is fast approaching when each American will have to make the clear choice between a further decline into Marxist feel-goodism and a restoration of limited government of, by, and for the people. When you meet with your fellow Patriots at the Tea Parties or other gatherings of like-minded conservatives, consider reciting this pledge:

Although I am retired, those Oaths still guide me. Those Oaths require me to support and defend the Constitution of the United States. I swore the oath first as a 17 year old in 1955 and again upon commissioning as a Naval Officer in 1959. I was impressed with the solemnity and the unending nature of the act, in peace or war.

I never renounced the oath and will NEVER do so. I feel as compelled now, at age 74, to comply with the oath as I did in my past. I still owe my country the allegiance and servitude the oath conveyed. Defending my country and its Constitution against enemies, foreign or domestic was my accepted mission and it still is.

I know others have served in political office that have uttered the same oath. I am deeply saddened and offended that some have elected to subordinate their oath before leaving office, let alone some who later chose to avoid adherence to their oath. Never have I heard a single renunciation of the oath by those who chose to break it, with or without purpose of evasion. I reckon such people are regardless still required to live up to their oath if they have never renounced it.

To me, it's a sacred responsibility that I will not fail to comply with. I don't expect other oath-takers to fail to live up to their oath, either.

During my nearly 26 years in the Navy, I was promoted with the advice and consent of the Senate and signed approved by the President. Each of my acceptances of promotion was accompanied by the oath of office. My adherence to the oath is my lifetime commitment.

I don't understand how Republicans could have allowed a justice to be seated (Kagan)who accepts the Constitution as it was interpreted by Thurgood Marshall rather than the original. This will have dire consequences.

But I don't see how this suit can be won. The Court will find what it will but it cannot impose fines in general but only in particular and only for those laws which are explicit, passed and signed. Still, I wish you luck to establish a standing at least or the public acknowledgement by the Court of its rejection of the peoples' standing.

The legislative action is the obvious one though the most difficult to achieve given the crop for whom the American public rightly approves of by about 20%. But who knows. Embarrassment might work where nothing else will.

So, I agree TOTALLY that there has been a breach of oath.

My QUESTIONS are these: Since there is an obvious conflict of interest involving the very judicial branch that is named in the law suit, WHO has jurisdiction over this kind of civil action? How does it get reviewed and how do we get an impartial judgment? And how do we get whatever judgment applied/executed, since the Executive Branch is also part of the suit and therefore faces a similar conflict of interest?

Or perhaps a more pertinent question: How do we convince all the Progressive citizens (who are so ardently opposed to following the Constitution) that we would all be better off if we would just return to a Constitutional Republic? I don't find that reason goes very far with them, and that they feel it is a MORAL obligation to become Socialist.

I first took the Oath of Office upon entering the US Naval Academy in 1964. I repeated that on the occasion of every promotion I received as a commissioned officer in the US Marine Corps. I again took that Oath upon entering service with the Dept. of Homelenad Security/TSA in Dec. 2009.

On each occasion I took that Oath as a solemn vow to serve and protect my country from all enemies, foreign and domestic, and will do so until I take my last breath.

Those who are elected/appointed to serve our country at the federal and state level, in particular, must be held accountable to the same high standard. If not, the Oath has no meaning and is just another "pro forma" ritual those officials must endure to do their own bidding. It's high time they are made accountable to the citizens who elect them, not the other way around.

For more than 23 years I served under that oath and was proud to do so. It grieves me deeply to see that our elected government officials, who swear the same oath, may blatantly violate that oath with near-absolute impunity.

And a great many of our government officials continue to violate their oaths, yet enjoy lifetime pensions, tax breaks, and free medical care for life. And the only hostile force they confront is the conservative news media.

Pay particular attention to what the Enlisted have to add that is not included in the Officers' oath.

There is a conflict of oath involved if the Commander in Chief is acting contrary to the Constitution.

I have taken the Oath at my commissioning as an Army officer. It was not spoken lightly - it was backed up by the pledge of my life, if necessary.

You cannot be an officer without the oath, and therefore it is necessary. Since it is clearly more than a pro forma excercise, it must be enforceable.

The Founders thought the Oath imposed a solemn obligation of the highest order on holders of positions of public trust- we should not do any less.

I regard the Pledge of Allegiance as an oath, and I swore that every day at school until I was out of high school. While I was never in the military, I have taken oaths before. Admittedly, my oath of fealty to my knight and my oath of fealty to the crown as a peer in my own right are in a medieval organization that is really a game, but I still regard those two oaths as my word, and I have always regarded my word as my bond, something to not take lightly, and definitely not something to be broken.

Taking the oath in equivocation or by mental evasion is criminal. Doing so, should be punished severely.

To act otherwise diminishes the purpose of the oath and the very Constitution sworn to be protected.

Yes, my oath is half a century old, but it is still operative.

A "living Constitution" is the outcome (intended) of lawyerly meddling that arose when case law and playing precedents was substituted (unlawfully) for the very clear contract law under which the Constitution was constructed. Time to reverse that. A good place to start would be the wholesale repeal of the entire Code of Federal Regulations.

There is an awful spiritual penalty for violating that oath. But for those who do not fear eternal damnation, it seems appropriate that all oath takers are subject to at least a criminal if not treason conviction.

In the 60's I was a police officer. This was before MLK and the civil rights movement. I took a oath of office and was not happy to find that un-official policy was VERY much against protecting certain citizens according to the Constitution.

It was troubling to me that people were treated in a way that ignored the Constitution and the oath I took. I objected to violent abuse of poor people of various minorities.

