KBJ Doesn’t Understand or Practice Impartiality

Justice Ketanji Brown Jackson emphasized the importance of judges avoiding partiality, but choosing Michelle Obama’s podcast as her venue undermined that point.

Supreme Court Justice Ketanji Brown Jackson was a guest on Michelle Obama’s podcast this week, where she discussed the importance of impartiality. Remember, KBJ is so impartial she doesn’t even know what a woman is.

“There are lots of limits on what judges can do, and I try to be very, very mindful and scrupulous with respect to that because, as you say, our obligation is to be unbiased in our approach,” said Jackson. “And, so, you have to then navigate all the sources that could make for an appearance of partiality, which you want to avoid.”

Let me reiterate the key point here: Jackson said this on Michelle Obama’s podcast.

Titled “IMO” — short for “In My Opinion” — Obama’s podcast is a place where she espouses left-wing talking points with the supposed moral authority of having been the first lady, not a politician. Yet we all know that she was a key player as Barack Obama did more to divide our nation than any other president. The anti-American Democratic Socialists of America is partly rooted in the work the Obamas began in “fundamentally transforming the United States of America.”

His sanctimonious “right side of history” garbage was routine, but his wife is the one who said amid his meteoric rise, “For the first time in my adult lifetime, I am really proud of my country.”

Consider that Jackson appeared on this podcast after having signed the Supreme Court’s Code of Conduct governing actions that could be construed as partial. “A Justice should not participate in extrajudicial activities that … reflect adversely on the Justice’s impartiality,” it says.

It’s not necessarily a problem for Jackson to have a conversation with Mrs. Obama, especially given that they talked about topics other than politics. The real issue is that the two share a worldview that is anything but impartial.

Jackson is deservedly criticized for seeking fame in a Broadway play, attending the Grammys, and posing for a magazine cover over a caption that reads “the people’s champion.” She clearly thinks very highly of herself, as evidenced by how much she talks in oral arguments and how many dissents she reads from the bench. Her attention-seeking sometimes annoys even her fellow left-wing justices.

By an order of magnitude, however, the biggest problem with Jackson is the radical leftist ideology that informs her Court opinions.

Her blinders are so big and fixed that she is frequently rebuked by her fellow justices in their opinions. Jackson is not just coming to the wrong conclusions, her colleagues sometimes write, but she is espousing opinions that are completely at odds with our constitutional system. And she’s doing so because she’s a left-wing race-baiter. We have a growing list of articles about her problematic tenure on the Court.

To Michelle Obama, Justice Jackson articulately explained an important point: “We all have to believe that there is a judicial system that is going to be fair, that is going to be neutral — that when you bring your dispute to the court, that judge doesn’t have any preexisting stake in the particular issue, that they are listening to both sides and fairly reviewing the evidence and coming up with a decision that is a just one.”

She should win a Grammy for Lack of Self-Awareness for that one, though, because that is precisely the problem with her jurisprudence. Everyone knows who she wants to side with, and she’ll employ whatever logical and legal gymnastics are necessary to get there. She follows the Marxist oppressor/oppressed ethic to the “necessary” conclusion in her Court opinions.

Don’t forget that the Democrats have been pushing to pack the Supreme Court for years. They want 13 KBJs issuing rulings that benefit their preselected winners. Worse, the DSA wants to effectively abolish the Supreme Court as it exists. The DSA platform claims it will establish “a real democracy” by “replac[ing] the President and Supreme Court with an executive and judiciary chosen by and subordinate to Congress.”

Like Ketanji Brown Jackson, the DSA aims to subvert the constitutional Republic our Founders established 250 years ago. Michelle Obama’s podcast just provides a convenient platform to build an audience for that perverted kind of hope and change.
