The Law of Israel commanded that those making false accusations of a crime should suffer the same penalty accruing to that crime. If a politician seeks to destroy a rival with made-up tales of sexual immorality, his own reputation should be mud. After all, it takes a dirty mind to come up with such stories. “Neither Congress nor an executive agency was intended to have unlimited power to regulate ‘whatever may affect interstate commerce.’ The power to ‘regulate commerce among the states’ was intended chiefly to keep states from engaging in protectionist practices, such as California’s demand that all pork be raised according to its regulations. Yet it is useful to have safety standards recognized nationally. Perhaps the answer is to require the FDA to submit any proposed changes to a food safety database to Congress for approval, and to ensure product liability lawyers have access to it.