I was not an activist. However, I returned to sales as an occupation. I am still proud to have served as a police officer. But an oath is sacred.

Article 1,section 8 of the Constitution has mostly been delegated away from Congress. They need to be required to take back the duties designated by this article. were taken to defend the Constitution, etc. My first oath was made on Thursday, August 12, 1948 when I was sworn into the U. S. Navy. I have pledged many, many times my allegiance to the flag of the United States of America. I am a true patriot and am disgusted with the present administration and many senators and representatives of both parties in their seemingly lack of allegiance to their oath of office. To those who swore with their right hand on the Holy Bible, GOD will not be fooled by the spin these will try to justify their actions. The Jefferson letter to Danby Baptists, the Federalist papers and the other writings by the founders, who sacrificed everything, make it very clear, even to the ignorant, that America is a Judeo-Christion nation. It was also verified by their actions to the Indian nations, the printing of Bibles by Congressional press and the services held in the white house and later the house of representatives. It's easy enough to support the principles at stake here -- I do -- but not at all easy to predict the outcome. Aren't the courts likely to waffle and pass the buck by saying (a) the class is too broad and lacks standing; and/or (b) the only remedy, by necessary implication, is the (badly corrupted) ballot box?

If that's only half correct, where does it leave us? Reaching for the ammo box, most likely. You'd best be really clear that's what you want because there will be no going back.

In Obama's case the key word is "ability!" By upbringing, tutoring and

As a Marine during the Viet-Era (not a combat veteran) I gladly took an oath to Support and Defend the Constitution against all Enemies, Foreign AND Domestic. It was no accident that this Oath was prescribed for American military personnel. Our forefathers recognized that Tyrants from within can as easily threaten our God Endowed Liberties, as Tyrants from without. I am committed as ever to this Oath which has no expiration date. I am convinced that virtually all Veterans feel as strong about their Oath, or stronger, as the day they took it in their enlistment or commissioning ceremony.

Any elected or appointed office/bench holder must respect their oath with the same seriousness and integrity as those who have paid with blood, tears, lives, and toil (and diminished livelihoods) to fulfill their oaths - the American military men and women.

Anyone in the military is subject to disciplinary action and court-martial who shrinks from their post and orders in the day of battle. Office holders and judges must be held to the same accountability by the people for shrinking from their constitutionally defined duties in this day of battle.

The oath is not to be taken lightly.It has been defended with the blood of patriots and those who deign to redefine this document for their own purposes must be removed from office under penalty of law.

It may come to pass that we, the people, have to take more drastic measures to rid ourselves of the scum who believe they can do anything they want with impugnity.

The restoration of constitutional limits on government is a noble cause for essential freedom. If we must fight to accomplish this then so be it!

Have I taken an oath? You betcha I have. I took one when I became a Christian, I took one when I enlisted in the USAF, and I took one when I married. So far, I have honored them all. Oh, it's true, the wife walked away from hers, but that was her choice, not mine. The one I took when I joined the Air Force was very similar to the one the President took when he was sworn in. I honored my oath, but he has not. What a pity for him. I support this effort by the Patriot Post, and I will support the effort every way I can.

Let our government know, acting outside the limits placed in the Constitution is unacceptable. Taxing the citizens of this country for every breath we take and every mile we walk or drive will no longer be tolerated. The elected government is not our masters; they were elected to defend our way of life, a life of liberty and independence, not servitude and submission. Let it be known on the 4th of July that we are putting the elected on notice, “you are not our Kings and Queens! Our money is not your money; you are not entitled to our sweat and labor beyond the operation of the government and the national defense. Do not treat us with contempt! This is your wake up call, the slumbering giant often referred to as the Silent Majority will no longer remain silent. Do what you were elected to do and restore the limits we placed upon you. The American population is a tolerant one but our tolerance is being pushed beyond the breaking point.

I took this sacred oath, when I immigrated to the U.S.A. and joined the U.S. Navy, in 1964. I reaffirmed this oath when I became an American Citizen, in 1970 and reenlisted in the U.S. Navy , as an enlisted. Additionally, I reaffirmed this sacred oath, when I was promoted as a Naval Officer.I retired after a full 21- year career, in the U/S. navy. Even if an individual took this sacred oath, while in the service, for one tour, only, the validity of this oath still stands, even if this individual is currently a civilian. I believe that I could be called an "OATH KEEPER".

Elected officials and other Oath takers must be held accountable. What is now going-on, within the U.S. Government and in our country, is totally unacceptable and we need to take action, to reverse this direction, before it becomes too late.

Now even our own president and members of congress are violating their oaths of the same. If I violated that oath it was treason. Why is it not treason if they violate that same oath?

If we had even one federal district attorney with any backbone and sense of justice he would seek grand jury indictments of a large number of federal officials, both executive and legislative, for false swearing. Those who falsely swore to protect and defend the constitution inhabit both political parties, although they are far more numerous in the democrat ranks.

I took an oath both as an enlisted man and later as a commissioned officer to protect and defend the Constitution of the United States against all enemies, (etc.) It is an oath I still revere and live up to this date. Too many of our elected Representatives and Senators have forgotten the oath they took when they entered the office to which they were elected. I have asked Representative Gus Bilirakis to mention this to his fellow representatives.

This is admirable, but, as a product of modern times, I must constantly refer to my dictionary. I often get bogged down in verbage. It would help to have a simple overview to accompany the document. It would give direction to my pursuit of understanding.

