The Department of Education (DOE) has officially rescinded a Biden administration regulation that widened sex discrimination to include gender-confused men in women’s sports.
According to a DOE statement:
Since the first days of the Administration, President Trump and [Education] Secretary [Linda] McMahon have abided by the original promise and purpose of Title IX: to protect women’s safety, dignity, and educational opportunities in schools that receive federal funding. Just 11 days into President Trump’s second term, following two federal courts unequivocally invalidating the Biden Administration’s 2024 rule, the Department announced it would enforce the 2020 Title IX regulations.
The Biden Administration’s illegal regulations were enjoined by eight different courts and later vacated by two separate courts. After years of legal challenges to the Biden Administration’s rule, federal courts dismissed all remaining litigation concerning the Biden-era regulations last month. This cleared the way for the Trump Administration to issue today’s final regulation restoring the previous regulatory text.
To be clear, lawmakers in Congress enacted Title IX — that is the legislative branch’s job. The executive branch’s job is to enforce the law, and the judicial branch’s job is to interpret the law. Where Team Biden erred (beyond the obvious injustice of allowing men to compete in women’s sports to further the Left’s agenda) was in illegally rewriting the law by changing the interpretation of “sex” to mean “gender identity.”
If so-called “women’s sports protections” include shielding anyone who claims to be a woman, then that’s not protection at all. Such a regulation not only takes academic and athletic scholarships away from women, but it gives gender-confused men (and male predators) access to women’s housing, locker rooms, and dressing rooms — spaces where women are already most vulnerable.
You’d think the feminists on the Left would have been up in arms over this, but no. They not only cheer for the mentally ill/predatory men but also call the women raising reasonable concerns bigots.
Thank goodness that two federal courts vacated Biden’s regulation and that Trump’s DOE formally expunged it before any more damage could be done. This is an unmitigated victory for women and girls.
But it’s not even the best part.
The DOE has created a Title IX Special Investigations Team in order to ensure that colleges reform their standards if they followed Biden’s illegal rewrite. Sports will once again be sex-segregated, as will locker rooms and dorm assignments.
Unfortunately, this comes too late for Riley Gaines and other swimmers who lost medals to men. However, it does ensure a brighter future for K-12 and collegiate female athletes who are coming up through the ranks — thanks in large part to Gaines’s activism.
Also unfortunate is the fight professional athletes still must have against the bitter horde that is content with using women’s livelihoods as a way to give gender-confused men and predators a platform. Remember, almost 2,300 medals have been stolen from women here in the U.S.
Over the summer, WNBA player Sophie Cunningham said she merely wants “to protect young girls in a locker room, or young girls in sport who shouldn’t have to go against biological men,” and yet she has faced the wrath of fellow players, feminist coaches, and activist fans. It’s a whole lot of ugly coming from a never-ending line of stupid, to paraphrase Motormouth Maybelle from the musical “Hairspray.”
The issue of sports integrity will not be settled until all women athletes, including at the professional level, have recourse, protection, and guaranteed fair play. Nevertheless, the DOE’s new Title IX enforcement is more than just a chink in the gender ideology armor — it’s a flood of protection and a huge win for women everywhere. Good job, President Trump and Secretary McMahon.
