Biden Puts Bullseye on SCOTUS

He plans to introduce legislation including term limits on the justices and an enforceable ethics code.

Joe Biden will soon announce plans to introduce legislation targeting the U.S. Supreme Court. According to sources, this legislation includes term limits on justices and enforceable ethics codes on the Court.

The Washington Post reports that Biden is also considering calls for a constitutional amendment that would eliminate presidential immunity, just affirmed by the Court earlier this month.

A transcript of Biden’s planned announcement obtained by the Post reads, “I’m going to need your help on the Supreme Court because I’m about to come out — I don’t want to prematurely announce it — but I’m about to come out with a major initiative on limiting the Court. … I’ve been working with constitutional scholars for the last three months, and I need some help.”

Clearly, Biden desires to limit the Court because the Court, as designed by the Constitution, has limited him. Biden doesn’t like to be checked by SCOTUS. Furthermore, Democrats don’t like the fact that the conservative-leaning Court has overturned historically bad decisions, the biggest one being Roe v. Wade. Never mind that even the late Ruth Bader Ginsburg, one of the Democrats’ favorite justices, was critical of Roe and thought it was bad jurisprudence even though she saw abortion as a “right.”

Biden’s targeting of the Court is just the latest play in the Democrats’ long-running effort to assert authority over the conservative-leaning Court. The Leftmedia smear campaign against Justices Clarence Thomas and Samuel Alito over bogus ethics complaints was intended to lay the groundwork for this move by Biden against the Court. It certainly has affected public opinion.

Furthermore, Biden, whose Justice Department has been engaged in lawfare against Donald Trump, has cited the Court’s decisions regarding presidential immunity as justification for a constitutional amendment. Talk about petty. If it wasn’t for Biden’s lawfare against Trump, then the notion of even considering an amendment eliminating presidential immunity would never have arisen.

Democrats have long called for changing the rules when they aren’t getting their way politically. They are not concerned with fairness; rather, they are concerned with power.

Biden has repeatedly pushed forward executive orders, such as his student loan transfer scheme, and has been checked for his overreach by the Court. This is exactly how our system of government is supposed to work. Biden doesn’t like it — though in the case of student loans, he proceeded anyway. And rather than respecting the judicial branch’s coequal constitutional authority, he’s seeking to assert executive authority over it because he doesn’t agree with its decisions.

The vacuous charge that the Court is politicized is the Democrats’ excuse for politicizing the Court, and Biden is now taking the next step on that politicization.

Thankfully, with Republicans in control of the House, and with the Senate needing to meet the filibuster-proof 60-vote threshold, the possibility of this legislation seeing any success right now is next to nothing. However, it will still be used by Biden and the Democrats for political fodder in an election year.

This is what Joe Biden is reduced to as he falls further behind Donald Trump in the polls.