Litigation has fared poorly as a valid means of social engineering. The unintended consequence of having public servants with integrity subject to suit for for violating oaths will distract good leaders and further discourage qualified candidates for office. This action is ill-conceived.

I've taken the oath when I enlisted 31 years ago and have subscribed to it ever since. My daughter, her husband and my son have also taken that sacred oath. The Constitution is the foundation of this great Republic. If mere citizen soldiers can take and uphold the oath, should not our elected repersentatives be held to the same standard?

I took the oath several times while enlisting and reenlisting in the U.S. Armed Forces. At those times I had no idea to what I was swearing. Since then I have read and studied the Constitution several times plus The Federalist Papers. I was shocked to discover that over 50% of Our current federal government has no delegated authorization, Congress blithely passses legislation with little or no constitutional basis, and that opinions rendered by the Judicial branch liewise hardly ever cite constitutional justification, but have relied on "penumbras" known only to them, and have blatantly violated their oaths by citing foreign laws as justification for their opinions.

There should be a requirement for all personnel preparing to take this oath to either receive training on the Constitution AS WRITTEN and RATIFIED or successfully pass a test demonstrating this knowledge.

when I joined the U.S. Air Force I took an Oath to defend the Constitution. When I was seperated I did not see anything in the paperwork I signed that rescinded or canceled that Oath. It would seem that millions of U.S. citizens are still sworn to this cause.

We The People of the United States of America, affirm our Sovereignty as free People, a federal Union, a Republic, and Nation. And Renounce the use of Force: armies, navies, or mercenaries to make aggressive War, declared or nor, for the corrupt purpose of dominion or conquest. No Soldier or Sailor of this Union shall issue or obey any order contrary to the Law of Nations; nor be forced to obey orders of, or be delegated to, the command jurisdiction of foreign entities or officers; nor be subject to foreign or domestic: trial or punishment, nor be deprived of life, limb, or liberty, upon allegiance to this sovereign principle.

A foreign or international source shall Not be cited to interpret this Constitution, or decide the constitutionality and meaning of the Laws of the Land, and the treaties made in pursuance thereof; Nor to authorize enforcement or to deny execution of this Constitution, laws, and treaties; Nor to deprive any Person of their life, limb, or liberty; Nor to decide any cause of action, within the Federal jurisdiction, or of the several States, or of the territories.

No Person, whether Elected, Appointed, Commissioned, or Hired; shall be an employee of the United States as any Officer or subordinate- receiving an emolument, compensation, or profit, for a span of tenure to exceed thirty-six years; and no one Office made by Congress shall be Filled for a Term to exceed eleven years. And that such emoluments, compensations, or profits shall not be increased without a record vote of Congress in current session, nor shall such increase commence until a new Congress-convene.

A Citizen only shall vote, in the vicinage of the state wherein they reside seven months of each year, for elective offices or upon issues in federal, state, local elections or referendums within the United States or any jurisdiction thereof And all votes shall be cast upon the day of election only, except military posted aboard, at each polling precinct which shall be administered and all ballots counted by a Jury of twelve citizens, randomly summoned and sworn, to protect ballot secrecy. The Will of the People as determined by vote tally shall not be challenged, delayed, or negated by any Person, Citizen, Judicial Court, or other Officer of the United States or of any State, lest the resultant margin be less than one percentile.

The Person upon being; Elected, Appointed, or Commissioned; such that each of these officers, not elsewhere provided for in this Constitution, shall have been a Citizen of the United States five years. And Cadre military, hired, and contractors of all inferior offices wherein their duty may require secrecy, shall be a citizen. And lest secrecy be necessary of their duty, citizenship shall not be required of non-cadre enlisted military.

Candidates for Federal election, appointment, commission, and hire; or all Persons upon voting shall prove their citizenship, literacy, and qualification. All Candidates for office or Persons to vote shall be ineligible upon impeachment for high crimes and misdemeanors or conviction of criminal felony; and officers upon failure to abide by their Oath of Office shall be ineligible as though impeached for high crimes and misdemeanors or convicted of criminal felony. All candidates, to be qualified, to prove literacy, and to Know Thine Oath; shall read aloud and whole, in English -henceforth the official language of the Land for Commerce, Trade, and Law: the Declaration of Independence and the Constitution of the United States. And before a Jury of one hundred citizen peers from the vicinage of the candidate, randomly summoned and sworn, and after such reading, the Jurors being empowered to approve or deny such candidacy by a vote of fifty-three Jurors.

Each of the several states shall be entitled to three and not more than fifty-three Representatives, and each shall be elected by the citizens of the state such that each elector shall vote in election of two Representatives, one of which shall be elected by the citizens of the whole state and shall be Spox of the State delegation; the remaining Representatives, allotted resultant of the Census, shall be elected by citizens within a district made by the state legislature. The Representative shall have a term of two years, nine times eligible for election, not more than eighteen years, nor more than six years consecutive. The Governing executive of the State, in the event of a vacancy of office, shall appoint a Representative to the remainder of the current term. A Representative elected and served from a State, shall not be elected or appointed a Representative by any other of the several States.

Each of the several States shall be entitled to three Senators and each shall be elected by the citizens of the whole state; such that each elector shall vote in election of three Senators, one Senator elected each biennial year. Each Senator shall have a term of six years, thrice eligible for re-election, not more than twenty-four years, nor more than twelve years consecutive. The Governing executive of the State, in the event of a vacancy of office, shall appoint a Senator to the remainder of the current term. A Senator elected and served from a State, shall not be elected or appointed a Senator by any other of the several States. The State legislature shall provision the official staff of each Senator of the State; and by a three/fourths vote, may censure, though not remove, a named Senator by issuing a recall Writ of Election.

