Judge Struck Down Obama’s Policies on Housing
A judge struck down the Obama administration’s disparate impact racial theory when it tried to apply it to housing. The administration tried to build a case that it could use the Fair Housing Act to go after banks, apartment complexes and landlords for civil rights violations if their business habits showed statistical disparities affecting minorities, as opposed to there being actual hard evidence of discrimination. “The American Insurance Association and the National Association of Mutual Insurance Companies brought the legal challenge on behalf of home insurers,” The Wall Street Journal wrote. “Judge [Richard] Leon wrote that the HUD rule would ‘have a wide-ranging disruptive effect on the pricing and provision of homeowner’s insurance’ and raise ‘serious concerns regarding widespread federal encroachment upon state insurance regulation.’” As WSJ notes: It’s just another Obama policy that has been knocked down and checked by the courts.
