One week from today President Trump will announce his pick for the Supreme Court. The Sunday talk shows were abuzz yesterday with talk about the great constitutional questions facing our Republic — immigration policy, separation of powers, surveillance law, insurance mandates... Just kidding, of course.

Congress and the Wayfair Shakeup
A few weeks ago, I wrote about the importance of the Supreme Court’s upcoming decision in the Wayfair vs. South Dakota case. Last week, the Court sided with South Dakota in a narrow ruling to overturn its own precedent (Quill vs. North Dakota) that states cannot force businesses to collect and remit sales taxes unless the business has a physical presence in their state. This ruling raises serious concerns about the future of Internet commerce.

With Its Janus Decision, the Supreme Court Corrected Itself on First Amendment Freedoms
The Supreme Court is especially admirable when correcting especially deplorable prior decisions, as with the 1954 school desegregation decision rejecting a 1896 decision’s “separate but equal” doctrine. It did so again last Wednesday, overturning a 41-year-old precedent inimical to the First Amendment.

In Order to Form a More Perfect Labor Union...
Was it a meeting of the National Education Association or the Democratic National Committee? At times it was tough to tell. Like a lot of unions, the line between politics and actual worker advocacy hasn’t existed — not in the NEA, not in Teamsters, United Steelworkers, or any number of Democratic slush funds posing as public-sector interest groups.