The Congress shall Regular session at least once per year to commence the second Monday of January, no less than sixty days, nor more than ninety-nine days; excluding Saturdays, Sundays, and Holidays. However, the President, or the Speaker of the House, or the Spox of a State, may call a Special or Joint session, or committees of either House may convene to conduct hearing and inquest, or Congress may assemble should imminent danger to the Union, or to any of the several States, will not admit of delay. Upon certification of election, each Elected shall be sworn or affirmed to office and assume their place. The members of the House of Representatives shall number no more than three times the number of members to the Senate. A majority of all Representatives, including one from each State, shall be present to constitute a Quorum to do business. A majority of all Senators, including one from each State, shall be present to constitute a Quorum to do business.

Upon each century, in the fifteenth, the thirty-seventh, the sixty-third, and the eighty-seventh years, betwixt assembly the second Monday of May, until permanent adjournment not later than September 17, a Federal session shall be convened. This Federal session shall be composed of five members from each of the several states. The State legislature shall select not less than twelve worthy and able citizens, specific to this purpose, from which three shall be elected by the People of the state. Each shall Not presently be an employ of the Federal government, though each shall have once served as Juror, and each shall have attained the age of twenty-one years and seven years a citizen of the Republic, and of the State whereof _he shall be chosen. And the Spox, and one Senator; both these officers shall have resigned from any other office under this Constitution before election to the current Term of the Congress and into the Federal Session. Upon convening, each member shall be sworn or affirmed, and shall have one vote as delegate of the State, and each State delegation shall have one vote. The presence of sixteen/twenty-fifths of all delegates inclusive of three delegates of each State shall be a quorum to do business. The Federal session shall be empowered to propose and submit to the legislatures of the several States, upon the approval of three fifths of the States delegations; such Constitutional Amendments for ratification by the State legislatures as is provided in Article V of this Constitution, which shall be in accordance with petitions for the redress of grievances, pursuant to Amendment I of this Constitution.

And the Federal session shall be empowered to review the Constitutionality, of all Laws, Resolves, Treaties, and other Acts which shall have been approved by Congress, or ratified by the Senate; and signed to Law by the President; also all Executive Orders, Rules, and Regulations, having the force of Law pursuant to those Acts; also all Judicial Reviews, Adjudications, Appeals, and Opinions of the Supreme Court or of the inferior courts of the United States appertaining to all those Acts, whether past or present. And by majority simple and ten percent of the all members of the Whole House of the Federal Session, to void or nullify any of those Acts, or approve resolutions of Bills, to introduce correctional Statute legislation, in next Regular session of the Senate and of the House of Representatives for requisite approval or disapproval. This session, may adjourn for any exigency, or for Congress to meet in Joint session, or separately in Regular session.

Having spent five years in the U.S. Army, I took an oath to defend the Constitution of the United States against all enemies, foreign and domestic. Although my active duty was limited to five years, I'm a firm believer that an oath is for a life time. I, therefore, continue to see it as my duty to defend the Constitution (against ALL enemies, foreign and DOMESTIC); as such, I also see it as my duty to ensure that others, who have taken the same oath, adhere to that oath - for them to do otherwise would, by definition, make them "enemies of the U.S. Constitution" - as previously stated, I have taken an oath to defend against the same. Support of this Civil Action represents a first line of defense against a potential domestic enemy.

Good luck with your fiduciary action, from what I have been reading there is a lot of malfeasance in public office.

It is so obvious that an oath is pointless unless enforced, proving the breach , good luck.

Insofar as your constitution is concerned, being erroneously called 'a living constitution' , which is obviously a socialist construct like a living will, which some jumped up 'piece of work' thinks they can change to suit themselves.

I would have thought that the premise should be 'living by the constitution' [that great product of the enlightenment]. America has lived by it.

Upon entering the United States Army many years ago, I too swore an oath to protect and defend the US Constitution and the laws of the United States against all foes, foreign and domestic. I served to the best of my ability and was honorably discharged, as a Sergeant. I have never taken any oath lightly!

However in executing this oath and completing my service, according to our president, I am a terrorist”! How does one act upon that oath now? It is not difficult to identify the greatest threat to our national security, our liberties and to the United States Constitution, as the worst foe in our history.

It is of course, the "leadership" of our country. They have put themselves above the law. Therefore, they are untouchable through any means, other than the polls! There are so many voting government “parasites”, that this is becoming an almost impossible route to improvement.

Voting for the “conservative” candidates has not been enough to insure my oath is being faithfully executed, or honored. The parties are not offering much for candidates. This does absolutely nothing to preserve our constitution. Unfortunately, nothing short of “an act of God”, a terrorist attack on the congress and the current "leadership", or civil unrest and bloodshed, is going to change anything.

Since congress and "leadership" have abused their power and stolen our future, they should pay for it by altering their "royal" status to that of regular citizens! They should earn normal salaries for their time and efforts, and then put on social security, with some form of health insurance and retirement, comparable to non-government employment!

Lobbyists should be outlawed! Politicians, who accept and corporations, that offer large political contributions should be tried for felony bribery and if convicted, sentenced to a minimum of 25 years in prison, and then a $250,000.00 fine. If politicians want the job, let them seek support from their constituents through small contributions.

This country is hated all over the world. Therefore, the US should withdraw from the UN and NATO. We should stop all foreign aid, and then win the wars currently being waged by military means. We should withdraw our troops to protect our own borders.

