Filed: Department of Justice Criminal Complaint Against Rep. Nancy Pelosi
This complaint includes clear and indisputable evidence of Rep. Nancy Pelosi willfully violating federal law.
To the Honorable William Pelham Barr, United States Attorney General, and to the Office of the Inspector General, U.S. Department of Justice:
At approximately 2220 hours on Tuesday, 04 February, 2020, I witnessed clear and indisputable evidence of Rep. Nancy Pelosi (D-CA), Speaker of the House, committing an act which I believe may brazenly and feloniously violate federal law – specifically 18 U.S.C. 2071 and the Presidential Records Act of 1978. Rep. Pelosi willfully mutilated the official signed State of the Union transcript prepared by the Executive Branch for the Legislative Branch. Her actions were witnessed by federal law-enforcement officials in the House chamber. This was also witnessed by members of her political caucus, with whom she likely colluded in premeditation of the commission of this offense. As evidence of this criminal complaint that Rep. For background:
According to 18 U.S.C. 2071: “Whoever, having the custody of any such record … willfully and unlawfully … mutilates, obliterates, falsifies, or destroys the same, shall be fined under this title or imprisoned not more than three years, or both; and shall forfeit [his or her] office and be disqualified from holding any office under the United States.” An exposition on the Presidential Records Act of 1978 is detailed here.
On the evening of Tuesday, 04 February, 2020, President Donald Trump clearly outlined, prior to Pelosi’s criminal action, that the State of the Union is strong. The success of this administration deeply concerns Rep. Pelosi and her U.S. Senate counterpart, Charles Schumer (D-NY), leaders of the Democrat Party, because the success of the Trump administration on behalf of the American people threatens their political influence.
As evidence of her malicious intent, Rep. Pelosi bookended the President’s speech with insults, deliberately omitting the traditional words of introduction, “Members of Congress, I have the high privilege and distinct honor of presenting to you the President of the United States,” and opting instead to state, “Members of Congress, the President of the United States.”
Once at the podium, President Trump personally delivered to Rep. Pelosi the official signed State of the Union transcript as prepared for the Congress.
During the President’s remarks, Rep. Pelosi scored cuts in the official transcript of the State of the Union, demonstrating premeditation in preparation for mutilating it at the conclusion of the speech. After the President completed his remarks, Rep. Pelosi committed an act that starkly demonstrated her cadre’s hatred of Mr. Trump and his grassroots American supporters, whom these partisans loathe.
At the conclusion of the President’s remarks, Rep. Pelosi took the official State of the Union transcript and, page-by-page, willfully mutilated that document. Rep. Pelosi maliciously obliterated what she called the “dirty” speech, later confessing: “I tore it up. I was trying to find one page with truth on it. I couldn’t. … It was necessary…to say this is not true. I felt very liberated last night.”
Notably, Rep. Pelosi’s offense also mutilates the names of those great Americans listed in the SOTU transcript, living and deceased, and the names of Americans in the gallery. In doing so, she libelously denigrated and defamed each of them personally by suggesting there was no truth to their life stories as represented in that transcript.
Regarding the legality of Rep. Pelosi’s act, President Trump declared: “It’s an official document. You’re not allowed. It’s illegal what she did. She broke the law.”
According to the White House media director, “The speech [Pelosi] ripped up was a one-of-a-kind record, signed by the President of the United States. It belonged to the American people.” That assessment was affirmed by House Minority Leader Kevin McCarthy (R-CA). Thus, this official signed transcript of the State of the Union speech qualifies as an official record under the Presidential Records Act of 1978.
Further, concurring with the opinion regarding Rep. Pelosi’s violation of 18 U.S.C. 2071, House Judiciary Committee member Matt Gaetz (R-FL) has filed an official complaint with the House Committee on Ethics, and noted: “There is no question that Speaker Pelosi ‘mutilated, obliterated, or destroyed’ the copy of the President’s address provided to her. The law does not allow the speaker of the House to destroy the records of the House, and the rules of the House do not permit [document destruction] because you don’t like what the president of the United States says.” (House Democrats have blocked a measure by Rep. Kay Granger (R-TX) to reprimand Rep. Pelosi for her conduct, on a party line vote of 224 to 193.)
In Rep. Pelosi’s relentless efforts to undermine President Trump and his administration, she has failed in her effort to establish Russia collusion in the 2016 election, and failed in her impeachment effort. Through both of these politically-motivated efforts, Rep. Pelosi has declared, “Nobody is above the law.”
In filing this complaint, I ask, “Is Rep. Pelosi above the law?”
The actions of Rep. Pelosi constitute a violation of 18 U.S.C. 2071 and the Presidential Records Act of 1978 – actions that were likely premeditated in collusion with co-conspirators within her caucus. The signed official State of the Union Address that Rep. Pelosi destroyed was property of the United States of America. Rep. Pelosi had no records-disposition order providing her with the specific authority to destroy that official government record.
I respectfully request a prompt reply from the Department of Justice concerning this criminal complaint and the legality of Rep. Pelosi’s actions, as well as of those who had prior knowledge of her actions.
