California Expands Gun Confiscation
California Gov. Jerry Brown officially implemented a new gun control law Tuesday with a swipe of his pen. The new rule, set to begin Jan. 1, means California is “the first state to allow family members to ask a judge to temporarily seize guns from someone who is suspected of posing an immediate danger,” The Wall Street Journal reports. “Under the legislation … family members or law-enforcement officers can petition to remove firearms from an individual. Authorities in Connecticut, Indiana and Texas can ask a judge to let them seize guns from people they deem to be dangerous. The California law extends the provision to relatives.” There unquestionably are individuals who pose a danger and should be disarmed. The issue here is the many ways this new law will likely be exploited and abused. As the NRA noted in opposing the legislation, “This bill’s low evidentiary standard and lack of a mechanism for individuals to present their own defense before being deprived of their constitutional rights fail to meet American standards for due process of law.” The Golden State is once presenting a bad solution to a problem not easily reconciled.