We can balance the budget in a matter of a very few years, by deporting all aliens here illegally and taking care of our own, by means of laws and programs that are constitutional!

The government would shrink to take care only of its constitutional obligations, not exceed its authority and allow the free market operate, without liberal social democratic hindrances. The government agencies should reduce in size or be abolished altogether.

The borders are already established and laws are in place to protect them. Enforce them and send all people, who do not legally, where they belong. We cannot support the world any longer!

Enacting some of all of these concepts would save trillions of taxpayer dollars in no time. We are a country of laws and we should get back to that business.

We served our country for 34 years, taking the Oath, to uphold the Constitution, We do not believe that our Fore fathers had any intention to make it a tool for Lawyers to ask us Citizens to pay them, for keeping the Constitution in tact and uphold it, making and using the constitution as a tool to make them rich and then glorifying them selfs for having done so.

Enough is enough, where is our Justice department, they are not doing anything to uphold their Oath, certainly not by sitting on the Bench and doing nothing.

Today it really upsets me to see the Politions and Judges change whatever part "THEY" feel is not to "THEIR" personal our their parties best interests for what they want to accomplish is disgusting. They should ALL be held accountable for and prosicuted for attempting to diminish or destroy the Rule of Law and rights of the people AS WRITTEN in the Constitution. JHS.

I too took the oath forty eight years ago. I am still being paid by the government, and therefore that oath is still in effect. All retired military in this country are still bound by that oath. One of the problems in Congress is that so few men now are veterans or have served in the military forces. I hold myself accountable to that oath and consider it each time I vote. I further hold accountable each person who is elected to Federal office.

There are many items in the Constitution that could be construed in many different manners. Therefore, a definition of each term needs to be obtained. You and I may agree that a phrase has a certain meaning, however, many people wishing to ignore that item will see it differently. President Clinton had the word "is" having a lack of definition. If that is true, how can you proceed. I have rewritten the Constitution in an attempt to place language that is simple to define and clear as to intent. This is what is needed in my opinion.

Yes, I took a very similar oath when I was commissioned as an officer in the United States Air Force. I took it seriously, as did my father, father-in-law, several uncles, my spouse, and several nephews (one of whom has earned FOUR Bronze Stars). I was appalled when Clinton got away with actions that would get any military officer cashiered. Never thought I would see the day when Clinton looked good to me. The sad thing is that Obama told us that the words in the oath were not important to him.. He told us exactly what his values and priorities are - not just on the campaign trail, but in his first book, "Dreams from my Father". I am scared for my college - aged kids!!

More than 40 years ago I took an oath to uphold the Constitution & this nation against ALL enemies foreign & domestic. A little over 20 years ago I retired from the military service, but I never forgot my oath of allegiance. I still hold this nation and that oath dear to my heart. Consequently, I have compiled a small arsenal along with ammunition to actively defend our nation.

For 20 years I fought for the sanctity of this nation - decrying any insurgency against our national personnel. Never would I have ever called for any attack against our nation, our representatives, or our government; however, I fear that this administration has failed to live up the oaths that they took upon accepting the position that they hold. Consequently, I am ready to join 'We the People' who are close to requiring a second Constitution referendum that will require active support to regain our freedoms & laws upon which this nation was founded.

I have the greatest respect for the Patriot Post and what it has done for this country since its inception. However, the greatest violation of our Constitution in the history of our country has been perpetrated by Barack Obama because he is not "natural born" (since his father was admittedly a British subject, he has been a dual citizen of Great Britain and the U.S. since birth).

Every member of Congress and every judge knows this is true because the Democratic Senate required a resolution to be passed saying that he was "natural born". In essence, each of them are violating their oaths of office by not having him prosecuted.

The absolutely most important and helpful thing that could be for our country would be for Rep. Issa to launch an investigation into Obama's being "natural born" (he promised to investigate eligibility during his campaign last fall, but, of course, has not done it. Boehner has completely rolled over on the subject. If every member of the Patriot Post would write, call or fax their Congressman incessantly, starting tomorrow, as well as Issa and Boehner, we could force an investigation.

From the that a charge of "quo Warranto" could be brought against Obama and he would be invalidated at President. Think about it ! Everything he has signed (including ObamaCare) and every appointment he has made (including two Supreme Court Justices) would be invalid. Is there a more important thing we could do now? Think of what good it would do for the country immediately. I plead and urge everyone to take up this issue and fax, call and write Congress until they follow their oaths and force an investigation. Let us take our country back now, before any more damage is done to our great country by this usurper (a legal term for somwone holding office illegally). It seems as though there are items in the Constitution that could be taken differently by different people so perhaps taking an oath could conceiveably be interpreted however the individual wants. Perhaps a more distinct definition of each term needs to be done, in otherwords re-word those items clearly so that there can be no misinterpretation of intention.

I most definately support upholding their sworn oath to protect, defend and abide the intentions of the Constitution and not ignore their accountability to do that.

Although I fully support the rule of law, and the primacy of our Constitution, I'm afraid that the breach oath suit will be useless (but give it a try anyway). The problem is not that the oath "to defend, etc.) is being broken, the problem is that the concept of the "living Constitution" (started by a Chief Justice, was it Marshall?, nearly 200 years ago) has become general.

I am a believer in original intent, and in interpreting the wording in the context of the vocabulary of the time. A state at that time was not a form of province of a nation, it was a sovereign entity. The United States, as a nomenclature, was not a nation - it was a voluntary Federation of sovereign states who gave certain powers to the Federal government.

