Biden’s ‘Shadow Amnesty’ Play
The Biden administration is packing the immigration courts to further his nefarious open-borders agenda.
There has been an illegal immigration crisis at the southern border ever since Joe Biden took office — a crisis that we have repeatedly noted is intentional. Biden’s de facto open-borders policy is part of a larger strategy designed to swell the ranks of the Democrat Party. In fact, the main reason behind the Left’s howling over Donald Trump’s eventually blocked attempt to include a citizenship question in the 2020 Census had everything to do with this duplicitous immigration non-enforcement strategy.
Thus, it comes as little surprise that Biden officials have been engaging in unprecedented actions to remove as many obstacles to their immigration strategy as possible. And that unprecedented action comes with the Justice Department’s removal of several senior officials and Trump-era judges at the Executive Office of Immigration Review (EOIR).
One of the booted judges, Matthew O'Brien, pinpointed what was behind his firing. “It’s an attempt to weaponize the courts along ideological lines,” he said. “It’s court packing on steroids. It’s court packing by deletion and then addition, because they’re getting rid of judges and they’re replacing them with people who meet their ideological framework.”
Another official within the EOIR agreed: “This turnover is unprecedented in the history of EOIR, and it all appears to be politically motivated in an effort to install Biden allies and pro-Democrat advocacy group supporters in both leadership and adjudicatory positions.”
The EOIR is a division of the Justice Department that consists of roughly 590 immigration judges who make decisions regarding specific issues, e.g. the deportation of noncitizens. These judges are directly hired by the DOJ and are not subject to Senate confirmation. As such, they can be fired by the attorney general, and several such as O'Brien have been.
O'Brien’s claim that his ouster was politically motivated is compelling. He was brought into the EOIR during the Trump administration after he previously worked as director of Federation for American Immigration Reform (FAIR), an organization that advocates for strict immigration enforcement. Further adding to O'Brien’s contention that his firing was politically motivated is the reality that the number of immigration cases have ballooned since Biden took office. The number of migrants caught illegally entering the country by U.S. Border Patrol has been setting records month after month.
The great irony in all this is that at the start of Trump’s presidency, it was the Leftmedia and Democrats wringing their hands over the potential that the new tough-on-immigration president would fill the EOIR with judges who would work to rubber-stamp his agenda. That fear never materialized. Now under Biden, however, the very politicization of the EOIR that the Left warned about is happening.
