Good News: Detransitioner Wins Big Malpractice Suit
The first of probably many lawsuits has just been won in favor of a detransitioner who was a child when she was butchered.
Detransitioners are a growing group of individuals who regret their decision to identify as “transgender.” They also deeply regret the medical procedures they were talked into getting, such as puberty blockers, cross-sex hormones, and even bodily mutilation surgery.
By the time most detransitioners began to realize that doctors were using their mental illness as a way to experiment on them, the statute of limitations had passed and there was no recourse. For the first time, though, a detransitioner has been able to pursue her case, see it through, and walk away with millions in restitution.
Fox Varian was a young girl of 16 when she was convinced that cutting off her healthy breasts would make her look more like a boy and, in fact, feel more boy-like. This was in 2019. By 2022, Varian had detransitioned, and in 2023 she filed a malpractice lawsuit against the medical professionals who persuaded her that bodily mutilation surgery was a reasonable procedure to placate her gender confusion.
Psychologist Kenneth Einhorn and surgeon Simon Chin were the medical professionals advising Varian as a teenage girl. Their motivation seemingly revolved around concern that she would commit suicide if bodily mutilation surgery wasn’t performed. The fear was great enough that Varian’s mother, even though it was against her better judgment, consented to the surgery.
Einhorn was a driving force behind the pressure for Varian to get a double mastectomy.
Last week, a jury found that Einhorn and Chin were liable for medical malpractice because they did not do their due diligence and take appropriate steps before suggesting bodily mutilation as a solution. For example, they did not check to see if Varian suffered from mental comorbidities/root causes such as ADHD, autism, body dysmorphia, trauma, sexual abuse, or other emotional distresses that could have been treated before lopping off her healthy breasts.
The moral and ethical aspects of surgery were not on trial, but rather whether the doctors did their due diligence before performing a life-altering surgery. This really is a shame because it doesn’t really address the fact that medical professionals should not be allowed to perform surgeries on psychologically disturbed individuals, particularly minors, under the false promise that these surgeries will change biological reality.
“The courts should be finding that this kind of surgery is inherently illegal,” Twitchy commentator Aaron Walker opined. “Naturally parents should be able to consent to even sterilizing surgery when it is based on medical (not psychological) necessity. So, for instance, if a thirteen-year-old girl has ovarian cancer and sterilizing surgery is the best way to remove the cancer… it would be heartbreaking, but her parents should be able to consent to that. But essentially cosmetic surgery because she subjectively believes she is a boy should not be allowed.”
Varian was awarded $1.6 million for pain and suffering and $400,000 for future medical expenses.
There are 28 other medical malpractice lawsuits from detransitioners on the horizon. The fact that Varian won hers is a victory that hopefully others can build upon. Perhaps even some will be able to claim consumer fraud, being mentally unable to give informed consent, etc.
The World Professional Association for Transgender Health (WPATH) itself should be facing serious malpractice suits from medical professionals who relied on its definition of “best practices” when treating gender-confused patients.
The responses to Fox Varian’s legal victory were great. Robby Starbuck, a conservative activist, posted: “In coming years the floodgates will open as more go to trial. What was done to these kids is a crime against humanity. An unforgivable evil that must be extinguished from the earth. Never again. The damage these kids carry is heartbreaking.”
Hopefully, this is the beginning of the end for transgenderism madness, particularly where it concerns children. “Gender-affirming care” has ruined lives, broken families, and irreparably harmed children both physically and mentally. Detransitioners are the key to bringing down this entire corrupt ideology.