I realize that the above is a tautology to us, but the erosion of that concept over 200 odd years has given us the "living Constitutions" as a fact in being. The oath would not be breached by those who subscribe to that concept. What we need is a movement to re-establish the original intent of the Constitution.

However, the constitution is a CONTRACT between the several states (as representing We the People) to create the Federal Government and grant to it limited powers. Contracts can only be changed when all parties agree to those changes in writing (amendments) and not because "the times they are a'changing."

As a boy, I was taught that an OATH is a solemn promise to GOD and is to be taken very seriously.In the "old days" one would put a hand on the Bible and proclaim "So help me God".

Of course, to be PC today, this is rarely done any more. I suspect that it has been virtually eliminated in order to ease one's conscience rather than the old "separation of church and state" mantra.

I took the oath a third and last time when I was sworn in as a Regular Army offier. That oath was a solemn obligation which should be no less an obligation on our elected and appointed officials. I have never taken an oath of public office, but I do believe that those who do should be required to live up to it. An oath is an affirmation of intent to live up to some guideline or set of guidelines. In this country, too many people do not take an oath seriously, they hold to it only so long as it is convenient and then forget it the moment it becomes inconvenient. Those who will not honor a marriage vow, for example, will not honor any other vows. We need to know about our elected officials and their past so we can judge whether they will hold to the expectations we have for them. Those who do not honor their vows should be punished for it. If an elected official breaks the law, he or she should be punished just like anyone else would who did the same thing, not be overlooked because of their office.

They should also be sued for creating an elite group or specialty group who do not have to abide by the laws that they pass, including not having to be in the social security pool and not being forced to be a part of Obamacare like the rest of the citizens are being required to do. Many of today's politicians go through the act of pledging without the intention to perform. They think the oath is just words with no real, serious meaning to them. I took the oath when I enlisted in the U.S. Army. I was honorably discharged from "active duty" but not from my oath.

I stand ready to honor my oath in what ever manner it becomes necessary.

I invested over twenty-six years on active duty in the United States Air Force protecting the Constitution of the United States and am proud to have served. One day while severing in Korea, a young South Korean youth approached and asked this question; " Sir, what is the difference between Liberty and Freedom?" I was a bit perplexed. I had never tried to articulate the difference in definition." Freedom is exrmption from external control, while Liberty in freedom from arbitrary or despotic government or control."

What has happened to our freedom and liberty? We have a despotic government attempting to exert control in every facet of our lives. Who's to blame? Us, we have either ignored this insideious movement or we have not shown the "true grit" of those who stould their ground before us; from the patriots of 1776, throughout history to the present.

When Americans again understand the organic (original) US Constitution, then they can begin to understand why it does not apply, in law, to them as; "citizens of the United States" (federal government).

Does not apply? Hasn't it been, isn't it, obvious?

n. person who by place of birth, nationality of one or both parents, or by going through the naturalization process has sworn loyalty to a nation. The United States has traditionally taken the position that an American citizen is subject to losing his/her citizenship if he/she commits acts showing loyalty to another country, including serving in armed forces potentially unfriendly to the United States, or voting in a foreign country. However, if the foreign nation recognizes dual citizenship (Canada, Israel, and Ireland are common examples) the U.S. will overlook this duality of nationalities.

Since when were citizens of the original republics loyal to the government, nation, or State "United States", citizens of the US federal government?

They were NOT, prior to the 14th Amendment, the "Reconstruction", The War Between the States.

The several separate and independent sovereign republic nation States created the federal government.

The people of the several separate and independent sovereign republic nation States where not citizens of the newly created federal government.

They were not "subject to the jurisdiction thereof" of the newly created federal government.

The people were protected, in law, from the newly created federal government by their separate and independent republic nation State government constitutions. They were not "one nation", "indivisible" prior to the so-called "Civil War". Are nations that are forced into a federation free? Do not overlook the obvious.

That all changed with the so-called "Civil War" and the 14th Amendment.

Prior to this, the people were citizens, with loyalty to their several separate and independent sovereign republic nation State's governments. Not the federal government.

In law, that makes all the difference.

Once Americans became "citizens of the United States" (federal government) they no longer had lawful protection ("standing" in law) by the Republic's constitutions.

They then did become unconstitutionally "one nation", "indivisible." Isn't it obvious?

How is it that so many can be so emotional over "The Pledge of Allegiance" that was written by socialist Francis Bellamy?

Difficult concepts to comprehend after a lifetime of indoctrination, I know.

The victors write the history, and the victors of the so-called "Civil War" have been writing the history.

But check our premises we must.

Don't overlook the obvious.

While the sentiment is nice, this is a waste of time and money for several reasons. One, any case brought is likely to be thrown out because of standing--the court will say there is no specific harm to specific people. If you get past that, they will say these are political issues, and you have the option to vote these people out. You can say "we reject" that we have representation, but saying it is not a legal argument, and the fact is, you can vote out people who don't uphold their oaths. Third, there is a lot of room for interpretation of whether someone has broken a Constitutional oath, thanks to broad interpretations by the courts among other reasons.

But the biggest block to this, even if you could get it to trial, is the voting records of conservatives. There is a long line of GOP candidates like Bush, Dole, Bush, and McCain who have run on platforms that violated the Constitution, and in the cases of the Bushes, they ran for 2nd terms with a clear record of having broken their oaths, and CONSERVATIVES SUPPORTED THEM while ignoring candidates who promised to uphold their oaths. I know all the arguments for choosing the lesser of two evils, pragmatism over principle, etc. But if there is a supposed large number of people who are concerned about this, then why did they not get behind Constitutional candidates? Almost any conservative that is party to this suit could be called to the stand and shown to have actively supported these oath-breakers, and be laughed out of court.

