What Is Election Day?

If there are no consequences and ramifications for the behavior we just witnessed in California, our electoral processes will be degraded.

Once again, that uber-leftist state of California is fully displaying a new and different definition of “election day.” One would tend to believe that the very words would offer a sense of finality to an election, a campaign for a particular political office. Sadly, we witness, yet again, that it appears to the Marxist leftists as the quote attributed to Josef Stalin says, “Those who cast the vote decide nothing. Those who count the vote decide everything.”

Imagine being a voter in California, truly any leftist state, and you cast your vote early or on election day, but the results take a week, or longer, well, until those counting decide that they get the outcome they desire. This is why I coined the phrase “the margin of cheating.” One must win beyond the margin of cheating, limits of rigging, to make it far more difficult for the forces of leftism to succeed. We first saw this in the Minnesota Senate election between Republican Norm Coleman and challenger Al Franken, a pathetic comedian. Things kept going past election day as more and more ballots for Franken kept appearing in the strangest of places.

I have my very own experience with said voter fraud issues during my reelection race in 2012 against Patrick Murphy. Somehow, in St. Lucie County, there were polling locations reporting a greater than 100% turnout. As well, somehow, after midnight, a switch was flipped, and I went from being up by a certain number of votes to being down by almost the same number of votes. Not to mention, St. Lucie County Election Supervisor Gertrude Walker was seen after hours at the ballot location.

Federal law establishes a uniform Election Day for federal offices in order to promote finality, public confidence, and administrable election rules. See 2 U.S.C. §§1, 7; 3 U.S.C. §1. That uniformity is undermined when states extend ballot receipt beyond Election Day, effectively prolonging federal elections after voting has concluded. Of course, there will be those who say, well, Colonel, the recent elections in California were not federal, pardon, yes, you had congressional races in that primary, along with state and local, mayoral. When the left goes down this path, there is no greater evidence of voter disenfranchisement than this.

And this is why the American Constitutional Rights Union has joined the Public Interest Legal Foundation in filing an amicus brief in support of a case before the U.S. Supreme Court concerning the definition of election day. This is a critical issue, especially in a time when leftists are always crowing about “threats to democracy.” Here are some examples of Marxist leftists’ threats to our representative democracy:

  • Counting illegal immigrants in our census.
  • Advocating for illegal immigrants to vote in our elections.
  • Unsolicited mail-in ballots, the process of mailing out ballots to addresses where there has not been voter roll auditing. Absentee ballots require a request and signature verification.
  • No support for the SAVE America Act, which requires a picture ID for voter registration and voting.

If I had a say, we would have only two ways of voting in America: absentee and in person. And with in-person voting, the early voting period would be limited to just ten days before the election, not the absurdity of a month or two before. We should end these insidious leftist practices of ballot drop boxes and ballot harvesting, unless you see votes as a crop.

As well, we must follow the law when it comes to mailing our absentee ballots for our military. Too often these ballots are not mailed on time, and there should be harsh criminal penalties to those who do not. One of the arguments about “extending” election day is to ensure military ballots are returned and counted. Back in my day in the military, one of the additional duties you could have as a young Second Lieutenant, Ensign in the Naval forces, is Voting Officer. It was your duty to track those members in your unit who would need to submit a request for a ballot. As well, you had to brief the entire unit, company/battery level, 100-200 troops, about upcoming election cycles and timelines. When I was in Congress, I served on the House Armed Services Committee’s Subcommittee on Military Personnel. Rep. Joe Wilson was the Chairman. We heavily focused on the Uniformed and Overseas Citizens Absentee Voting Act (UOCAVA), which requires a ballot to be issued 45 days before the election. This must be enforced, and no, the SAVE America Act does not jeopardize UOCAVA. What jeopardizes UOCAVA is the willful and intentional nefarious actions of election supervisors who wish to disenfranchise our uniformed service men and women, yet they would allow illegal immigrants to vote.

This recent election in California should be an embarrassment. It is not, because it is about controlling the results. Florida was once embarrassed by the whole “hanging chad” episode. Now the Sunshine State is a model for election integrity and efficiency. If there are no consequences and ramifications for the behavior we just witnessed in California, our electoral processes will be degraded. Marxists believe in the ideal that “the ends justify the means” and their insatiable hunger for power and control leads them to the other ideal, “by any means necessary.”