Most conservatives vote for oath breakers out of fear and refusal to believe doing what is right in God's eyes comes first. They vote for known oath-breakers, and they have gotten leaders who break oaths in spades--just not the oath-breakers they wanted. Well, if you vote for an oath-breaker, you deserve whatever you get.

This is awesome. But disgusting that it is necessary.

When elected officials use the "promote the general welfare" line to justify anything on their perverse agendas, we have a problem. When elected officials reject the OBVIOUS sound concept and innocent gesture of reciting the constitution in session, we have a problem. When elected officials refuse to cite the constitutional authority under which they propose a piece of legislation, we have a problem. We indeed have a major problem.

We have a battle between corporate America and the government, with the people and charitable organizations caught in the middle. Government has become the focus, not the tool or servant organization it was created to be. Government leaders pretend to be serving our interests, but it is truly not our interests being served: The focus is on the needs of the government, not the needs of the people.

President Obama and elected officials speak of making "investments", but this is just disguising the truth: They are picking your pockets to pay for their own re-election.

The current jobs bill is a total farse and class warfare designed to gain political points for the President and the democratic party. The jobs are short term, if any will in fact be "created". Once the money runs out, the government will use it as another crisis and continue to soak industrious workers for more taxes to pay for an extension of temporary jobs and/or unemployment. This is akin to "giving a man a fish" instead of teaching him to fish. No long term solution is created.

The Republicans have it correct: Businesses will not invest in long term capital projects or new jobs in a chaotic environment, and the government is the problem.

I also love the rhetoric and class warfare. I am not rich, but I do pay taxes. I would love for the people who currently pay no taxes to pay taxes in exchange for the privilege of voting and also to pass a basic civics class on the constitution.

In 1975 I joined the National Guard. I took an oath then to support and defend the Constitution of the United States against all enemies, foreign and domestic.

Even though I am no longer a Guardsman, the oath I took is still in force today. I consider it an honor to have taken it.

I, too, like so many others who have posted responses in this forum, have taken the Oath to, "support and defend the Constitution of the United States against all enemies, foreign and domestic." I do not believe that turning to the courts like a liberal to solve what is essentially a moral problem is the answer. Eventually the liberals will triumph. Any victory will be temporary, at best. What we need is a great revival of faith, morality, integrity, duty, honor, courage, and patriotism in this country. This can only come about by each one of us refuting every liberal lie we hear EVERY TIME and by telling all who will listen about the greatness of the United States. It is difficult sometimes. I take courses at the local community college. I have been mocked by students less than half my age as well as professors for espousing conservativism. But, I have also made converts and have at least convinced some young people to take a more objective look at what politicians, newscasters, and yes, their professors, have to say. This is how we will win, not by running to the courts like whiny, liberal, pantywaists.

Congress has failed to uphold their oath of office and should be removed from office in accordance with Sections 3 and 4 of the 14th Amendment. It's clear that many members of the House and Senate have not only rebelled against the Constitution, but they have given aid or comfort to the enemies of the Constitution. This includes a large number of Federal employees who shouldbe held accoutnable as well.

It does my heart good to see so many of you awake and involved! I was involved in this battle long over a decade ago and if you google my name you can see the book I wrote about our current criminal government!

There is not a single court of competent jurisdiction left in this country administered by a member of the judiciary! Members of the bar have violated seperation of powers doctrine and taken over all three branches! They have declared themselves immune in a nation where the only immunity was established as the rights of the People! The cure will most likely be the same one spoken of in the faretta supra concerning the former solicitors of the crown!

That being said, petition is not working, I have done so and been surrounded in court by armed deputies not to arrest me for wrong doing, but to prevent my delivery of process to an imposter judge!

If we are to proceed agsinst this entrenched mob, we must follow the examples of the founders and do so by Declaration of law! Begging for petition by one of the mob cannot work as he violated the oath he took as well! The entire point of securing a jury trial was to strip the black robed bandits of their ability to corrupt all things with the flick of a pen and put the rule of law into the hands of those who are the law, "The People"!

Judges dont interpret the Constitution, We do! Yes you and I are the ones who shall dictate to our civil servants what the law is by declaration!

In United States v. Sprague, 282 U. S. 716, 731, 75 L. Ed. 640, 51 S. Ct. 220, 71 A. L. R. 1381, the court said:

"The Constitution was written to be understood by the voters;

its words and phrases were used in their normal and ordinary as distinguished from technical meaning; where the intention is clear there is no room for construction and no excuse for interpolation or addition."

Violating the oath is perjury, taking the oath without the intent to keep it is fraud! Calling them on it as it occurs is JUSTICE! Failing to do so will maintain the criminal mob and their racket of JUSTUS!

I think this objective here is a good idea, if nothing else, to determine whether Americans do or do not have "standing" in law on constitutional issues. Although I must admit, I believe that has already been established in other constitutional issue cases already.

I'm of the opinion that in law, citizenship and nationality is a major, yet overlooked factor with regard to constitutional issues. And since citizenship for the most part, is a voluntary condition, one cannot claim that he has been "harmed" by the government one is a citizen to if one has "consented" to that government.

Specifically, the people of the original Republics were not "citizens of the United States" (federal government), and had constitutional protections with citizenship to their respective Republic. Once a federal citizen, by tacit consent, one is "subject to the jurisdiction thereof" of the federal government. Unprecedented prior to the 14th Amendment. Therein is why Americans who are 14th Amendment federal citizens, subjects of the federal government, have no constitutional protection, "no standing" in law on constitutional issues.

"These three kinds of law of nations, the voluntary, the conventional, and the customary, together constitute the positive law of nations. This is the nature of federal citizenship under the Fourteenth Amendment as stated by the Supreme Court of the United States: “It is the natural consequence of a citizenship [92 U.S. 542, 551] which owes allegiance to two sovereignties, and claims protection from both. The citizen cannot complain, because he has voluntarily submitted himself to such a form of government. He owes allegiance to the two departments, so to speak, and within their respective spheres must pay the penalties which each exacts for disobedience to its laws.” U.S. v. Cruikshank, 92 U.S. 542 (1875)

"The federal citizen cannot complain, because he has voluntarily submitted himself to such a form of government", in defiance of his Republic.

With regard to one's Oath to protect and defend the Constitution; isn't one already in defiance of the Constitution by being a federal citizen in the first place, all considered?

My explanation of the conspiracy:

I've tried to boil it down to simplify explaining it to this; It's a matter of citizenship and nationality in law. If you were a French citizen say, you'd be subject to the French government. Same for German, Spanish, South African, Argentina, etc., you get the idea. A citizen is a subject to a specific government. No different for a US citizen. (If you've noticed, they're attempting to establish a federal or European Union citizenship in Europe. That's the New World Order, it was started in the New World, America.)

However it gets confusing on this, the US part. Originally a Citizen of one of the separate republic nations was considered a uS Citizen after the formation of the confederation of united States was instituted. The government of the confederation of separate nation States, the federal government, was not a nation in law. The separate republics remained separate and independent sovereign nations in law after the confederation of nations or States. The people remained Citizens of their respective republic. Much like the people of EU countries still are.

That all changed following the conquering of the southern States (actually all the States) by the so-called federal government in the so-called "Civil War." It was not a civil war by definition, as the States were, and are, in fact separate nations in law. Calling it the Civil War is propaganda and part of the conspiracy.

If you think about it; the confederation (the US Constitution, US Congress, US President) would have dissolved once the southern States seceded as it was a voluntary union. Lincoln and the mainly republican Congress went rouge and committed a coup, forcing States back into the then involuntary Union or federation. Not a confederation or voluntary Union anymore. The federal government has been a criminal enterprise ever since. Except in law, "Might is Right", under certain circumstances. The federal government was "reconstructed" as the organic or original US Constitution was superseded (essentially re-written) by all Amendments following the first ten.

Following the 14th Amendment, citizen of the United States means citizen of the federal government, or federal citizenship. US nationality. No longer citizen and national of ones respective republic nation. It's claimed to be "dual citizenship", but one can only be loyal or a subject to one, and federal is now primary. Major upset under the law, but most don't realize.

Along with that, the political system of now federal citizens is a national democracy. Due to the change of citizenship of most all Americans, from respective State republic, to unconstitutional (de facto) federal.

Most Americans (for several generations) are federal citizens and have absolutely no idea of what that means under the law, because they don't understand the original republic. Thanks to federalized (national monopoly) education following the so-called "Civil War." The victors write the history, and control the education. As well as the media. After that war, the "Reconstruction" has been done gradually so as not to awaken the masses. And seems to be in the final phase of which all other democracies in history have succumbed, totalitarian government or dictatorship. The organic US Constitution has been defunct for 143 years. None of us can say we have not observed that to be true. So it's not even possible to restore the republic by participation in THEIR political system. A political system that was designed to destroy the republic in the first place.

PAC believes the organic US Constitution, and the several but separate republics and their constitutions still exist in law because they were not repealed. They are merely vacant as all Americans are federal citizens now, and have been for 143 years.

I highly recommend reading LB Bork's "The Red Amendment". He's not the only one to do research and write on the topic, but his book really pulled all the puzzle pieces together for me. It took me about 6 moths to get through it to where I understood it. www.pacinlaw.org

A simple examination of the oath of office laws shows it is a criminal offense to violate oath of office, not a civil offense. The courts will therefore reject this not because it is wrong but because it is not a criminal complaint. Moreover, the suit does not describe any actual violation of oath of office. There has been such a violation, the refusal of Congress to call an Article V Convention. As shown at www.foavc.org 49 states have submitted over 700 applications for a convention call. The Constitution requires a call when 34 states submit 34 applications.

You will also read at the site about the two federal lawsuits filed regarding this fact. In the second lawsuit the government admitted it was a criminal violation of law, that is, violation of oath of office, not to call.

In July, 2011 based on these facts, a criminal complaint of violation of oath of office was filed with the U.S. Attorney in Georgia. That complaint has already passed review regarding validity by the government and is currently awaiting disposition in Washington DC. Within a few weeks this issue will be known and obviously will resolve this meaningless civil suit before it is even filed.

I took an oath as a military member and I understand the constitution is written in stone and is not a living document as the liberal judges believe. Not only have our federal representitives abandonded the constitution but half of the supreme court judges think it is OK to use internationl law to make rulings that for our nation. They have lost their moral(christian) compas and by so doing have become both despots and models for the liberal lower courts to ignore the constitution. Our elected officals in Cal. have no knowlege of the constitution as their most recent law passed making it illegal to carry an unloaded gun in public and even transporting it thru a school zone can result in 5 yrs prison time. So much for the 2nd amendment!
